Chairman Seitz called the meeting to order at 1:28p.m.

 

Mr. Bell moved to approve the minutes of November 16, 2006 and the minutes of January 30 as read, and the minutes of March 16 as corrected.  Ms. Allen seconded, and the motion carried.

 

Old Business

 

Discussion was held on the Rules that need to be proposed by August:

1.  Supervision rules for Audiology and Speech Language Pathologists that are still in school.

                        2.  Need specific rules for the approved Clinical Practicum.

                        3.  Specify what approved course of study is.

4.  Clarify Rule 450, supervision requirements for Audiology and Speech Language Pathology.

                        5.  Supervision requirements for Aides and Assistants needs clarification.

 

Daily contact with supervisors is not always possible. The Board will accept phone contact or computer streaming video.  Supervision requires immediate contact between supervisor and supervisee.

 

Ms. Huylar moved to have Roger Hales draft rules to add to 450.01.a to add a sentence defining person-to-person contacts includes audio/visual, person-to-person, and telephone contacts. Mr. Peterson seconded, and the motion carried.

 

Ms. O’Donnell moved to have Roger Hales draft language for endorsement of Audiologists, Speech Language Pathologists and Hearing Aid Dealers and Fitters.  Ms. Allen seconded, and the motion carried.

 

Research ASHA.org for the supervision of Audiology and Speech Language Pathology.

Ms. O’Donnell and Ms. Huylar are to help research the information needed to Speech Language Pathology requirements and, Ms. Mecier and Chairman Seitz are to research for the Audiology requirements.  All committee reports are to be sent to Roger Hales to help draft the new law and rules. 

 

Karl Klein presented a Stipulation and Consent Order SHS-2007-01 to the Board for review.  Mr. Bell moved to accept the stipulation and consent order and have Chairman Seitz sign on behalf of the Board.  Ms. O’Donnell seconded, and the motion carried.

Mr. Peterson moved to redact the complainant’s name from the Stipulation and Consent Order SHS-2007-01 complaint and attachment.  Mr. Bell seconded, and the motion carried. 

 

Mr. Peterson moved to go into executive session to consider records that are exempt from disclosure as provided in chapter 3. title 9, Idaho Code. Mr. Bell seconded, and the motion carried.

 

The Board reviewed application files. 

 

Ms. O’Donnell moved to come out of executive session.  Ms. Mecier seconded, and the motion carried.

 

Mr. Peterson moved to table the applications for  901091334 and 901091362 until Idaho receives more information from Washington on the litigation status of the licenses held in Washington and the disciplinary procedure is obtained from Washington.  Ms. Mecier seconded, and the motion carried.

 

Cerumen Management

 

Mr. Peterson moved to have Roger Hales draft a rule to state that all licensees must practice within their scope of practice, education, training, and experience.  Ms. O’Donnell seconded, and the motion carried.

 

EXAMINATIONS

 

Ms. Allen, Ms. O’Donnell, and Ms. Huylar are to work on making an examination for Speech Language Pathologists licensure. The examination will be presented at a future meeting for approval.

 

Ms. Cory reported that a new conference call system is in use at this time.  Legislature approved two clerical positions and two investigative positions during the last session.  This will help with the cutting back on the investigative and clerical load for the Bureau.

 

FINANCIAL REPORT

 

Mr. Hetrick reported the financial status of a minus $39,655.12.  This will be revisited at the November meeting.  The revenue stream needs a full renewal cycle completed before an analysis can be done.

 

INVESTIGATIVE REPORT

 

Fiscal Year 2007: Seventeen (17) complaints have been received to date. Of those, three (3) have been referred for legal review; ten (10) remain under investigation; and four (4) await Board determination.

 

Fiscal Year 2006: Thirteen (13) complaints have been received to date. Of those, one (1) was closed following Board determination; one (1) has been referred for legal review; eight (8) remain under investigation; and three (3) await Board determination.

 

Fiscal Year 2005: Fifteen (15) complaints were received. Of those, eight (8) have been closed following Board determination; two (2) have been referred for legal review; and five (5) remain under investigation.

 

Fiscal Year 2004: Fifteen (15) complaints were received. Of those, thirteen (13) were closed following Board determination; one (1) remains under investigation; and one (1) awaits Board determination.

SHS-P3C-2-2006-1   Ms. O’Donnell moved to authorize closure without action.  Mr. Bell seconded, and the motion carried.

BOARD BUSINESS

 

A letter to be sent to Zeke Kelsey in response to his letter on supervision.  The Board has determined that phone contact daily and in-person contact once a week will work for supervision at this time.

 

Ms. Mecier moved to reconsider the Board joining the National Council of State Boards for Speech Language Pathology and Audiology and to have the staff investigate the organization to gain more information for further discussion and review. Ms. O’Donnell seconded, and the motion carried.

 

Ms. O’Donnell moved to go into executive session to consider records that are exempt from disclosure as provided in chapter 3, title 9, Idaho Code.  Ms. Allen seconded, and the motion carried.

 

Application files were reviewed.

 

Mr. Peterson moved to come out of the executive session.  Ms. Mecier seconded, and the motion carried.

 

Ms. Mecier moved to license those approved by the Board.  Mr. Bell seconded, and the motion carried.

 

Next Board meeting by conference call is June 28, 2007 at 1:30 Mountain Daylight Time.

 

Ms. O’Donnell moved that having no further business before them, the meeting adjourn at 4:50p.m.  Ms. Mecier seconded, and the motion carried.
