The meeting was called to order at 8:30 AM MDT by Anthony J. Hughes.

 

APPROVAL OF MINUTES

 

A motion was made by Mr. Elliott to approve the minutes of 9/22/2009.Seconded by Ms. Prather, motion carried.

 

LEGISLATIVE REPORT

 

Ms. Cory informed the Board that the Governor would like the Board to pursue the approval of NASCLA as construction standards as a statute change and not a rule change, which would allow the entire Legislature to review the information.The chairman wants to confer with the Idaho Building Contractors Association before continuing on.Ms. Cory and Mr. Klein are also to speak with investigations, to determine if there is the need for a construction standards guideline.The Board was informed that there was limited time to pursue this matter, due to the legislative deadline.Mr. Hughes approved an additional meeting if necessary to discuss this matter for submittal to Legislature.

 

Ms. Cory discussed with the Board implenting an insurance audit process.A motion was made by Mr. Elliott to approve a 2% audit annually, with the Bureau presenting to back to the Board by December 31st, 2009 the number that 2% will be, and when this audit will be run.The motion was seconded by Ms. Prather, motion carried.It was also determined that the current reinstatement/renewal process would remain as is.

 

FINANCIAL REPORT

 

Ms. Hall informed the Board that the budget had been increased due to the Boardís actual expenditures from the previous year.Ms. Hall also stated that in FY 2008 revenue did not exceed expenditures.The balance of this report was $375,180.00.

 

Ms. Hall also discussed with the Board its annual contract, informing them that most of the information was the same with the major changes being made to indirect expenses.A motion was made by Mr. Elliott to accept contract and authorize chair to sign.This motion was seconded my Ms. Prather, motion carried.

 

DISCUSSION

 

Mr. Klein gave the Board his updates on the amended rule/law changes that he has drafted.He has made amendments to the disciplinary statute, and is working with Mr. Jeremy Pisca who represents the Association to address the issue of an existing registrant registering under a new business.

 

DISCIPLINARY

 

Ms. Magnelli presented a Memorandum with recommendations for the following cases:

 

CON-2007-61 A motion was made by Mr. Elliott to authorize closure as recommended by the Boardís prosecutor.The motion was seconded by Ms. Prather, motion carried.

 

CON-2008-154 Mr. Elliott moved to authorize closure as recommended by the Boardís prosecutor, which took into consideration a district court decision discussing staffing agency registration.The Board does not necessarily agree with that decision as summarized.The motion was seconded by Ms. Prather, motion carried.

 

Ms. Magnelli presented Findings of Fact, Conclusions of Law and Final Order for Case No. CON-2007-63 to the Board for approval:

 

CON-2007-63 A motion was made by Mr. Elliott to approve the Final Order as presented and to authorize the Chair to sign the Order on behalf of the Board.The motion was seconded by Ms. Prather, motion carried.

 

Ms. Magnelli presented the following Stipulation and Consent Orders to the Board for approval:

 

CON-2008-83, CON-2009-29, CON-2009-36, and CON-2009-44

 

A motion was made by Mr. Elliott to approve the Orders as presented and to authorize the Chair to sign the Orders on behalf of the Board.The motion was seconded by Ms. Prather, motion carried.

 

Ms. Magnelli presented the following Default Orders and Findings of Fact, Conclusions of Law and Final Orders to the Board for Approval and explained the change in process is an effort to save costs for all parties involved.

 

CON-2009-33 A motion was made by Ms. Prather to enter an Order of Default.The motion was seconded by Mr. Elliott, motion carried.

 

A motion was made by Ms. Prather to accept the Findings of Fact, Conclusions of Law and Final Order as presented and to authorize the Chair to sign the Order on behalf of the Board.The motion was seconded by Mr. Pinther, motion carried.

 

CON-2009-42 A motion was made by Ms. Prather to enter an Order of Default.The motion was seconded by Mr. Pinther, motion carried.

 

A motion was made by Ms. Prather to accept the Findings of Fact, Conclusions of Law and Final Order as presented and to authorize the Chair to sign the Order on behalf of the Board.The motion was seconded by Mr. Elliott, motion carried.

 

Ms. Magnelli discussed with the Board a court decision that she would like to address with the Board further in regard to the requirement that a temporary staffing agency be registered.Mr. Pinther suggested that Ms. Anderson utilize NASCLAís Q & A site, to see how other states have handled temporary agencies, and compliance with that stateís license/registration requirements.

 

A motion was also made by Ms. Prather authorizing Mr. Klein to sign for the default complaint cases that Ms. Magnelli presented to the Board.This motion was seconded by Mr. Elliott, motion carried.

