Minutes of October 5, 2005

The meeting was called to order at 9:00 a.m. by Chair, Bill Thompson.   

Motion was made by Mike Schroeder to accept the minutes of the July 27, 2005 board meeting as amended; seconded by Victor Coles; motion passed. 

Ms. Jacobsen presented the legislative report. The remodel is completed. WWP licenses have increased to 3000. The Governors office is pleased with the proposal to lower fees. There have been two break-ins in the hotel, both occurred with state offices. The Historical Society and the Board of Accountancy. Both instances involved computer theft. IBOL has not been affected. The thief was apprehended. The DEQ files should be scanned within 6 months. File cabinets that cannot be used will be sent to surplus. Rule changes have been submitted, accepted and will be presented to the legislature. The Chair, Bill Thompson was asked to appear at the committee hearings. Mr. Thompson agreed.

We are trying to shorten the examination turn around time so that results are received sooner.

Two additional staff have been hired and the Investigative Division has been increased by three.

The additional Deputy Chief will start soon. Contractor registration is anticipated to become heavy in the next few months.  

Investigative Report: In the Fiscal Year 2006 there have been no complaints. Fiscal Year 2005 there were 2 complaints, one is closed and the other is under investigation.  

Mr. Hetrick presented the financial report. As of 9-30-05 the board had $34,898.82 in expenses and a cash balance of $196,332.65. The lease and attorney general’s office are prepaid for the fiscal year. The Bureau receives a 3% discount received for prepayment. 

Discussion held regarding changing  the term “management” in the Education and Experience Clause of Rule 300.02.e, f. This will be a proposed rule change in Legislation  for the 2006 Legislature. The Board will look at changing terminology next spring. 

Motion made by Mike Schroeder for the Board secretary to maintain a list of tabled items for proposed rule changes. Seconded by Ross Spackman, motion passed. 

Discussion concerning web links to old applications for licensure. Nancy Bowser from DEQ informed the Board that the links to old applications have been researched and removed.  

Discussion held on requiring photo identification. Photo identification is required for examinations. Proof of age is required for new applications. Birth certificate, military ID, passport, or valid driver’s license is acceptable proof of age. 

Discussion held regarding notarization of applications.  

Discussion held on system classification worksheets. System Classification worksheets are required if the system is not on the list provided by DEQ. All systems that have applied to DEQ have received a letter stating their classification. This letter is to be kept by the owner and submitted with all applications for operator licensure. This is not mandatory for system owners to have until 2008. A system classification when signed by the operator instead of by the owner and when the box is not completed by DEQ is incomplete. Worksheets are required for all class level applications if the system is not on the DEQ list.  

Discussion was held on examination letters sent to applicants. Letters sent to applicant’s states date, time and location.  

Discussion was held regarding Operator in Training licensure. 

The Wastewater Treatment Land Application examination has been submitted to ABC and will be available for the November examination. 

Nancy Bowser presented training material for the Wastewater Treatment Land Application course. Training will clearly instruct that this is an initial exam not an endorsement for application purposes. The Wastewater Treatment Land Application license is a supplemental license for the Wastewater Treatment license. WLAP license cannot be grandfathered. Training will be available in Twin Falls and Moscow. Training will not be available in Boise at this time. More locations will be added next year. Training manuals are available on the DEQ website.

The meeting was called back to order at 11:00 a.m. 

Mr. Hales presented the Idaho Rural Water Association letter. Board will re-address the letter in the spring inviting Mr. Munkers to attend the discussion. The Board requested IBOL to write a letter to Mr. Munkers. 

Motions was made by Robert Hansen for IBOL to write a letter to Mr. Munkers, Idaho Rural Water Association inviting him to attend the board meeting to discuss his letter. Seconded by Mike Schroeder, motion passed.

The February 1, 2006 board meeting was rescheduled for January 18, 2006. Discussion held regarding deadline dates. All applications must be in by the posted deadline date in order to be  reviewed by the board for examination.  

Motion made by Victor Coles to approve the new board meeting dates, deadline dates and examination dates for 2006. Seconded by Mike Schroeder, motion passed. 

Motion made by Robert Hansen that the Board delegates Victor Coles the authority to vote on behalf of the Board on the changes to the ABC bylaws. Seconded by Mike Schroeder, motion passed. 

The Board adjourned for lunch at 11:55 p.m. 

The meeting was called back to order at 1:00 p.m. 

Discussion held on the April 15, 2006 deadline date for operator licensure. The only license that has been extended to April 15, 2007 is the Wastewater Treatment Land Application license. All other operators must be licensed by April 15, 2006. DEQ will take appropriate action towards those not in compliance. Letters will be sent by DEQ to all systems regarding operator deadline.

Motion was made by Ross Spackman to go into Executive Session to review applications exempt from public disclosure per Chapter 3, Title 9, Idaho Code. Seconded by Kevin Pfenning, motion passed.
