CONFERENCE CALL MINUTES for August 29, 2002
ROLL CALL: Dr. Charles Gasser, Chairman, joined the call at 11:37a.m.

Steven Rademacher, Acting Chairman, called the meeting to order at 11:32a.m.
Dr. Wachtler moved to go into
executive session for consideration of pending litigation and matters exempt
from public disclosure. Dr. Cooper
seconded the motion, motion carried.
Dr. Cooper moved to come out of
executive session. Steven Rademacher seconded the motion, motion carried.
Wachtler moved to accept the Finings of Fact and Conclusion of Laws as written
with the exception that the Board finds that Mr. Brown has violated Section
54-2903, Idaho Code regarding the contract requirements, and Section
54-2912(b)(3), Idaho Code regarding unethical conduct, by advertising as holding
the oldest license. Dr. Wachtler
further moved that the Board impose a one-year probation and order Mr. Brown to
pay costs and fees incurred in the investigation and prosecution of the case.
The Board also recommends Mr. Brown make restitution to the consumer. Steven
Rademacher seconded the motion, motion carried.
Dr. Wachtler moved to set the
time frame for the payment of the costs and fees at 30 days from the date of the
final order. Dr. Cooper seconded
the motion, motion carried.
Dr. Wachtler moved to have
Roger Hales prepare the order and Chairman Gasser to sign the order on behalf of
the Board. Dr. Cooper seconded the
motion, motion carried.
Having no further business before them, Dr. Wachtler moved to adjourn the call at 12:10p.m. Dr. Cooper seconded the motion.
