Board Meeting Minutes of 1/15/2009

 Meeting was called to order at 9:00 AM MST by Gary Van Hees.

 

 APPROVAL OF MINUTES

 

A motion was made by Mr. Lehman to accept the minutes of September 15, 2008 as written. Seconded by Mr. Keller, motion carried.

 

A motion was made by Mr. Lehman to accept the minutes of October 22, 2008 as written. Seconded by Mr. Keller, motion carried.

 

A motion was made by Mr. Keller to accept the minutes of November 6, 2008 as written. Seconded by Mr. Lehman, motion carried.

 

LEGISLATIVE REPORT

 

Ms. Cory presented the legislative report. The Legislature convened Monday, January 12, 2009.  The Board’s proposed law change was reviewed and discussed.

 

A motion was made by Mr. Lehman to post the proposed law change on the Bureau’s website. Seconded by Mr. Keller, motion carried.

 

FINANCIAL REPORT

 

Ms. Hall presented the financial report which indicates a balance of ($119,240.22). The negative balance is due to the investigative and inspection expenses incurred with a new program. Mr. Hetrick outlined the disciplinary process to the Board and presented the investigative report.

FOR BOARD DETERMINATION

 

I-LPG-2008-11  LPG small facility inspection conducted at business on 12/18/07 resulted in a failing score of 73 and “C” card being issued. Follow-up inspection resulted in a B classification being issued. IBOL recommends the Board authorize closure.

 

A motion was made by Mr. Lehman to close the case. Seconded by Mr. Keller, motion carried.

 

 I-LPG-2008-33  C alleged the R is dispensing LPG without a license. Records show R submitted an application and additional information has been requested. Record shows additional information was received and the license was subsequently issued. IBOL recommends the Board authorize closure based on compliance.

 

A motion was made by Mr. Keller to close the case. Seconded by Mr. Lehman, motion carried.

 

 I-LPG-2009-1; 9; 10; 11; 12; 20; 29; 33; 34; 54; 57; 60; 64;  C conducted an inspection that resulted in a failing score and a "C" card being issued. INV revealed the follow-up inspection resulted in a “B” card classification and compliance.  IBOL recommends the Board authorize closure.

 

A motion was made by Mr. Lehman to close the 13 cases. Seconded by Mr. Keller, motion carried.

 

 I-LPG-2009-2  C alleged the R is practicing without a license. INV revealed the R has gained appropriate licensure as instructed.  Due to compliance, IBOL recommends the Board authorize closure.

 

A motion was made by Mr. Keller to close the case. Seconded by Mr. Lehman, motion carried.

 

 I-LPG-2009-13  C alleged the R is dispensing LPG without a license. INV revealed the R removed all dispensing equipment and is no longer dispensing LPG from the facility.  IBOL recommends the Board authorize closure.

 

A motion was made by Mr. Lehman to close the case. Seconded by Mr. Keller, motion carried.

 

 I-LPG-2009-15   C conducted an inspection that resulted in a failing and a "C" card being issued. R notified the IBOL that the dispensing equipment at the facility has been removed and the facility has turned over the license. Therefore, the IBOL recommends the Board authorize closure.

 

A motion was made by Mr. Keller to close the case. Seconded by Mr. Lehman, motion carried.

 

 I-LPG-2009-59   Inspection revealed failure to comply with NFPA 58 requirements and a “C” card was issued. Follow-up inspection was required. INV revealed the R canceled their license and sent a letter stating they no longer intend to dispense propane from this facility.  IBOL recommends the Board authorize closure.

 

A motion was made by Mr. Keller to close the case. Seconded by Mr. Lehman, motion carried.

 

 I-LPG-2009-67   C alleged the R is operating an unlicensed LPG Bulk Facility. Records show that R became licensed subsequent to INV contact. Based on R's immediate compliance, IBOL recommends the Board authorize closure.

 

A motion was made by Mr. Keller to close the case. Seconded by Mr. Lehman, motion carried.

 

 I-LPG-2009-68; 87; 88  C alleged the R's facility license was expired for approximately three months and continued to dispense propane. INV revealed the R renewed their expired license immediately upon notification.  IBOL recommends the Board authorize closure due to compliance.

 

A motion was made by Mr. Lehman to close the three cases. Seconded by Mr. Keller, motion carried.

 

INSPECTION FORMS

 

A discussion was held regarding the proposed changes to the facility inspection forms. The statement regarding “C” classifications will be changed as follows:

“Subsequent to the issuance of a ‘C’ classification and in order to maintain operation the facility must, within 60 days of the inspection either, complete the required improvements to gain compliance, or submit a detailed plan of correction for Board approval that includes the time necessary to complete the required improvements.” A letter explaining this change will be sent to all facilities with a “C” card.

           

CORRESPONDENCE

 

The Board reviewed correspondence.

 

EXECUTIVE SESSION

 

A motion was made by Mr. Lehman to go into executive session to review applications exempt from public disclosure per Idaho Code 67-2345(1)(d). Seconded by Mr. Keller. The vote was: Mr. Lehman, aye; Mr. Keller, aye;

and Mr. Van Hees, aye. Motion carried.

 

A motion was made by Mr. Lehman to come out of executive session. Seconded by Mr. Keller. The vote was: Mr. Lehman, aye; and Mr. Keller, aye; and Mr. Van Hees, aye. Motion carried.

 

A motion was made by Mr. Lehman to approve 15 facility applications; one facility application is pending further information, and to deny one dealer application for licensure. Seconded by Mr. Keller, motion carried.
