 APPROVAL OF MINUTES

 

A motion was made by Mr. Annen to approve the minutes of August 5, 2009. Seconded by Mr. Holton, motion carried.

 

LEGISLATIVE REPORT

 

Ms. Cory presented the legislative update to the Board.

 

A motion was made by Mr. Holton to post the PERSI bill information on the Board’s website. Seconded by Mr. Burnell, motion carried.

 

FINANCIAL REPORT

 

Ms. Cory gave the financial report.  This report is available on the website.  As of 09/30/2009, the Board has $52,035.19 in expenditures with a cash balance of $433,437.14.

 

FY 2010 RENEWAL CONTRACT

 

Ms. Cory presented the FY 2010 Renewal Contract to the Board.

 

A motion was made by Mr. Villegas to accept the 2010 Contract as presented and to authorize the Board Chair to sign the contract. Seconded by Mr. Holton, motion carried.

 

MEMORANDUM – CONTINUING EDUCATION AUDITS

 

Ms. Peel presented a memorandum to the Board for review and clarification regarding CE audit failures.

 

Expired Licenses: The Board directed Ms. Peel to send stipulations to everyone.

 

Voluntary Surrenders: A motion was made by Mr. Annen that if a licensee surrenders their license; the Board will not take any further action and absorb the costs. Seconded by Mr. Holton, motion carried.

 

Sanctions: The Board stated that for the first offense on all licenses there would not be a fine but directed Ms. Peel to impose $100 in costs. For the second offense a $250 fine and costs for drinking water and wastewater licensees would be imposed. There would be $100 in costs and a reprimand for BAT licensees.

 

WWP-2008-10: The Board directed Ms. Peel to send a stipulation and require the licensee to pay costs. Mr. Burnell informed Ms. Peel that DEQ has a reimbursement program for water operators with less than 3300 connections.

 

WWP-2010-17: The Board directed Ms. Peel to request medical documentation from the licensee’s doctor.

 

WWP-2010-24: A motion was made by Mr. Burnell to approve the AWWA Membrane Technology Conference & Exposition conference held in Tampa, Florida on March 19-21, 2007. Seconded by Mr. Holton, motion carried.

 

Mr. Annen recused himself from the discussion and vote.

 

WWP-2010-26: The Board instructed Ms. Peel to notify the licensee that if the licensee did not wish to enter into a stipulation, the licensee needs to submit a CE application and seek Board approval for the course.

MITIGATIONS

 

Mr. Chick addressed the Board regarding Case No. WWP-2010-18.

 

Mr. Lee addressed the Board regarding Case No. WWP-2010-32.

 

Mr. Wallace addressed the Board regarding Case No. WWP-2010-33.

 

A motion was made by Mr. Burnell that the respondent in Case No. WWP-2010-18 pay $100 in costs in two payments. Seconded by Mr. Holton, motion carried.

 

A motion was made by Mr. Burnell to require the respondent in Case No. WWP-2010-32 to provide medical documentation within 60 days; upon receipt of medical documentation, the CEs can be waived. If medical documentation is not received, there will not be a fine, but the respondent must pay $100 in costs and obtain his CE. Seconded by Mr. Holton, motion carried.

 

A motion was made by Mr. Burnell to require the respondent in Case No. WWP-2010-33 to make up six hours of CE for the audit period; provide proof of CE for next renewal period; and pay the $100 in costs in two payments. Seconded by Mr. Holton, motion carried.

 

FERGUSON WATERWORKS

 

Ms. Peel presented to the Board the CE application from Ferguson Waterworks. The application had been submitted and approved for three separate days for two hours each day. The provider had given operators a certificate for six hours of CE. The Board stated that the provider must provide the agenda, course materials, and instructor biographies to support the approval for six hours. If the provider cannot provide the required documentation the operator in question will need to obtain the additional four hours of CE within 90 days.

 

CORRESPONDENCE

 

Mr. Hales presented to the Board the draft letter to the Engineering Board. The Board approved the letter and directed Mr. Hales to send it.

 

RULES DISCUSSION

 

The Board reviewed the Administrative Rules Hearing transcript from October 22, 2009.

 

Mr. Leedy addressed the Board with questions regarding the proposed rules.

 

Mr. Burnell explained the difference for the Very Small Water System classification of 500 people and the Wastewater Very Small System classification of 500 connections. The WWVSS classification uses connections to open up a broader pool and opportunity.

 

Mr. Leedy requested the following clarification regarding the restricted license:

 

1)     A restricted license is for a Class I only. An operator has an unlimited amount of time to obtain the required 1600 hours to upgrade to the unrestricted license.

2)     The restricted license is for one system only. An operator cannot use his restricted license at another facility as a back-up operator.

