Meeting was called to order at 9:00 AM MDT by Shirlie Meyer.

 

APPROVAL OF MINUTES

 

A motion was made by Ms. Simon to approve the minutes of April 28, 2009. Seconded by Mr. Eaton, motion carried.

 

LEGISLATIVE REPORT

 

Ms. Cory presented the legislative report to the members of the Board.

 

FINANCIALREPORT

 

Ms. Cory presented the financial report to the members of the Board. The current cash balance is a negative $1,029.89.

 

Ms. Mac Master presented Memorandum RCA-2009-6 to the members of the Board. A motion was made by Ms. Simon to approve the recommendation of the Attorney Generalís Office and close the matter with an advisory letter reminding the Respondent that Idaho Code 54-4212 prohibits the unlicensed practice of residential care administration. Mr. Eaton recussed himself from discussion. Seconded by Ms. Gooding, motion carried.

 

RCA-2009-4

 

Ms. Mac Master presented THE FINDINGS OF FACT, CONCLUSION OF LAW AND FINAL ORDER for case no. RCA-2009-4 to the members of the Board. A motion was made by Ms. Simon to approve the order as written and authorize the Chair to sign on behalf of the Board. Seconded by Mr. Eaton, motion carried.

 

INVESTIGATIVEREPORT

 

Mr. Hetrick presented the investigative report to the members of the Board.

 

I-RCA-2009-4 R failed to respond to the CE Audit. Sent certified demand for proof of CE. R responded with certificates confirming compliance with the CE requirement. IBOL recommends the Board authorize closure.

 

A motion was made by Ms. Simon to accept the Bureauís recommendation and authorize closure. Seconded by Mr. Eaton, motion carried.

 

OLD BUSINESS

 

The Board reviewed the proposed rule change for nursing home administrators to include the language ďwithin the five years preceding the application working in a residential care facility. A motion was made by Ms. Simon to approve this change to rule 160. Seconded by Ms. Gooding, motion carried.

 

A motion was made by Ms. Simon to submit the proposed law and rules changes in their entirety, Seconded by Mr. Eaton, motion carried.

 

NEW BUSINESS

 

DISCUSSION WITH JAMIE SIMPSON RE: PROVISIONAL PERMITS

 

Ms. Simpson approached the members of the Board. She stated she has some concerns and questions regarding the RCA provisional permits. Ms. Simpson stated she doesnít want a permit issued to an applicant who is just opening a new facility as they may not be fully qualified at that time. The Board reviewed Idaho Code 54-4211. Ms. Simpson also expressed concern over issuing multiple different permits to one facility. The Board discussed changing the licensure application and required documentation to include information regarding what facility an applicant is requesting the provisional permit for.

 

The Board also presented to Ms. Simpson the proposed law change regarding the qualifications for licensure. Ms. Simpson stated she is in favor of the stricter educational and experience requirements.†† †††

 

DISCUSSION WITH IHCA/ICAL RE: THE ADMINISTRATOR COURSE

 

Ms. Hunt and Ms. Graves approached the members of the Board. Ms. Graves stated a total of 10 people have taken the Headmasters exam and of those half have failed. This number also includes individuals who have taken the exam multiple times.

 

There has also been an update to the administrator course. They stated the total cost for the course for a non-member is $600.00 and it is $400.00 for members. Membership fees are based upon the number of beds within a facility.

 

Ms. Graves stated the administrator course will soon be available on-line. The Board requested to have copies of the course mailed to them.

 

The Board has also asked to have Robert VandeMerwe attend the next meeting to discuss any legislation the Association may be presenting this year.

 

2009 ANNUAL NAB MEETING

 

Ms. Simon attended the annual NAB meeting held in Virginia. She stated the focus was on an increase in their marketing and awareness to what NAB is. Ms. Simon also participated in reviewing exam questions for accuracy, etc. She added this process as well as the meeting as a whole was very educational.††††

 

NEXT MEETING is scheduled for Tuesday August 4, 2009 at 9:00 a.m.

A motion was made by Ms. Simon to adjourn the meeting at 10:30 a.m. Seconded by Ms. Gooding, motion carried.
