The meeting was called to order at 9:00 AM MST by Victor Villegas.

 

 

APPROVAL OF MINUTES

 

A motion was made by Mr. Annen to approve the minutes of November 3, 2010. Seconded by Mr. Burnell, motion carried.

 

LEGISLATIVE REPORT

 

Ms. Cory presented the legislative report to the Board members.

 

FINANCIAL REPORT

 

Ms. Hall gave the financial report.  This report is available on the website. As of 01/31/2011 the Board has $97,736.78 in expenditures with a cash balance of $476,941.79. 

INVESTIGATIVE REPORT

 

Ms. Peel presented the investigative report.

 

CONSENT ORDER

 

A motion was made by Mr. Burnell to accept the Notice of Violation and Settlement Order for case WWP-2011-2 and approve the Board Chair to sign. Seconded by Mr. Wilder, motion carried.

 

ABC EXAMS

           

The Board reviewed the ABC Pass/Fail report for 2009 and 2010. The Board determined it would like to receive this report annually.

 

BAT INSTRUCTOR QUALIFICATIONS

 

Mr. Wilder presented a draft of the BAT instructor qualifications to the Board for review.

 

A motion was made by Mr. Annen to draft the rule to consider for BAT instructor qualifications for comparison with the past DEQ instructor qualifications; and to review the course and refresher course criteria. Seconded by Mr. Holton, motion carried

 

ABC CONFERENCE UPDATE

 

Mr. Wilder presented to the Board members an update on the ABC Conference he attended in Phoenix, Arizona on January 25 – 28, 2011. He stated that the focus is to ensure operator competence and continuing education courses.

RULES DISCUSSION

 

The Board members reviewed and discussed the draft proposed rules from the sub-committee. There were suggested revisions and the Board will review them at its next meeting on May 5, 2011.

BOARD MEMBER PLAQUE

 

Mr. Villegas informed the Board members that Mr. Dees has resigned his position on the Board effective immediately for personal reasons.

 

A motion was made by Mr. Wilder to order a plaque fro Mr. Dees for his service on the Board. Seconded by Mr. Burnell, motion carried.

BOARD TERM LIMITS

 

Mr. Villegas proposed to the Board members that the term limits for Board members be revised. After discussion, the Board agreed that changes were not necessary at this time.

ABC ANNUAL DUES

 

A motion was made by Mr. Burnell to pay the annual dues for ABC’s examination services. Seconded by Mr. Wilder, motion carried.

 

CE APPLICATION AND CERTIFICATE REQUIREMENTS

 

The Board reviewed the CE application and requested that the wording for the instructor information be listed as follows: List name(s) of instructors (attach a resume for each instructor outlining their qualifications, education, experience, and license number).

 

The Board discussed having a renewal application for providers that are submitting the same course where the information and instructor has not changed. The Board members determined to not change the process. Providers need to submit the completed application and submit the required documentation as outlined on the application.

 

“The Operator and Provider Guidelines” are outdated and inaccurate; it was suggested that these guidelines be removed from the IBOL website.

 

A motion was made by Mr. Holton to table the discussion regarding the “Operator and Provider Guidelines” to the next meeting. Seconded by Mr. Burnell, motion carried.

 

Mr. Burnell informed the Board members that Brown Environmental’s contract with DEQ has expired and they are not applying for the new contract.

 

CORRESPONDENCE

 

The Board reviewed and discussed John Solvie’s letter from ABC. Mr. Wilder will respond and complete the Continuing Education Review Program survey.

 

The Board reviewed and discussed the e-mail received from Suzanne Scheidt; Mr. Burnell will respond to her question regarding operator experience.

 

The Board reviewed and discussed the e-mail from Kimberly Ellsworth.

 

A motion was made by Mr. Burnell for the Bureau to respond to Ms. Ellsworth. Seconded by Mr. Annen, motion carried.

 

The Board reviewed and discussed an e-mail received from Jon Herrick regarding licensure experience.

 

A motion was made by Mr. Holton for the Bureau to draft a response for Mr. Annen to review and for the Board Chair to sign. Seconded by Mr. Burnell, motion carried.

 

The Board reviewed and discussed an e-mail received from Dean Renninger regarding his college transcripts. The Board determined that he would need to submit official transcripts and identify the relevant courses he would like the Board to approve for continuing education credit.

 

The Board reviewed an e-mail from Ronald O’Connor and determined that an official transcript should accompany his application for licensure for the Board to review.

 

The Board reviewed and discussed an e-mail from Marla Carter regarding Remote Training CEU Approval Strategy Meetings. Mr. Burnell will respond to her inquiry.

 

EXECUTIVE SESSION

 

A motion was made by Mr. Burnell that the Board go into executive session under Idaho Code § 67-2345(1) (d) to consider records that are exempt from disclosure under the Idaho Public Records Law. The purpose of the executive session was to consider license application materials. Seconded by Mr. Annen. The vote was: Mr. Burnell, aye; Mr. Holton, aye; Mr. Annen, aye; Mr. Wilder, aye; and Mr. Villegas, aye, motion carried.

 

A motion was made by Mr. Holton to come out of executive session. Seconded by Mr. Annen. The vote was: Mr. Burnell, aye; Mr. Holton, aye; Mr. Annen, aye; Mr. Wilder, aye, motion carried.

 

A motion was made by Mr. Holton to approve 15 applications for licensure; to approve

103 applications for examination; to deny 11 applications; and to hold three applications for receipt of additional information. Seconded by Mr. Holton, motion carried.

 

A motion was made by Mr. Holton to approve 181 Continuing Education courses and to deny 33 courses. Seconded by Mr. Annen, motion carried.