3)     An operator can hold multiple restricted Class I licenses.

4)     A system can have more than one person with a restricted license.

 

Mr. Tominaga will prepare a letter from the Idaho Rural Water Association stating they are in support of the proposed rules and include any concerns they may still have.

 

A motion was made by Mr. Burnell to approve the proposed rules as submitted and direct IBOL to submit them to the Legislature. Seconded by Mr. Villegas, motion carried.

 

ELECTION OF BOARD CHAIR

 

Nominations were made for the election of the Board Chair.

 

A motion was made by Mr. Burnell to close the nominations for Board Chair. Seconded by Mr. Villegas, motion carried.

 

A motion was made by Mr. Annen to elect Mr. Thompson as Board Chair until his term expires and he has been replaced. Seconded by Mr. Villegas, motion carried.

 

A motion was made by Mr. Annen to elect Mr. Villegas as Vice-Board Chair. Seconded by Mr. Holton, motion carried.

 

A motion was made by Mr. Annen to break for lunch and return at 1:00 PM. Seconded by Mr. Villegas, motion carried.

I-WWP-2007-28, I-WWP-2009-18:  Rs initially provided documentation of CE outside the audit periods in response to audit requests, but later provided documentation verifying adequate CEs to carry over to the audit periods.  IBOL recommends the Board authorize closure.    

 

A motion was made by Mr. Annen to close the cases. Seconded by Mr. Holton, motion carried.

   

I-WWP-2008-12, I-WWP-2008-17, I-WWP-2008-24:  Rs are BATs who submitted CE documentation showing that BAT refresher courses were taken one to three months before the audit periods.  Board Rule 500.01 requires BATs to complete an 8-hour refresher course “every two (2) years for license renewal.”  At the time Rs submitted their renewals, the form asked, “Have you met the continuing education requirement as prescribed by the laws and rules applicable to the license identified by this application?”  Neither the rule nor the application specifically required that the refresher course be completed within 24 months of submitting the application.  (The renewal application has since been revised to ask, “Prior to your submission of this renewal application, have you completed an eight (8) hour refresher course in Backflow Assembly Testing during the previous 24 months?”)   IBOL recommends the Board authorize closure.

 

A motion was made by Mr. Annen to close the cases. Seconded by Mr. Holton, motion carried.

 

I-WWP-2008-21, I-WWP-2008-23, I-WWP-2008-25:  In response to audit requests, Rs submitted documentation showing that they attended BAT refresher courses one to four months after renewal but in the same year of renewal.  One R also included a letter stating that he thought he had to complete the class in the renewal year but did not realize the course had to be completed before renewal, and R apologized for the late course attendance and stated that it will not happen again.  (Again, the renewal application has since been revised.)  IBOL recommends that the Board authorize closure with warning letters to Rs advising Rs that in the future, the refresher course must be completed within two years prior to renewal.

 

A motion was made by Mr. Holton to close the cases and to send a warning letter that the refresher courses must be completed within two years prior to renewal. Seconded by Mr. Burnell, motion carried.

 

I-WWP-2009-1, I-WWP-2009-31:  R initially failed to respond to the CE audit request, but later provided documentation verifying completion of CE during the audit period.  IBOL recommends the Board authorize closure.    

 

A motion was made by Mr. Burnell to close the cases. Seconded by Mr. Annen, motion carried.

       

I-WWP-2009-14:   R attempted to renew her license on 7/11/08 but failed to answer the CE question on the renewal.  On 8/4/08 R explained that she had open heart surgery and two hernia operations during the past year and was unable to attend CE.  IBOL requested R provide documentation for medical CE waiver.  R provided a letter from her doctor (not on letterhead) stating that because of ongoing illness, R was “unable to make meetings in 2007.”  R was reinstated on 12/9/08.  On 2/11/09 Board members reviewed documentation for reinstatement and found that R failed to provide adequate documentation for medical waiver of CE.  R’s license expired on 8/11/09 and has not been renewed.  IBOL recommends that the Board authorize closure with a warning letter to R.

 

A motion was made by Mr. Villegas to not close the case and to send a stipulation and consent order. Seconded by Mr. Holton, motion carried.

 

I-WWP-2009-16:   R attempted to reinstate his license online on 7/24/08 and answered “yes” to the question, “Have you met the continuing education requirement as prescribed by the laws and rules applicable to the license identified by this application?”  On 7/28/08 IBOL informed R that he needed to provide CE documentation before his license could be reinstated.   R subsequently provided documentation of having attended an approved 14-hour course on 10/15/08-10/16/08 and an approved 6-hour course on 1/16/09.  R stated that he believed he could not take CE until he had renewed his license and was employed in the field, and that he informed IBOL he would not be taking the CE until he was employed.  R stated he has done all he can to get his license reinstated.  IBOL recommends that (1) R’s license be reinstated and (2) IBOL send R a warning letter to R reminding him that, in the future, he cannot certify on a renewal/reinstatement application that he has obtained CE that he has not yet taken.

