 APPROVAL OF MINUTES

 

The Board reviewed the February 3rd & 4th, 2009 minutes.  Mr. Glick moved to approve the minutes as written.  Seconded by Dr. Freeman, motion carried.

 

The Board reviewed the February 11th, 2009 minutes.  Mr. Glick moved to approve the minutes as amended.  Seconded by Ms. Hill, motion carried.

 

LEGISLATIVE REPORT

 

Ms. Cory presented the legislative update to the members of the Board.

 

FINANCIAL REPORT

 

Mr. Hetrick gave the financial report, which showed a negative cash balance of $31,949.63 with revenues of $140,890.00 and expenditures of $157,088.26 as of 4/30/2009.

 

INVESTIGATIVE REPORT

 

Mr. Hetrick presented the investigative report to the members of the Board.

 

DISCIPLINE

 

For Board determination:

 

I-COU-2007-7                     C alleged R provided COU services to C & children; that R kept C isolated from family & others; & R was unethical. C was unclear as to specific issues that may be violations. IBOL records do not show a license for R. INV revealed that R is a PSR provider who worked under the supervision of an LCPC in a counseling agency.  INV revealed that R is no longer employed at the agency.  INV did reveal evidence to support the allegations of providing PSR services. If the Board considers PSR services to be the practice of COU, IBOL recommends the Board authorize closure with an advisory letter and a copy to the prosecutor. Dr. Freeman moved to accept IBOLís recommendation for closure with an advisory letter and a copy to the prosecutor.Seconded by Mr. Glick, motion carried. Dr. Freeman moved to amend the motion to also include a copy of the letter sent to the supervisor.Seconded by Mr. Glick, motion carried.

 

I-COU-2007-8                     C alleged R provided COU services to C & children; that R kept C isolated from family & others; & was unethical. C was unclear as to specific issues that may be violations. INV revealed that R did provide services to C & family while employed at a counseling agency.  INV revealed that R provided a complete statement denying all allegations of unethical conduct and appeared to be very familiar with the ethical requirements. C would not respond to INV inquiries for additional information. INV did not reveal evidence to support the allegations or a violation. IBOL recommends the Board authorize closure. Ms. Woods moved to accept IBOLís recommendation for closure in this matter.  Seconded by Mr. Glick, motion carried.

 

I-COU-2008-15                   C alleged that R was counseling C's child and was sending a bill to C that should have gone to the other parent.  C also alleged that R failed to provide a report of the child's counseling.   R was called to testify in a custody hearing as a witness and C alleged that R lied under oath regarding R willingness to involve C in the counseling service.  C also alleged that R, along with C's former spouse, had filed at least seven child abuse allegations and R testified under oath that the former spouse has never stated that C was a child abuser. INV revealed that R provided written responses and denied all allegations. INV also revealed that the court record is sealed and no evidence regarding R's testimony is obtainable. R did provide documentation of contact with C and of providing C with requested information.  INV did not reveal evidence to support the other allegations or a violation of law or rule. IBOL recommends the Board authorize closure. Dr. Freeman moved to accept IBOLís recommendation for closure in this matter.  Seconded by Mr. Glick, motion carried.

 

I-COU-2009-3                     C alleged the R was verbally and physically abusive to minor clients. INV revealed the R conducted a role-playing exercise to show the children how to walk away from a fight, but that the children were not hurt in any way by the exercise.  One of the parents of the children supported the Rís statement when questioned. The children were not made available to talk to, so the INV could not confirm the allegations or support the Rís statements.  Based on Rís and witness statements, it appears the events may have been exaggerated by the children.  The children were not made available interview, so the INV could not confirm the allegations or support the Rís statements. INV did not reveal evidence to support the allegations or a violation.  IBOL recommends the Board authorize closure. Mr. Glick moved to accept IBOLís recommendation for closure in this matter.  Seconded by Ms. Woods, motion carried.Mr. Glick moved to amend the motion to request an advisory letter also be sent.Seconded by Ms. Woods, motion carried.

 

I-COU-2009-15                   C alleged the R fraudulently billed the C's insurance. INV revealed the R correctly billed the insurance for family therapy without the C being present.  Documents and statements confirmed that the court ordered sessions were provided as ordered and billings were correctly submitted and processed. INV did not reveal any evidence to support the allegation or a violation.  IBOL recommends the Board authorize closure. Dr. Freeman moved to accept IBOLís recommendation for closure in this matter.  Seconded by Mr. Glick, motion carried.

 

I-COU-2009-20                   C alleged the R was seeing the Cís estranged spouse and child and the C for counseling during a dispute over a change in a custody.  C stated the R told the C there was a conflict of interest that the R knew the C's family and could not see either party and cancelled all appointments.  C now states the R is seeing the C's estranged spouse and child on a regular basis and states this is a violation of the ACA Code of Ethics. INV revealed that R recognized a possible conflict of interest because of family acquaintance and decided to stop seeing the clients. R referred them to another counselor after reviewing concerns with a colleague.  INV did not reveal evidence to support a violation of the code of ethics or law or rule. IBOL recommends the Board authorize closure. Ms. Woods moved to accept IBOLís recommendation for closure in this matter.  Seconded by Mr. Glick, motion carried.

