Board Meeting Minutes of 7/22/2010

The meeting was called to order at 9:00 AM MDT by Roberta Crockett, M.A.

 

APPROVAL OF MINUTES

 

The Board reviewed the May 4 & 5, 2010 minutes.  Mr. Glick moved to approve the minutes as written.  Seconded by Dr. Freeman, motion carried.

 

LEGISLATIVE REPORT

 

Ms. Hall presented the legislative update to the members of the Board.

 

FINANCIAL REPORT

 

Ms. Hall presented the financial report to members of the Board, which showed a negative cash balance of $4,606.72 with revenues of $174,940.58 and expenditures of $146,005.92 as of 06/30/2010.

 

DISCIPLINE

 

Ms. Mac Master presented COU-2008-19 to members of the Board.  Ms. Crockett recused herself and passed the gavel to Dr. Freeman.  Discussion was held on appointing a liason officer from the Board to assist as an expert in a particular case. Ms. Spenner moved to appoint Dr. Freeman liason officer to advise the Attorney General’s Office.  Seconded by Mr. Glick, motion carried. 

 

Ms. Mac Master presented COU-2009-16 to members of the Board.  Mr. Glick moved to close COU-2009-16 and authorize the Attorney General’s Office to send a cease and desist letter.  Seconded by Ms. Hill, motion carried.

 

Ms. Mac Master presented COU-2010-1 to members of the Board.  Dr. Freeman moved to accept the recommendation for closure. Seconded by Mr. Glick, motion carried.

 

Ms. Mac Master presented COU-2010-9 to members of the Board.  The Board made recommendations to the Attorney General’s Office.

 

Ms. Mac Master presented COU-2010-10 to members of the Board.  Ms. Spenner moved to accept the recommendation for closure with an advisory letter regarding boundaries and dual relationships as outlined in the ACA (American Counseling Association) code of ethics. Seconded by Mr. Glick, motion carried.

 

Ms. Mac Master presented COU-2010-11 to members of the Board.  The Board made recommendations to the Attorney General’s Office.

 

Ms. Mac Master presented COU-2010-15 to members of the Board.  The Board made recommendations to the Attorney General’s Office.

 

Ms. Mac Master presented COU-2010-16 to members of the Board.  Mr. Glick moved to close COU-2010-16 and authorize the Attorney General’s Office to send a cease and desist letter.  Seconded by Ms. Spenner, motion carried.

 

Ms. Mac Master presented COU-2011-1 to members of the Board.  Ms. Spenner moved to accept the recommendation for closure. Seconded by Mr. Glick, motion carried.

 

INVESTIGATIVE REPORT

 

Ms. Peel presented the investigative report to the members of the Board.

 

For Board Determination:

 

I-COU-2009-21  C alleged that while she was employed at the same agency as R, she saw R grab, push, and violently yell at children.  C also stated that she witnessed R be verbally abusive to children. Investigation revealed that the facility worked with 3 to 10-year-old children with behavioral issues.  Both C and R informed the investigation that the facility did not have a policy regarding disciplining children while they were at the agency.  (The facility closed in March 2009.)  R stated that he did place a child in the corner for a time-out but denied that he grabbed the back of the child’s head and pushed his face into the wall.  R stated that C also filed a complaint with Health and Welfare, and Health and Welfare investigated and found the complaint unfounded.  R stated that if a child was having a tantrum and was out of control he occasionally held their arms behind their back for a second or two so they did not harm themselves or him.  R stated that he is in a wheelchair and did not want the kids to fall on it and get hurt.  The investigator spoke to another former co-worker who stated that he did not see any inappropriate behavior by R with the children.  Health and Welfare informed the investigator that C was inconsistent on what she saw and how she saw it, and when she talked to a police officer she said she did not see R do anything to a child.  Health and Welfare stated that the allegations were unsubstantiated so the case was closed.  Based on the results of the investigation, IBOL recommends that the Board authorize closure. Mr. Glick moved to accept IBOL’s recommendation for closure. Seconded by Dr. Freeman, motion carried.

 

I-COU-2010-19  C, the mother of a minor client, alleged R provided unauthorized counseling to the child.  The investigation revealed that the child’s parents were divorced and the father was bringing the child to counseling.  The mother claimed that because the custody agreement states that the parents would “provide advance notification to the other of proposed or forthcoming non-emergency medical care” and that neither parent would incur any elective health care expenses “without consulting with each other,” the father could not take the child to counseling without the mother’s permission.  R informed the investigator that she had ensured that the child custody agreement was in place and agreed to provide counseling after notifying the father that he needed to make sure the mother was aware of the counseling.  R stated that the child had been in counseling for several years off and on due to the parents’ high-conflict divorce.  A pro reviewer found that R provided requested continuing therapeutic services subsequent to receiving permission from a legal guardian/parent, and R did not violate the ACA Code of Ethics.  IBOL recommends that the Board authorize closure.  The Board discussed this matter and would like legal interpretation of the law where there is joint custody involved.

