Chairman Roberta Crockett called the meeting to order at 9:00 a.m.

 

The Board reviewed the February 6th & 7th minutes and made some corrections. Dr. Birdsall moved to approve the minutes as amended.  Seconded by Dr. Freeman, motion carried.

 

Dr. Jones moved to enter into executive session under Statute 67-2345, to consider records that are exempt from disclosure as provided in chapter 3, title 9, Idaho Code.  Seconded by Dr. Freeman, motion carried.

 

Dr. Birdsall moved to enter into regular session.  Seconded by Ms. Hill, motion carried.

Chairman Roberta Crockett called the meeting to order at 9:00 a.m.

 

Ms. Cory welcomed the Board members and gave a brief legislative update noting; the Governor’s revised budget had been approved by the legislature so the Bureau would be hiring more staff.  The additional positions include two new investigators and two office specialists.

 

Mr. Hales gave an update on the Rule changes that passed and are now in affect, which includes the annual renewal fee increase.

 

The Board discussed renewal notices and continuing education.  The Board clarified that applicants MUST have met the continuing education requirements before they sign their renewal notice. 

 

Mr. Hetrick presented the financial report which is available to the public on the Bureau’s website at www.ibol.idaho.gov.

 

INVESTIGATIVE REPORT

 

Mr. Hetrick presented the investigative report that indicated:

 

FY2007:  To date, twenty-one (21) complaints have been received. Of those, two (2) have been closed subsequent to Board determination; one (1) is pending legal review; and eighteen (18) remain under investigation.
FY-2006:  Thirteen (13) complaints were received. Of those, two (2) have been closed subsequent to Board determination; four (4) are pending legal review; six (6) remain under investigation; and one (1) awaits Board determination.
FY-2005:  Twenty-eight (28) complaints were received.  Of those twelve (12) have been closed subsequent to Board determination; three (3) were closed subsequent to disciplinary action; three (3) are pending legal review; eight (8) remain under investigation; and one (1) awaits Board determination. 
FY-2004:  Twenty-six (26) complaints were received.  Of those, nineteen (19) have been closed subsequent to Board determination; three (3) were closed subsequent to disciplinary action; three (3) are pending legal review; and one (1) remains under investigation.
FY-2003:  Twenty-one (21) complaints were received.  Of those, fourteen (14) have been closed subsequent to Board determination; three (3) were closed subsequent to disciplinary action; three (3) are pending legal review; and one (1) remains under investigation.

Dr. Birdsall moved to approve IBOL recommendations for closure against complaint COU-P3A-4-2005-27. Seconded by Dr. Jones, motion carried.

 

Dr. Jones moved to approve IBOL recommendations for closure against complaint COU-P5-1-2006-1. Seconded by Dr. Freeman, motion carried.

 

Ms. Mac Master presented COU-2007-1.  Dr. Freeman moved to accept the recommendations presented by the Attorney General’s office and authorize the Board Chair to execute the document on behalf of the Board.  Seconded by Dr. Birdsall, motion carried.

 

Ms. Mac Master presented the following complaint cases:

The Board discussed each case and made recommendations for disciplinary actions.

 

Dr. Jones moved to appoint Dr. Freeman to coordinate with the Bureau in developing a supervisory form that would include details for reporting back to the Board disciplinary actions from licensees.  Seconded by Dr. Birdsall, motion carried. 

 

Dr. Freeman moved to enter into executive session under Statute 67-2345, to consider records that are exempt from disclosure as provided in chapter 3, title 9, Idaho Code.  Seconded by Dr. Jones, motion carried.

 

Dr. Jones moved to enter into regular session.  Seconded by Ms. Hill, motion carried.

 

Dr. Birdsall moved to deny applicant # 901092406 for endorsement based on a citation issued on Applicants license.  Seconded by Dr. Jones, motion carried.

 

Ms. Woods moved to deny applicant # 901035837 for licensure based on the requirements of the stipulation in Colorado and applicants failure to comply with Statute 54-3405(4).  Seconded by Dr. Jones, motion carried.

 

Ms. Woods moved to accept the Board’s recommendation for those applicants approved for licensure.  Seconded by Dr. Jones, motion carried.

 

Dr. Jones moved to table actions on the following applications, pending receipt of additional information.  Seconded by Ms. Woods, motion carried.

Dr. Freeman moved that a license be issued to Peter Billings upon receipt of the official transcripts arriving at the Bureau.  Seconded by Ms. Woods, motion carried.

 

The Board noted: in order for an application to be considered complete and ready for review it must include the official transcripts.  Per Rule 149.02 Provide Verification of Educational Program. Verify completion of the approved educational program identified on the application with official graduate transcripts. Official transcripts must be received by the Board directly from the registrar of the appropriate college or university.