 

A motion was made by Ms. Prather to amend the agenda to disregard the information that was placed under Mr. Kleinís name for discussion.This information was on the agenda in error.Seconded by Mr. Pinther, motion carried.

 

INVESTIGATIVE REPORT

 

Mr. Hotchkiss presented the following cases for Board determination:

 

I-CON-2007-7 C alleges that R is in breach of contract for concrete work on a driveway. INV revealed the work did have some defects and R did not complete the work as agreed upon. INV also revealed numerous other complaints have been filed against R and Rís registration was revoked in a previous disciplinary action. (This complaint was submitted before Rís registration was revoked.) IBOL recommends the Board authorize closure.A motion was made by Ms. Prather to refer this case to the AGís Office.This motion was seconded by Mr. Elliott, motion carried.

 

I-CON-2007-310, I-CON-2007-631,I-CON-2008-1, and I-CON-2009-173 R's failed to provide proof of liability insurance after IBOL received a cancellation notices from Rísí insurance companies, and Rís failed to respond to certified letters from IBOL. Rísí registrations subsequently expired and have not been renewed. IBOL recommends the Board authorize closure.Motion to close this was made by Mr. Elliott.This motion was seconded by Ms. Prather, motion carried.

 

I-CON-2007-318, I-CON-2007-440,I-CON-2007-424, I-CON-2007-449, and I-CON-2008-112 Rís failed to provide proof of liability insurance after IBOL received cancellation notices from Rísí insurance companies. Rís subsequently provided documentation verifying continuous insurance coverage. IBOL recommends the Board authorize closure.Motion to close this was made by Ms. Prather.This motion was seconded by Mr. Elliott, motion carried.

 

I-CON-2007-573 and I-CON-2007-618 C alleged R is practicing contracting without being registered. INV revealed R manufactures cabinets for wholesale and does not provide installation services.IBOL recommends the Board authorize closure.Motion to close this was made by Ms. Prather.This motion was seconded by Mr. Elliott, motion carried.

 

I-CON-2007-642 C alleged R was hired to put in a trench for electrical lines for Cís house and cover the trench back up. C alleged that the power company told R that the power lines had to be buried 30Ē deep, but R buried them only 16Ē deep, and when the power company inspected and found that the power lines were only 16Ē deep, C had to hire another CON because R refuse to fix the problem. INV revealed that R prevailed in a civil action between the parties and that R did not have a contractual agreement with C but only provided services as a favor to C. IBOL recommends the Board authorize closure.Motion to close was made by Ms. Prather.This motion was seconded by Mr. Pinther, motion carried.

 

I-CON-2008-35 C alleges R failed to complete a sprinkler project properly. INV revealed that C could not provide any detailed information or documentation indicating improper repair of the system. INV did not reveal any evidence to support the allegation or violation. IBOL recommends the Board authorize closure.Motion to close was made by Ms. Prather.This motion was seconded by Mr. Pinther, motion carried.

 

I-CON-2008-298 C alleges R was contracted to build Cís house and was fired at the end of the project. C alleges there were only minor things left to complete, so C hired another CON to finish. After C moved in cracks started to show up, doors are uneven and nails are popping out of walls. INV showed that construction and completion of Cís home was done prior to the Registration Act. IBOL recommends the Board authorize closure.Motion to close and send a letter to C apologizing for the Boardís inability to pursue this complaint due to the time the incident occurred was made by Ms. Prather.This motion was seconded by Mr. Pinther, motion carried.

 

I-CON-2008-323 C alleges R was contracted to install hardy plank siding, all around trim, and caulking as necessary, and to replace the old roof with a new metal roof. C alleges that Rís work did not pass the first or a second inspection, that R refused to correct any of the problems, such as roof leaks in several areas, and that R filed a lien on Cís house. INV revealed Rís work initially did not pass inspection but a subsequent inspection of the roof did pass, and R removed the lien. IBOL recommends the Board authorize closure.Motion to close was made by Ms. Prather.This motion was seconded by Mr. Pinther, motion carried.

 

I-CON-2008-324 C alleges R built a storage structure without a building permit and the structure does not meet building codes requirements or the county set back requirements. INV revealed that the homeowner was the general contractor and was the responsible party who should have obtained the building permit. The county issued a cease and desist order, the owner paid a penalty and subsequently obtained proper permitting. No evidence was obtained to show that R committed any violation. IBOL recommends the Board authorize closure.Motion to close was made by Mr. Pinther.This motion was seconded by Ms. Prather, motion carried.

 

I-CON-2008-348 C alleges R falsified the registration application by using an address at which R has never lived nor had a place of business. INV did not reveal any evidence to support the allegation. IBOL recommends the Board authorize closure.Motion to close was made by Mr. Pinther.This motion was seconded by Ms. Prather, motion carried.

