Board Meeting Minutes of 4/15/2011

The meeting was called to order at 9:00 AM MDT by Larry Ohman.

 

APPROVAL OF MINUTES

A motion was made by Ms. Liddle to approve the minutes of 1/4/2011, 1/21/2011, and 2/16/2011. Seconded by Mr. White, motion carried.

LEGISLATIVE REPORT

 

Ms. Cory presented the legislative report to the members of the Board. She stated the Board has temporary and proposed rule changes. No comments were received.  

 

FINANCIAL REPORT

 

Ms. Cory presented the financial report to the members of the Board. The current cash balance as of 3/31/2011 was $175,991.45. Ms. Cory stated the Board may need to reduce its fees in the future. 

 

PHT-2010-6

 

Mr. Nelson presented the consent order, PHT-2010-6, to the members of the Board. Following discussion a motion was made by Mr. White to accept the stipulation and consent order. Additionally, Mr. McDonald will submit reports to the Board on a semi-annual basis for a period of five (5) years and these reports are to include the attendees signatures. Seconded by Ms. Liddle. Mr. Nelson stated he will make the noted revisions to the stipulation to bring back before the Board during its next scheduled meeting. Motion carried.

 

INVESTIGATIVE REPORT

 

Ms. Peel presented the investigative report to the members of the Board. The following were up for Board determination:

 

I-PHT-2011-6 and I-PHT-2001-7 A motion was made by Mr. White to accept the Bureau’s recommendation and authorize closure. Seconded by Ms. Liddle, motion carried.

 

COGNIZANT MEMBER

 

Discussion was held regarding the appointment of a designated member to review the complaint records after the investigation. A motion was made by Mr. White to appoint the Board Chair as the cognizant member and approve the reimbursement of any expenses incurred. Seconded by Ms. Liddle, motion carried.

 

OLD BUSINESS

           

PROPOSED LAW/RULE CHANGES

 

Discussion was held regarding the implementation of background checks as part of the licensure requirements. The Board reviewed a draft of proposed language. The Board asked Ms. Gilstrap to research other states’ processes and cost, and if there has been benefits for requiring background checks. The Board asked to have this tabled until its next regularly scheduled meeting.

 

The Board reviewed the revised draft to the continuing education rule changes. A motion was made by Mr. White to approve this draft as written. Seconded by Ms. Liddle, motion carried. 

 

NEW BUSINESS

 

FSBPT/NPTE EXAM

 

Discussion was held regarding the national exam and the changes to be made regarding the available number of future test dates. The Federation of State Boards of Physical Therapy (FSBPT) will no longer provide continuous testing after June 30, 2011. This has caused concerns from the schools and students. The Board stated they will meet to review applications on an as-needed basis.    

 

Correspondence re: NPTE Litigation

 

The Board reviewed a letter received regarding civil action taken against the State of Georgia and FSBPT with regard to the availability for foreign trained to take the national examination. No action needed to be taken. 

 

Correspondence re: Board Certification

 

The Board reviewed an inquiry received from the American Physical Therapy Association (APTA) asking if continuing education credit is given for Board certifications. The Board discussed how many contact hours could be given for obtaining these certifications. Mr. Ohman stated he will contact other states to determine how many they allow and asked Ms. Gilstrap to send him a reminder, as well. 

 

Correspondence re: Devices

 

The Board reviewed an inquiry sent by Mr. Blenkinsop asking if therapists were allowed to purchase, possess, and use medical devices. Following discussion, The Board discussed its authority to implement and use medical devices. Mr. Klein stated he would contact the Board of Medicine for additional information.

 

EXECUTIVE SESSION

 

A motion was made by Mr. White that the Board go into executive session under Idaho Code § 67-2345(1)(d) to consider records that are exempt from disclosure under the Idaho Public Records Law.  The purpose of the executive session was to consider license application materials. Seconded by Ms. Liddle. The vote was: Mr. White, aye; Mr. Ohman, aye; and Ms. Liddle, aye. Motion carried.

 

A motion was made by Ms. Liddle to come out of executive session. Seconded by Ms. Liddle. The vote was: Mr. White, aye; Mr. Ohman, aye; and Ms. Liddle, aye. Motion carried.

 

APPLICATIONS

 

PHYA-2807 A motion was made by Mr. White to deny the application for Naveen Kumar Alle based upon his failure to show proof of passing scores for the required English proficiency exam. Additionally, his education credential report states his education is not equivalent to that of a US physical therapy degree. Seconded by Ms. Liddle, motion carried.

 

PHYA-2818 A motion was made by Mr. White to approve the endorsement application for Clarissa Celestino once verification of passing TOEFL scores is received. Seconded by Ms. Liddle, motion carried.

 

APPLICANT ID 901112920 A motion was made by Mr. White to send notification of the application lack of activity and request the applicant notify the Board if they wish to pursue Idaho licensure. Seconded by Ms. Liddle, motion carried.

 

APPLICANT ID 901115714 A motion was made by Mr. White to hold the application pending documentation of continuing education courses attended from 2003 to current. Seconded by Ms. Liddle, motion carried.

 

APPLICANT ID 901116024 A motion was made by Mr. White to approve the applicant to sit for the examination upon receiving proof of graduation. Seconded by Ms. Liddle, motion carried.

 

APPLICANT ID 901116381 A motion was made by Mr. White to approve the applicant to sit for the examination upon receiving proof of graduation and the submission of two (2) additional character references in narrative form. Seconded by Ms. Liddle, motion carried.

 

PHYA-2718 A motion was made by Mr. White to deny the application for Magesh Lingan based upon his education credential report which states his education is not equivalent to that of a United State physical therapy degree. Seconded by Ms. Liddle, motion carried.

 

PT- 2824 A motion was made by Mr. White to approve John Sayler for endorsement licensure. Seconded by Ms. Liddle, motion carried.
