Meeting Minutes of September 13, 2002

Chairman Kaiser called the meeting to order at 9:05a.m. 

Myron Higbee moved to approve the minutes of June 20, 2002 meeting and August 12, 2002 conference call. Ken Madsen seconded the motion, motion carried. 

New Board members, Ione Springer and Shirlie Meyer, were welcomed to the Board.

 

Bureau Staff 

The financial report was presented to the Board showing a positive balance of $58,383.87.  The Board is in a good financial position.  Several cost saving measures have been developed:  going paperless, the Chief Investigator is not at Board meetings unless needed. The Deputy Attorney General no longer attends meetings unless needed. And the new meeting room and examination rooms will be a savings when the Board no longer has to rent extra rooms. 

The investigative report was presented to the Board and shows no complaints have been received in 2003.  One complaint from 2002 is open and under investigation and two from 2000 are still under investigation. 

The complaint and investigation procedure was explained to the new members. 

Roger Hales went over the proposed law and rule changes.  There is nothing in the law for the original license fee.  If the Board wants to change that portion, then legislative action will need to take place next year. 

Ione Springer moved to go into executive session for discussion of material otherwise exempt from public disclosure. Myron Higbee seconded the motion, motion carried. 

Myron Higbee moved to come out of executive session.  Ken Madsen seconded the motion, motion carried. 

Myron Higbee moved to accept the experience shown by RCA-05-13-02-CES in lieu of the high school education for examination.  Ken Madsen seconded the motion, motion carried.

 

New Business 

The Governorís office will be conducting a training session for new Board members. Ken Madsen, Ion Springer and Shirlie Meyer would like to attend the training session. 

 The educational programs were discussed.  Only the Idaho Assisted Living Association (IDALA) and the National Assisted Living Association programs have been approved.  Debbie Ransom is to work with IDALA to complete a portion for the rules and regulations for facilities. 

The NAB Study Guide is not a program. 

Myron Higbee moved to continue with NAB for the examination portion and have Rayola Jacobsen sign the contract with NAB.  Shirlie Meyer seconded the motion, motion carried. 

Discussion was held on the travel arrangements for Board members when they travel.  The Bureau is to produce instructions for future arrangements.  Board action is required for all travel arrangements. A draft of the travel procedures is to be sent to all Board members when it is completed. 

The NAB meeting is to be held in Anaheim, California on November 6&7. Myron Higbee moved that Verlene Kaiser is to attend the NAB meeting and the reasonable travel expenses be paid and she is to look for a new exam committee member for NAB from Idaho. Shirlie Meyer seconded the motion, motion carried. 

The next NAB meetings are:

June 11-13, 2003 in Portland OR and November 5-7, 2003 in Austin TX. 

The next Board meeting will be held at the Bureau on March 14, 2003 starting at 9:30a.m. 

The following meeting will be held at the Bureau on May 15-16, 2003 for law and rule changes at 9:30a.m. 

September 18, 2003 at the Bureau at 9:30a.m. 

The contract between the Bureau and the Board was presented.  Myron Higbee moved to have the Chairman of the Board, Verlene Kaiser, sign the contract with the Bureau.  Ione Springer seconded the motion, motion carried. 

Jolene Tuma, Charles Tuma and Attorney Mr. Robinson, by phone, addressed questions from the Board on discrepancies on the application for temporary permit and the criminal background for Ms. Tuma. 

Shirlie Meyer moved to go into executive session for discussion of potential litigation.  Myron Higbee seconded the motion, motion carried. 

Ken Madsen moved to come out of executive session. Ione Springer seconded the motion, motion carried. 

Myron Higbee moved to approve the application for temporary permit and examination for Ms. Tuma.  Shirlie Meyer seconded the motion, motion carried. 

Having no further business before them, Myron Higbee moved to adjourn the meeting at 2:30p.m. Ione Springer seconded the motion, motion carried.
