MEETING MINUTES for MAY 9, 2002

Chairman Gasser called the meeting to order at 1:00p.m. 

Steve Rademacher moved to approve the minutes of the meetings of November 8, 2001, November 30, 2001 conference call, January 11, 2002 conference call and February 12, 2002 conference call as written.  Kelley Olenick seconded and the motion carried. 

BUREAU STAFF 

Rayola Jacobsen presented a Board training session on parliamentary procedure to the Board. 

Ms. Jacobsen reported that a new law in effect on July 1, 2002 will allow an open meeting, properly noticed, to be held with one Board member at the Bureau and all others on speaker phone will be accepted as a board meeting. 

Changes at the Bureau include the boardroom being expanded to allow for larger meetings and examinations, to be ready by July 1, 2002.  

The phone system was updated to meet the Bureau needs. 

The Bureau is going paperless with the new technology being introduced. 

Kelley Olenick moved to go into executive session for discussion of possible litigation. Dr. Wachtler seconded and the motion carried. 

Kelley Olenick moved to come out of executive session.  Steven Rademacher seconded and the motion carried. 

Kelley Olenick moved for case CVOC 02 0123A to allow the Attorney General to negotiate, with consultation with the Chair, authority to bind the Board to settlement.  Steven Rademacher seconded and the motion carried. 

Budd Hetrick presented the financial report to the Board showing a negative $5,629.52 balance.  The attorney fees and investigative costs are the reason for the negative balance.  The renewals will bring the cash balance to a positive side by June 30, 2002. 

The Investigative report shows three complaints received in 2002 and one of those is open and under investigation.  For 2001, six complaints were received and three are open. For 2000, five cases are under investigation. 

Kelley Olenick moved to go into executive session for matter exempt from public disclosure.  Steven Rademacher seconded and the motion carried. 

Kelley Olenick moved to come out of executive session, Steven Rademacher seconded and the motion carried. 

For case number HAD-L2B-02-00-018 Steven Rademacher moved to accept the recommendation of the Attorney General with a copy to the manufacturer.  Kelley Olenick seconded and the motion carried. 

For case number HAD-P3C-04-00-022 Kelley Olenick moved to follow the recommendation of the Attorney General for staying the suspension, if violation of probation, then the suspension goes into effect. Steven Rademacher seconded and the motion carried. 

For case number HAD-P3-01-01-004 Kelley Olenick moved to accept the recommendation of the Attorney General except on #4 assuming this is the first violation.  Steven Rademacher seconded and the motion carried. 

Rayola Jacobsen reported the Bureau is to introduce legislation this year to change the renewal date for licensees to their birthday with a pro-rated fee for the first license.  Dr. Wachtler moved to approve this change to the licensure renewal time being the candidate’s birthday.  Kelley Olenick seconded and the motion carried. 

For discussion at the November meeting: 

            Law change for Endorsement for 2003

    Limiting the number of times an exam can be taken.

             Two-year degree requirement

             Content of examination in law changed to National exam

             Disposable hearing aids

             Sound testing

 

Then rules will need to be drafted once the laws are changed. 

Quarterly reports were reviewed and the examination was prepared for Friday. 

Having no further business before them, the meeting adjourned at 4:15p.m.
