MEMORANDUM

             DATE:          October 2, 2006

             TO:               Idaho State Board of Cosmetology Examiners

             SUBJECT:   Complaint / Investigative Report

  

FY2007: To date, eleven (11) complaints have been received. Of those, ten (10) remain under investigation; and one (1) awaits Board determination.

FY2006: Eighty-six (86) complaints were received. Of those, twenty-two (22) have been closed without action, thirty-nine (39) have been referred for formal action review, sixteen (16) remain under investigation; and nine (9) await Board determination. 

FY-2005:  Sixty-three (63) complaints were received. Of those, twenty-five (25) have been closed without action, twenty-eight (28) have been referred for formal action, and ten (10) remain under investigation. 

FY-2004:  Seventy three (73) complaints were received.  Of those, forty-one (41) were closed without action; thirty (30) were referred for formal action; and two (2) remain under investigation. 

There are thirty-seven (37) currently pending disciplinary matters.

For Board determination:

COS-P5-2-2006-40            C alleged that R altered student hourly records; that the administrative staff and instructors are dishonest, rude and practice bad moral conduct; that sexual comments are being made to students; and there is alleged drug use. INV revealed evidence to show that hourly records were not being maintained or recorded in an appropriate manner; that law classes were routinely cancelled; that students were not provided with law & rule books; and that students were overbooked and pulled from theory classes to work on patrons. No evidence was revealed to support the other allegations. Subsequent INV record reviews have revealed that record maintenance and hour calculations have improved since C is no longer employed at the school. IBOL recommends the Board authorize closure with an advisory to school regarding the importance of adequate training in sanitation, laws and rules training, and diligent record keeping.

COS-L4-2-2006-51            C alleged that R did not met the sanitary requirements for operation of an establishment. INV revealed that R's salon did not comply with sanitary requirements and a "C" card was issued. INV follow-up revealed that sanitation had been improved and an A card was issued. IBOL recommends the Board authorize closure.

COS-B4A-2-2006-57        C alleged that R did not met the sanitary requirements for operation of an establishment. INV revealed that R's salon did not comply with sanitary requirements and a "C" card was issued. INV follow-up revealed that sanitation had been improved and an A card was issued. IBOL recommends the Board authorize closure.

COS-L3-2-2006-73            C alleged that R was incompetent or dishonest in the management of student training, lacked appropriate moral ethics, and that R threatened a student. INV revealed that R is no longer employed by the school in question. R stated that some comments may have been threatening in nature but that no real harm was intended. INV revealed that R did not have the access necessary to alter student hours. INV did not reveal evidence to support the other allegations or violations of law or rule. IBOL recommends the Board authorize closure with an advisory letter to be more aware of the perceptions of R's comments and actions.

COS-L3-2-2006-74            C alleged that R was incompetent or dishonest in the management of student training and moral ethics. INV revealed that C made numerous allegations concerning gossip in the school. INV did not reveal evidence to support the allegations or any violation of law or rule. IBOL recommends the Board authorize closure.

COS-L3-2-2006-75            C alleged that R was involved in altering school records, is addicted to drugs and makes sexual comments to students. INV revealed that C's allegations were based on hearsay and unsubstantiated comments. R denied all allegations. INV was unable to obtain any evidence to substantiate the allegations or violations of law or rule. IBOL recommends the Board authorize closure.

COS-L3-2-2006-76            C alleged that R was very unprofessional by fondling self in front of students. INV revealed that R was previously reprimanded by the school for inappropriately touching self in the presence of other students. R admitted to having "jock itch" at the time of the incident. School officials denied receiving any complaints after the initial reprimand. While evidence was revealed to substantiate the allegations, INV did not reveal evidence of a violation of law or rule. IBOL recommends the Board authorize closure.

COS-L1B-2-2006-79            C alleges that R is allowing unlicensed hairstylists aka techs to practice on the public and then snuck out the back door when IBOL investigators show to do a routine inspection. INV contact was made with R and the salon on numerous occasions regarding this complaint. INV revealed that R was very cooperative and allowed full access to the facility and all personnel. INV did not reveal any evidence to support the allegations. IBOL recommends the Board authorize closure.

COS-B1C-2-2006-85            During a routine inspection R was found operating an establishment with a expired license. IBOL records noted that license had been expired for approximately 5 months. R was advised of violation and encouraged to reinstate license. A subsequent check of IBOL records showed that R had reinstated license. IBOL recommends the Board authorize closure with an advisory letter regarding timely renewal.

COS-B1C-2-2007-1            During a routine inspection R was found to be working with out the benefit of a current cosmetology license. IBOL records confirmed that R's license had expired in 2003. R stated "I thought my personal license had been rolled into the salon license." INV advised R of the license requirement and advised immediate reinstatement. A subsequent check of IBOL records confirmed that R had reinstated the license. IBOL recommends the Board authorize closure with an advisory letter regarding timely renewal.