 

I-COU-2009-26                   C alleged R provided COU services to C & children; that R kept C isolated from family & others; & was unethical. C was unclear as to specific issues that may be violations, though PSR services were referenced. INV revealed the C will not respond to any attempts to contact the INV, so supporting information and documents cannot be obtained to support the allegations.  INV did not reveal any evidence to support the allegation or violation.  IBOL recommends the Board authorize closure. Dr. Freeman moved to accept IBOLís recommendation for closure in this matter.  Seconded by Mr. Glick, motion carried.

 

I-COU-2009-29                   C alleged the R wrote an insufficient funds check for a renewal. IBOL records revealed that the bad check was for an overpayment so no bad check fee is required.  The license is current and the transaction record has been updated and no further action is required.  IBOL recommends the Board authorize closure with an advisory letter regarding submitting bad checks to the Board. Ms. Hill moved to accept IBOLís recommendation for closure in this matter.  Seconded by Mr. Glick, motion carried.

 

The Board discussed a request to make payments in regard to COU-2008-21. Mr. Glick recused himself.Dr. Freeman moved to grant an additional six months from May 3rd for the fees to be paid.Seconded by Ms. Woods, motion carried.

 

Ms. Mac Master presented COU-2008-24. The Board discussed COU-2008-24 and made recommendations to the Attorney Generalís Office.

 

Ms. Mac Master presented COU-2007-12. Dr. Freeman moved to authorize the Attorney Generalís Office to close COU-2007-12 and send an advisory letter. Seconded by Mr. Glick, motion carried.

 

Ms. Mac Master presented COU-2007-13. Mr. Glick moved to authorize the Attorney Generalís Office to close COU-2007-13 and send an advisory letter. Seconded by Dr. Freeman, motion carried.

 

The Board discussed submitting names of pro reviewers, specifically in regard to child custody cases to IBOL.

 

Ms. Mac Master presented COU-2009-14. Mr. Glick moved to authorize the Attorney Generalís Office to close COU-2009-14 and send an advisory letter. Seconded by Ms. Woods, motion carried.

 

Ms. Mac Master presented COU-2009-12. The Board discussed COU-2009-12 and made recommendations to the Attorney Generalís Office.

 

Ms. Lorraine Lambert addressed the Board in regard to her application.

 

EXECUTIVE SESSION

 

Mr. Glick moved to enter into executive session under Idaho Code 67-2345 (1) (d), to consider records that are exempt from disclosure.  Seconded by Dr. Freeman, motion carried. Individual vote for this motion was: Ms. Crockett, aye; Ms. Hill, aye; Dr. Freeman, aye; Mr. Glick, aye; and Ms. Woods, aye.

NEW BUSINESS

 

Health and Welfare

 

Ms. Laurie Geren addressed the Board in regard to the proposed Health and Welfare rules that would prohibit licensed professional counselors (LPC), licensed clinical professional counselors (LCPC), licensed associate marriage and family therapists (LAMFT), and licensed marriage and family therapists (LMFT), work with clients in substance abuse facilities unless they also had a certified substance abuse certificate.

 

The Board broke for lunch at 12:30 p.m.

 

The Board was called back to order at 1:45 p.m.

 

Miriam Ezraty addressed the Board in regard to the continuing education requirements and annual renewals.No action was taken.

 

The Board went over the proposed rule changes and will follow-up with Mr. Hales.

OLD BUSINESS

 

The Board discussed the revised rules.Mr. Hales will draft the proposed rules for the Board to review at their July 7, 2009 meeting.

 

PROPOSED RULES

 

The following are the proposed rule changes:

 

150.01.iii Ė applicant must complete one graduate level course in each of the eight areas.

105.02.b Ė supervision must be provided by a counselor education faculty member at an accredited college or university or a Professional Counselor or Clinical Professional Counselor or Marriage and Family Therapist licensed by the State and registered with the Board as a supervisor.

245- adding licensed professional counselor

250 Ė deleting professional counselor

300.01 Ė Foreign country must have substantially similar requirements for licensing as is provided for new applicants in Idaho.

425- continuing education policy will be outlined in rule

 

NEW BUSINESS

 

Health and Welfare

 

The Board discussed the proposed Health and Welfare rule in regard to the certified substance abuse certificate.Mr. Glick moved to request Ms. Crockett draft a letter on the Boardís behalf to the Department of Health and Welfare in regard to proposed rule changes to IDAPA 16.06.03.Seconded by Dr. Freeman, motion carried.

Ms. Woods moved to table the actions in regard to applicants 90103822, 901104044, and 901106009 pending receipt of additional information for the Boardís review.  Seconded by Mr. Glick, motion carried.

 

Ms. Woods moved to approve Tracy Sorensen licensure pending receipt of official exam score to the Bureau of Occupational Licenses. Seconded by Mr. Glick, motion carried.
