For Board Determination:

 

I-WWP-2008-8R initially failed to respond to the audit request but subsequently provided documentation of having obtained a BAT refresher course during the audit period.IBOL recommends the Board authorize closure.

 

I-WWP-2008-10R initially sent in documentation in response to an audit request showing that R took a BAT refresher course one month after renewal.R later submitted documentation showing that R took a BAT refresher course within two years of renewal.IBOL recommends the Board authorize closure.

 

I-WWP-2009-1, I-WWP-2009-31, I-WWP-2009-38, I-WWP-2010-8, I-WWP-2010-9, I-WWP-2010-11, I-WWP-2010-12, I-WWP-2010-13, I-WWP-2010-15Rs initially failed to respond to the audit requests but subsequently provided documentation verifying completion of appropriate CEs.IBOL recommends the Board authorize closure.

 

I-WWP-2009-3R is a BAT and failed to respond to an audit request.On 1/9/09 and again on 8/12/09 R was notified by IBOL that if he failed to respond to the audit request, the matter may be turned over to the Attorney Generalís Office.Rís license expired on 6/20/09 and has not been renewed, and on 11/24/09 R was notified that he could surrender his renewal rights without having to pay a fine for his failure to comply with the audit request.On 12/7/09 R informed IBOL that he obtained a BAT refresher course within two years of renewal and believed the provider had submitted documentation to the Board.R was instructed to contact the provider and obtain the necessary documentation.On 1/8/10 IBOL sent R a letter asking R to provide an update as to whether R would like to surrender his renewal rights or whether R had obtained the documentation.R has failed to respond to IBOLís letter.IBOL recommends that the Board authorize either (1) closure, (2) referral to the Attorney Generalís Office to file a Complaint against Rís renewal rights, or (3) any other action the Board wishes, including issuance of a warning or advisory letter to R.

 

I-WWP-2009-27††††† The Board reviewed this case at its meeting on 11/4/09.Because of a typographical error, IBOL mistakenly reported to the Board that Rís CE audit period was 2/3/07 to 2/3/08 when, in fact, the audit period was 12/3/07 to 12/3/08.To refresh the Boardís memory, Army Corps of Engineer records show that R was deployed in Afghanistan from May through November 2008, 7 months of the audit period.In addition, R attended a 14-hour WW course before deployment and during the audit period because R believed that the course could be used for DW CEUs.Based on Rís deployment and Rís belief that the WW course would apply to his DW license, IBOL recommends that the Board authorize closure of this case with a warning letter to R to check the Boardís web page in the future to ensure that the course he wishes to takehas been approved for his license type.

 

I-WWP-2009-45R failed to respond to the audit request.Rís license expired on 9/16/09 and has not been renewed.R has failed to respond to two requests by IBOL to settle this matter or voluntarily surrender his license renewal rights.IBOL recommends that the Board authorize either (1) closure, (2) referral to the Attorney Generalís Office to file a Complaint against Rís renewal rights, or (3) any other action the Board wishes, including issuance of a warning or advisory letter to R

 

I-WWP-2009-61R submitted documentation in response to an audit request and the Board was unable to verify course approval.R subsequently submitted additional documentation and the course was approved for CE.IBOL recommends that the Board authorize closure.

 

I-WWP-2010-6The Board reviewed this case at its meeting on 11/4/09.In response to an audit request, R submitted documentation showing he attended 5 Board-approved courses for a total of 6 hours of CE.One of the courses, however, was listed on the providerís website as 2 hours and the provider provided R with a transcript showing that the course was approved for 2 hours, but Bureau records show that the provider applied for and the Board approved the course for only 1 hour, leaving R 1 hour short.At the 11/4/09 meeting, the Board requested that R obtain 1 hour within 90 days and that R be reminded that it is his responsibility to ensure that the CE he is taking has been approved by the Board.R was also directed to verify CEs on the Boardís website in the future.On 1/26/10 R provided documentation of completing 2 hours of Board-approved CE on 1/21/10.IBOL recommends that the Board authorize closure.

 

I-WWP-2010-7R initially failed to respond to the audit request.Subsequent documentation submitted by R shows that a 6-hour course taken by R has not been approved by Board but has been approved by State of Washington.IBOL recommends the Board authorize closure.

 

I-WWP-2010-16R has a DWDVSWS license and, in response to an audit request, submitted documentation of having attended 24 hours in the following courses:RCW/WAC Update Class (4 hours), 2008 NEC Chg. Pt. II (8 hours), Motor Control (8 hours), and Transformers (4 hours).†† Rís CE was rejected because all of the courses relate to electricians and have not been approved for water or wastewater operators.††† In response to the proposed stipulation, R requested that the Board reconsider its rejection of the CE.R stated that the courses he took were for Pump Installers-Electric in Idaho and Washington.R stated that the courses keep him current in NEC and controller devices for water well pump requirements, that he has maintained his licenses for the sole purpose of water well and wastewater repair, and that he also has a plumbing license for water well and automatic water control valves.R stated that he is the Water Master and President of a small community water system with less than 100 homes and that he repairs water leaks, cleans the reservoir and maintains the pumps and electrical controls at all hours (for which he is not compensated but performs as a community service).R also noted that the Board has approved Pumps & Motors courses in the past, and believes that the courses he submitted are similar.IBOL requests that the Board provide guidance regarding its decision to reconsider Rís courses.