 

Dr. Freeman moved to have letters sent out to applicant file # 901064167 indicating what is needed to complete each application for licensure in Idaho.  Per Rule 149.06 applicant has 12 months to comply.  Seconded by Ms. Woods, motion carried.

 

Mr. Hales went over a memo that narrowed down the requirements and limitations of the First Amendment as it relates to the Board.  Mr. Hales suggested the Bureau may come up with a policy that establishes how the public can address the Board.

 

Mr. Hales reviewed the continuing education rule with the Board. 

 

The Board discussed Rule changes.

 

Dr. Birdsall moved that Mr. Hales draft rule changes for both an inactive license and a senior license.  Seconded by Dr. Jones, motion carried.

 

Dr. Birdsall went on record to say she researched retirement/senior status license to honor seniors. 

 

Dr. Birdsall moved to revise Rule 150.01.e to reflect current terminology of the accrediting directory.  Seconded by Dr. Jones, motion carried. 

 

Dr.  Jones moved to change language in Rule 300.07.i to read minimum 100 hours continuing education hours for the past 5 years prior to application.  Seconded by Ms. Woods, motion carried.

 

Dr. Freeman moved to incorporate a minimum of one graduate level course in at least six (6) of the following eight (8) areas into Rule 150.01.  Seconded by Dr. Birdsall, motion carried.

 

The Board discussed the fact that both Marriage and Family board member’s term would be up at the same time and were concerned about how that could affect the integrity of the Board. 

 

Ms. Cory will consult with Ann Beebe to bring this concern to Governor’s attention.

 

The Board clarified twenty (20) hours of continuing education are required upon the 1st application for renewal of a license and every year thereafter.

 

Dr. Jones moved for Mr. Hales to draft a proposed rule making it mandatory that MFT applicants register as an intern prior to accruing clinical supervised hours – with implementation to begin at the end of the 2009 legislative session.  Seconded by Dr. Birdsall, motion carried.

 

The Board reviewed a correspondence from Idaho Mental Health Counselor Association requesting they be added as an approved provider for continuing education.

 

The Board approved the following organizations as providers of continuing education for Idaho licensees and requested they be added to the website.

 

IDAHO MENTAL HEALTH COUNSELOR ASSOCIATION (IMHCA)

AMERICAN MENTAL HEALTH COUNSELORS ASSOCIATION (AMHCA)

IDAHO SCHOOL COUNSELORS ASSOCIATION (ISCA)

AMERICAN SCHOOL COUNSELORS ASSOCIATION (ASCA)

 

The Board reviewed and took into consideration a correspondence letter from Adam Williamson.

 

Dr. Freeman discussed the information she has been gathering for creating a power point presentation for use at conferences.  This presentation would include reports and flow charts for the complaint and application process to aid associations and new licensees.

 

Dr. Freeman will be working with the Bureau in structuring an annual report that would be updated each year at the July board meeting.

 

Dr. Freeman will be attending the NBCC meeting August 14th & 15th  in Reno, Nevada.

 

Ms. Woods will be attending the AMFTRB meeting September 4th, 5th & 6th in Atlanta, Georgia.

 

The Board will not be sending a representative to the CLEAR conference.

 

Dr. Jones is planning on attending the Idaho Association of Marriage & Family conference being held September 28th & 29th

 

The Board reviewed and discussed a correspondence from David Kleist regarding addendum 1 on the application for licensure.

 

The Board directed Ms. Crockett to draft a letter to Mr. Kleist in response to his correspondence.

 

The Board requested the following be added to the top of the licensure application Addendum 1:

*Please note: Graduates of approved Council for Accreditation of Counseling and Related Educational Programs (CACREP) and Council on Rehabilitation Education (CORE) counseling programs do not need to complete Addendum 1.

 

Ms. Woods moved to delete section 150.01.a.i. referring to the National Council for accreditation of Teacher Education.  Seconded by Dr. Birdsall, motion carried.

 

The Board discussed the Frequently Asked Questions (FAQ’s) page that is being developed to add to the web.  The Board will review the information and submit their suggestions to the Board secretary.

 

Dr. Birdsall went on record thanking everyone for the opportunity to serve on the Board. 

 

The Board thanked Dr. Birdsall for her dedication and contribution for serving on the Board. 

 

Ms. Hill moved to adjourn the meeting.  Seconded by Dr. Freeman, motion carried.

 

The next board meeting is scheduled for July 10th & 11th, at the Bureau of Occupational Licenses.
