Minutes of September 18, 2003

Chairman Kaiser called the meeting to order at 9:00a.m. 

Mr. Higbee moved to approve the minutes of July 17, 2003 meeting.  Ms. Springer seconded the motion and the motion carried. 

BUREAU STAFF 

Ms. Jacobsen stated the deadlines have been met for rules promulgation. The rules adopting the Code of Ethics and Standards of Practice were published as proposed rules instead of temporary rules, as approved by the Division of Financial Management.. 

The Nursing Home Administrator Board must formally support the proposal to delete section 54-4211. (2), Idaho Code, allowing Residential Care Facility Administrator licensure of current Nursing Home Administrators before the change can be submitted. The Division of Financial Management denied the proposed change based on possible controversy.  

Discussion was held on the Law change for Nursing Home Administrators having to take the same test as Residential Care Facility Administrators, and about educating the public and administrators.  Letters to the Bureau in support of the change, as well as discussions with Association membership would help. 

The Board asked that educational material concerning Provisional licenses be sent out to all license candidates, Facility Standards, and the Idaho Residential and Assisted Living Association, and be put on the web site. 

The contract between the Board and the Bureau was reviewed.  Ms. Springer moved to approve the contract and have the Chairman sign on behalf of the Board.  Ms. Meyer seconded the motion and the motion carried.

The Board reviewed the Attorney General’s letter confirming there was no conflict of interest for the Board, should the Board be given statutory authority to license and inspect Residential Care Facilities.  The Board asked that Ms. Jacobsen send a copy of the letter to Deborah Ransom. 

Mr. Hetrick presented the financial report showing a positive balance of $44,163.99. 

Mr. Hetrick presented the investigative report showing five current investigations. 

Chairman Kaiser presented Mr. Hetrick with a model application for licensure that she received from NAB for possible use in the future. 

Discussion was held with Roger Hales on South Carolina’s Grounds for Discipline and a possible change to 54-4212.c.  Ms. Meyer moved to have Mr. Hales present proposed law changes on disciplinary actions at the next meeting.  Ms. Springer seconded the motion and the motion carried. 

Mr. Higbee moved to go into executive session for discussion of applicants files exempt from public disclosure.  Ms. Meyers seconded the motion and the motion carried. 

Mr. Higbee moved to come out of executive session.  Ms. Springer seconded the motion and the motion carried. 

Ms. Meyers moved to issue the provisional permit to RCA 07 28 2003 LDH and the permanent license will depend on the material received from the investigation and passing of exam. Ms. Springer seconded the motion and the motion carried. 

Old Business 

Mr. Higbee moved to send a letter to all licensees explaining the rule changes on the provisional permits.  The envelope for the letter is to state “Rule Changes” on the outside.

Ms. Meyers seconded the motion and the motion carried. 

Discussion was held on the Idaho Assisted Living Association proposal to transfer facility licensure and inspection authority the Residential Care Facility Administrators Board. The Board requests that Debra Ransom and Virginia Loper meet with the Board for discussion.  The next Board meeting will be December 11, 2003 at 9:00a.m. 

The Board requested that Debra Ransom and Virginia Loper advise the Board of any proposed law or rule changes from the Department of Health and Welfare that could affect the Board. 

Discussion was held on the percentage of licensees to be audited.  Ms. Meyers moved to approve a 10% audit for continuing education of all licensees. Ms. Springer seconded the motion and the motion carried. 

New Business 

Ms. Springer moved that Shirlie Meyer attend the NAB Mid-Year Convention in Austin, Texas. Mr. Higbee seconded the motion and the motion carried. 

The Board requests feedback to Ms. Meyer on the usability of the Model Application before the November Convention.   

Shirlie Meyer moved that David Hahn be invited to the next meeting to discuss how the legislative material is reviewed and processed.   

The next Board meeting will be on December 11, at 9:00a.m.

With no further business before them, the meeting adjourned at 1:35p.m.