 

I-COU-2010-42  In response to an audit request, R submitted documentation verifying 18.75 Board-approved hours.  R subsequently provided documentation showing an additional 5 hours during the audit period.  IBOL recommends that the Board authorize closure. Ms. Spenner moved to accept IBOL’s recommendation for closure. Seconded by Mr. Glick, motion carried.

 

Ms. Peel presented COU-2010-22 to members of the Board.  Dr. Freeman moved to accept the Findings of Fact, Conclusions of Law and Final Order, and authorize the Chair to sign on behalf of the Board.  Seconded by Mr. Glick, motion carried.

 

OLD BUSINESS

 

REVIEW OF LAWS & RULES WORKGROUP

 

Dr. Freeman discussed the workgroup with members of the Board to review the licensure laws and rules.  The names that will be working on this group are as follows:  Dr. Freeman, Ms. Spenner, Ms. Crockett, Piper Field, Susan Holmes, Diana Pals, and Eric Pettingill.  Dr. Freeman will contact a former Board member to see if they would like to join the work group. Dr. Freeman moved to constitute the task force for review of the laws and rules with those names that were submitted.  Seconded by Ms. Spenner, motion carried.            

 

The Board broke for lunch at 12:15 pm.

The Board reconvened at 1:30 pm.

 

SUPERVISION

 

The Board discussed a proposed supervision outline. The Board would like that to remain in the file as part of the workgroup discussion.

A motion was made by Ms. Spenner that the Board go into executive session under Idaho Code § 67-2345(1)(d) to consider records that are exempt from disclosure under the Idaho Public Records Law.  The purpose of the Executive Session was to consider license application materials.  Seconded by Mr. Glick, motion carried. Individual vote for this motion was: Ms. Crockett, aye; Ms. Spenner, aye; Mr. Glick, aye; and Ms. Hill, aye.  Dr. Freeman was out of the room.

 

Mr. Glick moved to enter into regular session.  Seconded by Ms. Spenner, motion carried. Individual vote for this motion was: Ms. Crockett, aye; Ms. Spenner, aye; Mr. Glick, aye; Ms. Hill, aye; and Dr. Freeman, aye.

 

ELECTION OF OFFICERS

 

Mr. Glick moved to nominate Ms. Woods as Chair.  Seconded by Dr. Freeman, motion carried.

 

Dr. Freeman moved to nominate Mr. Glick as Vice-Chair.  Seconded by Ms. Spenner, motion carried.

CONFERENCES

 

Dr. Freeman moved to approve the AASCB (American Association of State Counseling Board) annual dues.  Seconded by Mr. Glick, motion carried. 

 

The Board discussed upcoming conferences.

 

Mr. Glick moved to pay expenses to send Ms. Crockett to the AMFTRB conference.  Seconded by Ms. Spenner, motion carried. 

 

CORRESPONDENCE

 

The Board reviewed correspondence from Tom Moreland.  The Board suggested ISCA (Idaho School Counseling Association) and ICA (Idaho Counseling Association) would meet his needs as both conferences are being held in Coeur d’Alene this year.  The Board also suggested taking an audit course from U of I. 

 

The Board reviewed correspondence from Fred Mondin and Joan Henderson requesting the Board consider raising the amount of carryover CEs currently allowed by rule.  The Board will take this matter under advisement with the workgroup.

ANNUAL REPORT

 

The Board reviewed the updated annual report and would like Ms. Cory to review this report with the Board at its next meeting.

Mr. Glick moved to approve Garlena Rumsey’s intern permit pending receipt of official transcript sent directly to the Bureau of Occupational Licenses and approved Michael Hill for licensure pending receipt of passing NCE results sent directly to the Bureau of Occupational licenses.  Seconded by Ms. Spenner, motion carried.

Dr. Freeman moved to extend a grace period until July 2011 of the new requirement in rule 150.01.a.iii which asks for one graduate level course unique to each of the following eight areas and also a grace period until July 2011 in regard to the new requirement changes for counseling students in graduate programs’ supervisors outlined in rule150.02.b.  Seconded by Mr. Glick, motion carried.
