The meeting was called to order at 8:37 AM MST by Andrew J. Seitz.
APPROVAL OF MINUTES
After review of the minutes from the November 18th and January 12th meetings; a motion was made by Ms. Chaney to approve the minutes from the January 12th meeting. Ms. O’Donnell clarified verbiage regarding requirements for SLP Aides and Assistants working within a school district in the November 18th minutes with approval after the addition of the clarification. Ms. Whiteman seconded The motion carried.
Ms. Cory presented an update on House Bill H-47 which has passed and is on the way to the Senate.
Ms. Hall presented the Financial Report to the Board. As of January 31, 2011, the Board had a positive balance of $814.24.
Ms McGinty presented the Investigative Report which is linked above.
Mr. Olsen presented a memo regarding SHS-2005-3 and SHS-2010-4.
After discussion, a motion was made Ms. Chaney and seconded by Ms. O’Donnell to close SHS-2005-3. The motion carried.
The Board gave direction for discipline on case SHS-2010-4.
IMA Proposed Legislation
A discussion was held regarding the Idaho Medical Association’s proposed Health Care Transparency Act. Mr. Klein explained the act is intended to protect consumers from potentially misleading healthcare advertising. The Act requires practitioner’s not to engage in misleading advertising as defined in the Act. Among other things, it requires practitioner advertising to disclose the practitioner’s license type and to not offer services beyond the practitioner’s licensed scope of practice. The Act empowers the board to discipline licensees who violate the Act, and it empowers the board and other agencies to go to court to enforce the Act. The board discussed the Act’s potential impact on the Board. Any concerns about the extent to which the Act may impact the profession would be better addressed by the profession’s association.
Comparison of Licensing in other States
The Board held a discussion
on material detailing licensing requirements in six states. The material was
provided to give the Board an overview of requirements, fees, continuing
education requirements and length of time expected between submission of the
application and issuance of the license. With an average processing time of 31
A motion was made by Ms. Reis that the Board go into executive session under Idaho Code 67-2345(d) to consider such records that are exempt from disclosure under the Idaho Public Records Law. The purpose of the Executive Session was to consider license applications and continuing education for reinstatement. Ms. O’Donnell seconded. The vote was: Mr. Bell, aye; Ms. O’Donnell, aye; Ms. Reis, aye; Ms. Chaney, aye; Ms. Whiteman, aye; Ms. Osterhout, aye; and Chairman Seitz, aye. There were no nay votes.
Ms. O’Donnell made a motion to come out of executive session. Ms. Reis seconded. The vote was Mr. Bell, aye; Ms. O’Donnell, aye; Ms. Reis, aye; Ms. Chaney, aye; Ms. Osterhout, aye Ms. Whiteman, aye; and Chairman Seitz, aye. There were no nay votes.
