Meeting was called to order at 9:02 MDT by David L Hutton.
APPROVAL OF MINUTES
Mr. Buck moved to approve the minutes of July 15-16, 2008. Mr. Sims seconded, and it carried.
Mr. Sims moved to approve the minutes of August 12, 2008. Mr. Buck seconded, and it carried.
REPEAL OF IDAHO CODE
Mr. Shultz presented the idea of repealing Idaho Code 54-1119 from the Morticianís Statute. The repeal is based upon the fact that the Department of Health and Welfare has laws and rules in place covering the control of handling dead human bodies. The Idaho Code 54-1119 has never had any rules, and historically has never been used.
Mr. Sims moved to support the repeal of Idaho Code 54-1119 by the Department of Health and Welfare. Mr. Buck seconded, and it carried.
MEMO FROM THE ATTORNEY GENERALíS OFFICE
MOR-2008-9 and MOR-2008-10
Chairman Hutton recused himself from these cases, and appointed Mr. Buck to act as Vice Chairman.
The Attorney Generalís Office is to negotiate a consent order involving:
1. Fine of $500.
2. Pay $1,150 in costs and fees.
3. Have a 15 day suspension of his license.
The Attorney Generalís Office is to issue a strong warning letter and close the file.
MOR-2009-1 and MOR-2009-2
The Attorney Generalís Office is to negotiate a consent order and letter of reprimand.
Mr. Sims moved to accept the voluntary surrender of his license. His license is to be revoked and all privileges of renewal be revoked. He is to pay a fine of $1,000 and the recovery of costs and fees. Chairman Hutton is to sign on behalf of the Board.
Mr. Buck seconded, and it carried.
Mr. Sims moved to go into executive session per Idaho Code 67-2345 (1) (d). Mr. Buck seconded. Aye votes: Mr. Sims, Mr. Buck and Mr. Hutton. Nay votes: None. Motion carried.
Mr. Sims moved to come out of executive session. Mr. Buck seconded. Aye votes: Mr. Sims, Mr. Buck and Mr. Hutton. Nay votes: None. Motion carried.
Approved for Exam
Mr. Buck moved to approve Kevin H. Persons for examination and licensure pending successful passage of the exam. Mr. Sims seconded, and it carried.
CONFERENCE ANNUAL DUES
Mr. Buck moved to pay the Conference of Funeral Service Examiners annual dues of $250. Mr. Sims seconded, motion carried.
Discussion was held on what type of records crematories must keep for stillborn babies under 20 weeks, and medical waste from hospitals.
Mr. Buck moved to table this discussion until the January 2009 meeting. Mr. Sims seconded, motion carried.
Mr. Sims moved to adjourn the call at 10:05 a.m. Mr. Buck seconded, motion carried.
