Meeting was called to order at 9:00 AM MST by Ione Springer.

 

APPROVAL OF MINUTES

 

A motion was made by Ms. Goettshe to accept the December 15, 2008 minutes as written. Seconded by Ms. Meyer, motion carried.

 

LEGISLATIVE UPDATE

 

Ms. Cory presented the legislative update to the members of the Board. She stated the Boardís proposed rules are posted to the website at http://ibol.idaho.gov/rca.htm

 

FINANCIAL REPORT

 

Ms. Hall presented the financial report to the members of the Board. The current cash balance is $4,212.86 with their revenues at $25,405.00 and their expenditures at $22,621.48, as of 12/31/2008.

 

INVESTIGATIVE REPORT

 

Mr. Hotchkiss presented the investigative report to the members of the Board.

For Board Determination:  

I-RCA-2008-3          C questioned the authenticity of Rís CE certificates. INV confirmed the authenticity of the documentation submitted by R. IBOL recommends the Board authorize closure.

A motion was made by Ms. Simon to follow the Bureauís recommendation and authorize closure. Seconded by Ms. Goettsche, motion carried.  

I-RCA-2009-1          An audit revealed that documentation of CE showed that 4  hours of CE were obtained outside the audit period. IBOL record shows that R's license expired. IBOL recommends the Board authorize closure as CE will be required upon reinstatement.  

A motion was made by Mr. Eaton to follow the Bureauís recommendation and authorize closure. Seconded by Ms. Goettsche, motion carried.  

I-RCA-2009-6          R failed to respond to a CE Audit.  Sent certified demand letter for proof of CE.  R submitted a total of 19 CE hours all of which were in the audit period.  IBOL recommends that the Board authorize closure.

 A motion was made by Ms. Simon to follow the Bureauís recommendation and authorize closure. Seconded by Mr. Eaton, motion carried.  

I-RCA-2009-7          R failed to respond to a CE Audit.  Review of the record showed that R had moved and not updated address. Subsequent documentation confirmed that R had met the CE requirement.  IBOL recommends the Board authorize closure.

A motion was made by Ms. Meyer to follow the Bureauís recommendation and authorize closure. Seconded by Ms. Goettsche, motion carried.

RCA-2007-4 Ms. MacMaster presented the memorandum to the members of the Board. A motion was made by Mr. Eaton to follow the recommendation of the Attorney Generalís Office to close this matter and authorize closure with an advisory letter to the Respondent warning her that a further violation of federal or state regulations governing facility standards could result in discipline against her residential care administrator license for willful or repeated conduct. Seconded by Ms. Meyer, motion carried.

OLD BUSINESS

HEADMASTERS EXAMINATION AND HANDBOOK

 

Mr. VandeMerwe approached the members of the Board. Mr. Eaton reported from the second pilot test taken. In general, the feedback was the test had improved; however, it was felt that the length of the exam needs to be increased as well as the areas it covers.

 

A motion was made by Ms. Meyer to approve the Headmasters exam based upon 100 question test using the same percentage as set for the 72 question test. The pass rate will be based upon minimum competency as determined by the exam administrator and that the test is approved as an alternate to the NAB exam for licensure in the state of Idaho. Seconded by Ms. Simon, motion carried. ††††††††

EXECUTIVE SESSION

 

A motion was made by Ms. Meyer to enter into executive session as per Idaho Codes 67-2345.1(d) and (f). Seconded by Ms. Goettsche. The vote was: Ms. Springer, aye; Ms. Simon, aye; Ms. Meyer, aye; Ms. Goettsche, aye; and Mr. Eaton, aye. Motion carried.

 

A motion was made by Ms. Meyer to come out of executive session. Seconded by Mr. Eaton. The vote was: Ms. Springer, aye; Ms. Simon, aye; Ms. Meyer, aye; Ms. Goettsche, aye; and Mr. Eaton, aye. Motion carried.

 

A motion was made by Ms. Simon to direct the Bureau to follow up with Headmasters and association representatives to discuss confidentiality issues associated with the examination. Seconded by Ms. Meyer, motion carried.

 

NEW BUSINESS

 

REQUEST FOR CONTINUING EDUCATION APPROVAL

 

A motion was made by Ms. Simon to deny the request submitted by Donna Lant, RCA-186, for continuing education approval based upon not meeting the requirement under Rule 401.02.d. Seconded by Ms. Meyer, motion carried.

 

NATIONAL ASSOCIATION OF BOARDS (NAB) TESTING AGREEMENT

 

A motion was made by Mr. Eaton to approve the NAB testing agreement for one year and authorize the Chair to sign on behalf of the Board. Seconded by Ms. Goettsche, motion carried.

 

EXECUTIVE SESSION

 

A motion was made by Ms. Meyer to enter into executive session to consider records exempt from public disclosure as per Idaho Code 67-2345.1(d). Seconded by Ms. Simon. The vote was: Ms. Springer, aye; Ms. Simon, aye; Ms. Meyer, aye; Ms. Goettsche, aye; and Mr. Eaton, aye. Motion carried.

 

A motion was made by Ms. Simon to come out of executive session. Seconded by Ms. Meyer. The vote was: Ms. Springer, aye; Ms. Simon, aye; Ms. Meyer, aye; Ms. Goettsche, aye; and Mr. Eaton, aye. Motion carried.

The Board discussed licensure and if there is a need to create different levels. The Board asked the secretary to contact NAB and gather information regarding the training and experience requirement for other states and bring it back to the Board during the next scheduled meeting.††