 

A motion was made by Mr. Annen that the respondent’s license be reinstated and a warning letter be sent reminding him that he cannot certify on a renewal/reinstatement application that he has obtained CE that he has not taken yet. Seconded by Mr. Burnell, motion carried.

 

I-WWP-2009-26, I-WWP-2010-5:  Rs provided documentation of CE outside the audit periods in response to audit requests.  Rs believed that they had until their birthdays to obtain the required CE.  Documentation shows that Rs obtained the CE after they renewed but before their birthdays.  IBOL recommends closure with an advisory letter to Rs.

 

A motion was made by Mr. Burnell to close the cases and send an advisory letter. Seconded by Mr. Holton, motion carried.

 

I-WWP-2009-27:   R provided documentation of CE outside the audit period in response to an audit request. R’s CE audit period was February 2007 to February 2008.  Army records show that R was deployed in Afghanistan from May through November 2008.  In addition, R attended a 14-hour WW course before deployment and during his audit period because, according to R, students were told that the course could also be used for DW CEs.  Based on R’s deployment and belief that the WW course would apply to his DW license, IBOL recommends that the Board authorize closure of this case with a warning letter to R to check the Board’s web page in the future to ensure that the course he wishes to take has been approved for his license.

 

A motion was made by Mr. Burnell to send a stipulation and consent order with no fines, but require respondent to pay costs in payments, and make up six hours of CE. Seconded by Mr. Holton, motion carried.

 

I-WWP-2009-50:   R submitted documentation in response to a CE request and the Board was unable to verify which courses R attended.  The CE provider subsequently provided documentation verifying courses attended by R and that R obtained required CE during audit period.  IBOL recommends the Board authorize closure.

 

A motion was made by Mr. Annen to close the case. Seconded by Mr. Burnell, motion carried.

 

I-WWP-2009-54:   R submitted documentation in response to a CE request showing 19.5 hours of non-approved CE.  R subsequently provided documentation of having attended Board-approved CE and verifying compliance during the audit period.  IBOL recommends the Board authorize closure.

 

A motion was made by Mr. Annen to close the case. Seconded by Mr. Burnell, motion carried.

 

I-WWP-2009-57:   R submitted documentation in response to a CE request and Board was unable to verify approval or relevancy.  R subsequently provided a transcript from the State of WA documenting attendance at approved CE.  IBOL recommends the Board authorize closure.

 

A motion was made by Mr. Burnell to close the cases. Seconded by Mr. Villegas, motion carried.

 

I-WWP-2009-59:      R submitted documentation in response to a CE request and Board was unable to verify which courses R attended.  R subsequently provided documentation verifying appropriate CE during audit period.  IBOL recommends the Board authorize closure.

 

A motion was made by Mr. Annen to close the case. Seconded by Mr. Villegas, motion carried.

 

I-WWP-2010-6:  In response to an audit request, R submitted documentation showing he attended 5 Board-approved courses for a total of 6 hours of CE.  One of the courses, however, is listed on the provider’s website as 2 hours and the provider provided R with a transcript showing that the course was approved for 2 hours, but the provider applied for and the Board approved the course for only 1 hour, leaving R 1 hour short.  IBOL recommends that the Board authorize closure with a letter to the provider advising the provider that it needs to ensure that CE approval applications are completed for the correct amount of hours.

 

A motion was made by Mr. Villegas to authorize IBOL to send a letter to the provider advising the provider that CE applications must be completed for the correct amount of hours. The licensee must obtain one hour of relevant CE within 90 days and IBOL will report back to the Board. Seconded by Mr. Burnell. Motion carried.

 

CONTINUING EDUCATION SETTLEMENT ORDERS

 

A motion was made by Mr. Villegas submit the amended settlement order for WWP-2009-4 pertaining to the changes in paragraph four changing CE to refresher. If the licensee agrees to the changes, the Board Chair is authorized to sign the Notice of Violation. Seconded by Mr. Holton, motion carried.

 

A motion was made by Mr. Villegas to submit the amended settlement order for WWP-2009-6 pertaining to the changes in paragraph four changing CE to refresher and in paragraph seven changing the year from 2010 to 2011. Seconded by Mr. Holton. motion carried.

 

A motion was made by Mr. Villegas to amend the motion pertaining to the settlement order WWP-2009-6 to authorize the Board Chair to sign the Notice of Violation if the licensee agrees to the changes. Seconded by Mr. Burnell, motion carried.

