MEMORANDUM

             DATE:          October 1, 2007

             TO:               Idaho State Board of Cosmetology Examiners

             SUBJECT:   Complaint / Investigative Report

  

FY2008:  To date, twenty-three (23) complaints have been received. Of those, all remain under investigation.

FY2007:  Sixty-seven (67) complaints were received. Of those, nineteen (19) have been closed following Board review; two (2) were closed following disciplinary action; sixteen (16) are pending legal review, twenty-three (23) remain under investigation; and seven (7) await Board determination. 

FY2006: Eighty-five (85) complaints were received. Of those, forty-five (45) have been closed following Board review; twenty (20) were closed following disciplinary action; twelve (12) are pending legal review, seven (7) remain under investigation; and one (1) awaits Board determination. 

FY-2005:  Sixty-four (64) complaints were received. Of those, thirty-two (32) have been closed following Board review; twenty (20) were closed following disciplinary action; seven (7) are pending legal review; and five (5) remain under investigation. 

FY-2004:  Seventy three (73) complaints were received.  Of those, forty-five (45) were closed following Board review; twenty-four (24) were closed following disciplinary action; and four (4) are pending legal review. 

For Board determination:

COS-B1C-1-2006-77                Renewal received without proof of current bond. Notice received from insurance company noting the $5000 bond was expiring. IBOL sent letter to R advising that proof of $25,000 bond was required before license could be renewed. Proof of bond was later received showing no lapse in coverage. IBOL recommends the Board authorize closure and license was renewed.

COS-L1-2-2007-41                C alleged R was practicing as an instructor without a CI license. IBOL records show R holds a current RC license, and there was no record of a student instructor permit. INV revealed that R did provide advice to students on an irregular basis. INV did not reveal evidence to show that R was acting without the supervision of other instructors, or that R was receiving training towards a CI license. IBOL records confirm that R did later obtain a CI license. INV did not reveal evidence to support the allegations or of a violation. IBOL recommends the Board authorize closure.

COS-L1-2-2007-42                C alleged that R is practicing cosmetology in an unlicensed facility without the benefit of COS licensure. INV confirmed unlicensed practice and R was advised of the violation and the licensure process. IBOL recommends the Board authorize with a cease and desist letter to R with copy to prosecutor.

COS-P6-2-2007-51                C alleged R's GED document to get into cosmetology school was forged and is not legitimate. INV revealed that a foreign certificate of education with translation was included in the application materials. INV revealed that the name on the certificate did not match the applicant, and no name change documentation was provided. INV was unable to confirm the authenticity of the document. R maintained that the name change took place during immigration and that no identification was required. The Board later approved the applicant for exam based on the application materials, and R passed the exam and was issued a license. IBOL recommends the Board authorize closure.

COS-B3B-2-2007-53                C was required by the R to sign several R-40's for a student instructor whom is a close friend to the school owner. The student instructor has not completed any training. C feels the school owner should have never put C in that position without requiring the friend to follow the student instructor criteria. INV revealed that the records were corrected by the R prior to the investigation and that C withdrew the complaint. IBOL recommends the Board authorize closure.

COS-B6B-3-2007-55                C alleged that R fraudulently used a credit card to renew R's license. INV revealed that R is the grandchild of the cardholder and that the cardholder forgot to tell the R the card had been cancelled. INV confirmed that the cardholder had given prior permission to use the card to the R. INV did not reveal evidence of a violation. IBOL recommends the Board authorize closure.

COS-L5B-2-2007-58                C alleged that R was practicing as an apprentice EST without adequate supervision. C stated that R works on clients when the CI is not in the salon. IBOL record shows that R is awaiting re-exam due to a previous L&R exam failure. INV revealed that R denied the allegations and that C could not provide witnesses or other proof of the allegations. IBOL recommends the Board authorize closure.

COS-B1-2-2007-64                C alleged unlicensed practice. INV witnessed the R providing pedicure services to a client. Owner and R were both cited by local PD. IBOL recommends the Board authorize closure with a cease and desist letter.
