The meeting was called to order at 10:02 AM MST by Anthony J. Hughes.

 

APPROVAL OF MINUTES

 

A motion was made by Mr. Nemec to approve the minutes of 10/13/2009 and 11/10/2009.Seconded by Mr. Pinther, motion carried.

 

DISCIPLINE

 

CON-2008-83-Pursuant to the terms of the Stipulation and Consent Order, Ms. Peel presented to the Board the respondentís explanation of the licenses that respondent held in other states.The Board requested that a letter be sent to the respondent, asking for additional information.

 

CON-2008-154-Ms. Peel presented to the Board a request from the respondent that they be granted a 90-day extension to pay the fines, fees, and costs.A motion was made by Mr. Nemec to allow respondent 90 days from 12/14/09, the date of this request.Motion seconded by Mr. Timmins, motion carried.

 

Ms. Cory discussed with the Board confidentiality of complaints and disciplinary matters.

 

Mr. Klein presented CON-2009-23, a Petition for Reconsideration in which the respondent asked the Board to reconsider its Final Order, which had issued in the case upon respondentís default.Respondent asked the Board to set aside that Final Order and to allow him to appear and defend himself against the allegations, not withstanding his default.

 

A motion was made by Ms. Prather to deny respondentís petition for untimeliness. Motion seconded by Mr. Nemec and Mr. Timmins, motion carried.

 

Mr. Klein presented the following final orders to the Board for review: CON-2009-27, CON-2007-91, CON-2008-126, CON-2009-26, CON-2008-130, CON-2008-123, CON-2009-13, CON-2008-145, CON-2008-132, CON-2009-39, CON-2008-78, CON-2009-34, CON-2008-109, CON-2007-117, CON-2008-64, CON-2009-8, CON-2009-38, CON-2009-20, CON-2009-7 and CON-2008-133.A motion was made by Ms. Prather to adopt the hearing officerís findings of fact and conclusions of law in each case, to impose discipline on each respondent, to authorize the Chair to sign the Orders on behalf of the Board, and to also refer CON-2009-27 to the appropriate agency for follow up.The motion was seconded by Mr. Nemec, motion carried.

 

Ms. Magnelli presented memorandum CON-2008-163.A motion was made by Mr. Nemec to close this with a letter of warning.This motion seconded by Mr. Pinther, motion carried.

 

The Board revisited the district court decision in the Gem State Staffing Case.  The Board was not a party to that case, but the case does discuss how the Boardís law applies to a staffing agency that provides temporary laborers to a registered contractor.  The Board previously expressed disagreement with the courtís ruling and that staffing agencies must be registered.  This broad statement may have been premature.  The Board had not actually read the district courtís decision but had heard a summary of its holding discussed.  The Board has now read the courtís decision and sees that the court merely ruled that the staffing agency in that case did not need to be registered as a contractor, given the particular facts of that case.  The Board believes its initial expression of disagreement was too strong.  Whether a staffing agency must register as a contractor will require a case-by-case assessment and depend on what the staffing agency is actually doing.  Is the staffing agency providing skilled construction workers to meet a contractorís need for specialized tradespersons who can work independently on the contractorís project?  Or, is the staffing agency providing unskilled laborers to perform menial tasks under the contractorís direction?  The Board recognizes its law contains numerous exemptions to registration, that the facts of each case will differ, and that the application of existing law to different factual scenarios may compel different conclusions about the need for staffing agency registration.

 

DISCUSSION

 

Ms. Hall discussed with the Board the insurance audit process informing them that 170 files were audited.The audit form is requesting proof of coverage for a certain period of time, but it was the Boardís understanding that the audit was for proof of current insurance only.Future audits will ask for current proof of insurance.A motion was made by Mr. Pinther that current certificates of insurance as well as proof of the time period requested on the audit form be accepted and considered complete for audit purposes.This motion was seconded by Mr. Nemec, motion carried.

 

EXECUTIVE SESSION

 

A motion was made by Ms. Prather that the Board go into executive session under Idaho Code ß 67-2345(1) (d) to consider records that are exempt from disclosure under the Idaho Public Records Law.  The purpose of the Executive Session was to consider registration application materials.  Motion was seconded by Mr. Timmins, motion carried.The vote was: Mr. Timmins, aye; Ms. Prather, aye; Mr. Pinther, aye; Mr. Nemec, aye; and Mr. Hughes, aye.

 

Motion was made by Mr. Nemec to go out of executive session.  Motion was seconded by Mr. Timmins, motion carried.  Individual votes for this motion were: Mr. Pinther, aye; Ms. Prather, aye; Mr. Timmins, aye; Mr. Hughes, aye; and Mr. Nemec, aye.