 

A motion was made by Mr. Burnell to submit the amended settlement order for WWP-2009-11 pertaining to the changes in paragraph four changing CE to refresher and in paragraph seven changing the year from 2009 to 2010. If the licensee agrees to the changes, the Board Chair is authorized to sign the Notice of Violation. Seconded by Mr. Holton. motion carried.

A motion was made by Mr. Villegas to accept the settlement order for WWP-2010-9 with the amendments that paragraph four be stricken from the order and refund $250 to the licensee. If the licensee agrees to the changes the Board Chair is authorized to sign the Notice of Violation. Seconded by Mr. Burnell, motion carried.

EXAM UPDATE

 

Ms. Miles presented the exam update to the Board. The failure rate ranges from 40% to 50% for each exam. There is not any difference in failure rates between examinees that have taken the exam online verses written.

 

The Salmon and McCall Department of Labor offices are able to provide written exams; online exams are not an option. The Sandpoint DOL office can provide written and online. The Bureau will contact DOL and find out if Pocatello would be a possible exam location for written and online.

 

There have been an additional four exam dates added to the 2010 schedule; these exams are online only. The exam schedule will be posted to the Board’s website.

 

A motion was made by Mr. Holton to approve the application deadlines, exam dates and board meeting dates for 2010. Seconded by Mr. Villegas, motion carried.

 

ABC CONFERENCE

 

The Board discussed attending the ABC Conference being held in Jacksonville, Florida on January 26-29, 2010. Mr. Annen will attend and update the Board at the February 3, 2010 meeting.

 

MULTIPLE EXAMS

 

The ABC Board of Directors voted to phase out the ABC multiple-entry examinations. The current versions of the ABC multiple-entry standardized exams will be supported by ABC through January 1, 2011 but ABC will no longer develop multiple-entry exams after January 1, 2011. This decision was based on the data analysis that was shared with other states on July 28, 2009 and from the subsequent feedback that was provided by current multiple-entry exam users.

 

Programs may still have a multiple-entry program but ABC will no longer offer a separate multiple-entry standardized exam. The following options will be provided to existing clients that would like to continue using multiple-entry exams:

 

1)     Programs may continue to use the pre-2011 version of the multiple-entry standardized exams through January 1, 2012.

2)     ABC will waive the $55 exam development fee for current clients choosing to develop prescriptive multiple-entry exams through January 1, 2012. After January 1, 2012 our program would be responsible for paying a $55 exam development fee for each prescriptive exam developed.

 

The Board will discuss their options at the February 3, 2010 meeting.

 

CE FOR INSTRUCTORS

 

Mr. Villegas will research other programs regarding instructors receiving CE for their own classes and bring his findings back to the Board at the February 3, 2010 meeting.

 

BAT INSTRUCTOR QUALIFICATIONS

 

Mr. Thompson will develop a draft of BAT instructor qualifications and bring back to the Board at the February 3, 2010 meeting.

 

MINUTES CORRECTIONS

 

The State of Washington requested corrections in the May 13, 2009 minutes.

 

A motion was made by Mr. Holton to reflect Washington’s concerns in the November 4, 2009 minutes. Seconded by Mr. Villegas, motion carried.

1.  "The Association of Boards of Certification exam is not used" - this is not correct.  Washington State uses the Association of Boards of Certification (ABC) written exam for Backflow Assembly Testers (BAT).  The practical exam is not ABC's, it is Washington's. 

2.  Correct the statement "WA has four different exams locations for exams.”

3.  For information on BAT exam dates and locations see www.wacertservices.org.

4.  "The continuing education requirement is every three years and it does not need to be relevant to Backflow Assembly Tester licensure."  The professional growth requirement must be met every 3 years.  To meet the requirement the BAT must pass the practical exam during the 3 year reporting period.  This has nothing to do with relevancy.

EXECUTIVE SESSION

 

A motion was made by Mr. Burnell that the Board go into executive session under Idaho Code § 67-2345(1)(d) to consider records that are exempt from disclosure under the Idaho Public Records Law.  The purpose of the Executive Session was to consider license application materials.  Seconded by Mr. Villegas. The vote was: Mr. Burnell, aye; Mr. Holton, aye; Mr. Villegas, aye; Mr. Annen, aye; and Mr. Thompson, aye. Motion carried.

 

A motion was made by Mr. Burnell to come out of executive session. Seconded by Mr. Holton. The vote was: Mr. Burnell, aye; Mr. Holton, aye; Mr. Villegas, aye; Mr. Annen, aye; and Mr. Thompson, aye. Motion carried.

 

A motion was made by Mr. Holton to approve 107 applications for exam; 30 applications for licensure and deny 14 applications. Eight CE applications were approved. Seconded by Mr. Burnell, motion carried.
