The meeting was called to order at 9:05 AM MDT by Gary Van Hees.

 

 

APPROVAL OF MINUTES

 

A motion was made by Mr. Warner to approve the minutes of September 21, 2010. Seconded by Mr. Hill, motion carried.

 

LEGISLATIVE REPORT

 

Ms. Cory presented the legislative report to the Board members. The proposed rules for the 2011 Legislative session were posted on October 6, 2010 and have been linked to the Boardís webpage.

 

FINANCIAL REPORT

 

Ms. Hall presented the financial report. As of September 30, 2010, the Boardís balance was ($146,011.22). The revenue was $24,369.01 and the expenditures were $22,490.18. The Board will have a savings in rental fees for FY2011 with the Bureauís move into its new facility.

 

 

 

INVESTIGATIVE REPORT

 

For Board Determination:

 

I-LPG-2009-14, I-LPG-2011-15, I-LPG-2011-16, I-LPG-2011-17, I-LPG-2011-18, I-LPG-2011-19, I-LPG-2011-20, I-LPG-2011-22 Investigators discovered Respondents dispensing LPG without a license.IBOL records reflect that Respondents are now licensed.IBOL recommends the Board authorize closure.

 

A motion was made by Mr. Warner to authorize closure of cases I-LPG-2009-14, I-LPG-2011-15, I-LPG-2011-16, I-LPG-2011-17, I-LPG-2011-18, I-LPG-2011-19, I-LPG-2011-20, I-LPG-2011-22. Seconded by Mr. Hill, motion carried.

 

I-LPG-2009-154 An investigator discovered Respondent dispensing propane without a license.IBOL contacted Respondent numerous times regarding compliance with the Boardís laws, but Respondent failed to submit an application for licensure.IBOL subsequently forwarded the matter to the local prosecuting attorney.IBOL recommends that the Board authorize closure.

 

A motion was made by Mr. Warner to authorize closure of case I-LPG-2009-154. Seconded by Mr. Hill, motion carried.

 

I-LPG-2010-30, I-LPG-2010-31, I-LPG-2011-7, I-LPG-2011-8 During inspections of Respondentís two facilities on 3/23/10, the investigator discovered that Respondentís licenses expired on 6/30/09 and had not been renewed.IBOL records reflect that Respondent had attempted to renew in June 2009 but had failed to submit renewal applications. Respondent was then notified by IBOL that renewal applications were required in order to renew.After speaking with the investigator, Respondent submitted the documentation and the licenses were reinstated on 3/24/10.Respondent again expired on 6/30/10 and attempted to renew after the expiration date but failed to provide insurance documentation.Respondent was notified by IBOL that insurance documentation was required for reinstatement.The investigator spoke with the facility manager on 7/8/10 and noted that the licenses were expired again. The company immediately provided documentation showing continuous insurance coverage and the licenses were reinstated.IBOL recommends that the Board authorize closure with a warning letter to Respondent regarding timely renewals.

 

A motion was made by Mr. Hill to authorize closure of cases I-LPG-2010-30, I-LPG-2010-31, I-LPG-2011-7, I-LPG-2011-8 with a warning letter to Respondent regarding timely renewals. Seconded by Mr. Warner, motion carried.

 

I-LPG-2010-47 During an inspection on 6/24/10, the investigator discovered that Respondentís license expired on 4/30/10 and had not been renewed.IBOL records reflect that Respondent had submitted a renewal application on 5/25/10 but had failed to provide insurance documentation.Respondent was notified by IBOL on 5/27/10 that insurance documentation was required for reinstatement.The investigator spoke with the facility manager on 6/24/10 about the issue, and on 6/28/10 Respondent faxed insurance documentation to IBOL and was reinstated. IBOL recommends that the Board authorize closure with a warning letter to Respondent regarding timely renewals.

 

A motion was made by Mr. Warner to authorize closure of case I-LPG-2010-47 with a warning letter to Respondent regarding timely renewals. Seconded by Mr. Hill, motion carried.

 

I-LPG-2011-3 During an inspection, the investigator discovered that there was no identified and accessible shutoff switch or 18 lb. fire extinguisher.After the inspection, Respondent decided to stop selling propane, and the supplier confirmed that the tank was removed.IBOL recommends that the Board authorize closure.

 

A motion was made by Mr. Hill to authorize closure of case I-LPG-2011-3. Seconded by Mr. Warner, motion carried.

 

I-LPG-2011-6 During an inspection on 7/12/10, the investigator discovered that Respondentís license had expired on 5/9/10 and had not been renewed.Respondent subsequently renewed its license on 7/15/10.IBOL recommends that the Board authorize closure with a warning letter to Respondent regarding timely renewal.

 

A motion was made by Mr. Warner to authorize closure of case I-LPG-2011-6 with a warning letter to Respondent regarding timely renewals. Seconded by Mr. Hill, motion carried.

 

CETP TRAINING

 

Mr. Van Hees tabled the CETP Training Update for the December 8, 2010 agenda.

 

CORRESPONDENCE

 

The Board members reviewed correspondence received from Elk Creek Station.

 

A motion was made by Mr. Hill to approve the request of an extension until July 2011. Seconded by Mr. Warner, motion carried.

 

EXECUTIVE SESSION

 

Mr. Warner made the motion that the Board enter executive session, under Idaho Code ß 67-2345(1) (d), to consider records that are exempt from disclosure under the Idaho Public Records Law. The purpose of the executive session will be to consider license application materials. Seconded by Mr. Hill, motion carried. The votes were: Mr. Warner; aye, Mr. Hill; aye, and Mr. Van Hees; aye.

 

A motion was made by Mr. Hill to come out of executive session. Seconded by Mr. Warner, motion carried. The votes were: Mr. Warner; aye, Mr. Hill; aye, and Mr. Van Hees; aye.

A motion was made by Mr. Warner to approve two facility applications, one dealer application for licensure. One facility application is approved pending further information. Seconded by Mr. Hill, motion carried.