 

I-CON-2009-20 C alleges R was hired to roof Cís house and R failed to use the proper flashing on a section of the new roof. INV revealed that the work on Cís home was done prior to the Registration Act. IBOL recommends the Board authorize closure.Motion to close and send a letter to C apologizing for the Boardís inability to pursue this complaint due to the time the incident occurred was made by Mr. Pinther.This motion was seconded by Ms. Prather, motion carried.

 

I-CON-2009-23 and I-CON-2009-34 C alleges R was hired to build a shop but was not registered as a CON when the job started. C alleges that R did not pull any permits, and the workmanship was so poor the building will have to be completely redone. INV revealed R was practicing CON prior to being registered. Rís registration and renewal rights were recently revoked by the Board in a previous case. IBOL recommends the Board authorize closure.A motion was made by Mr. Pinther to refer this case to the AGís Office.This motion was seconded by Ms. Prather, motion carried.

 

I-CON-2009-51 C alleges R was hired to extend Cís back porch by 4 feet, move the front porch, and pressure clean and paint. C stated R will not come back to complete the job. In a recent case, R voluntarily surrendered his registration and the Board revoked Rís registration. IBOL recommends the Board authorize closure.A motion was made by Mr. Pinther to refer this case to the AGís Office.This motion was seconded by Ms. Prather, motion carried.

 

I-CON-2009-72 C alleges R was hired to finish half of Cís basement. C stated that the wiring R completed was incorrect and a hazard and that R was not licensed to do electrical work. C stated that R had an electrician redo the work but R failed to pay the electrician and there was no permit obtained for the electrical work. C also stated that R performed the plumbing work and was not licensed to do so, that there are issues with the plumbing that need to be corrected, and that the permit for the plumbing was not obtained. C stated that R has also failed to pay the sheetrock installers and refuses to come back and finish the job. In a recent case, R voluntarily surrendered his registration and the Board revoked Rís registration. IBOL recommends the Board authorize closure.A motion was made by Mr. Pinther to refer this case to the AGís Office.This motion was seconded by Ms. Prather, motion carried.

 

I-CON-2009-92 C alleges R did not complete the job per the contract and there was very poor workmanship. INV revealed this was a money dispute and all the workmanship issues were completed and repaired. IBOL recommends the Board authorize closure.A motion to close was made by Ms. Prather.This motion was seconded by Mr. Elliott.

 

I-CON-2009-140 C alleges R was contracted and paid in full to build a barn. C stated that R ordered and received the lumber, built the frame, and stopped for the winter. C stated that R filed for bankruptcy shortly thereafter and did not pay for the lumber that was delivered to Cís property. The supplier placed a lien on the Cís property. Rís registration was revoked in a previous disciplinary action. IBOL recommends the Board authorize closure.A motion was made by Ms. Prather to refer this case to the AGís Office.This motion was seconded by Mr. Elliott, motion carried.

 

I-CON-2009-141 C alleges R was hired to do some excavation. C stated R was not doing it correctly and when C spoke to R about the problems, R quit and did not come back. R then filed alien on Cís property. INV revealed the dispute is solely over money and there appeared to be a breakdown in communication between parties. INV also revealed that there were no problems until R started to request payments for work order changes and adding additional costs for interest. IBOL recommends the Board authorize closure.A motion to close was made by Mr. Elliott.This motion was seconded by Ms. Prather.

 

I-CON-2009-145 Review of another case revealed that R may have provided substandard concrete work and may have filed an inappropriate lien. INV revealed that R was not given the opportunity to provide a remedy and the problems arose from the general contractor. IBOL recommends the Board authorize closure.Motion to close was made by Ms. Prather.This motion was seconded by Mr. Elliott.

 

I-CON-2009-160 C alleges R was hired for excavation of footings and fine grading for concrete placement. C also stated R was to grade out the floor and driveway for concrete and C states that it was incomplete and not suitable for concrete. C was later billed by Rand the supplier. INV revealed that the C/homeowner acted as the general contractor of the project, and that a civil action found in favor of R and ordered C to pay the amount due and owing to R. IBOL recommends the Board authorize closure.Motion to close was made by Ms. Prather.This motion was seconded by Mr. Pinther, motion carried.

 

I-CON-2009-165 C alleges R was hired to build a barn, that Rís registration was expired when R took the job, and that R was paid but R could not complete the job because R ran out of money. C stated that R also failed to pay a supplier. INV revealed the allegations were substantiated. R signed a voluntary surrender of registration in another case, and the Board revoked Rís registration. IBOL recommends the Board authorize closure.A motion was made by Mr. Pinther to refer this case to the AGís Office.This motion was seconded by Ms. Prather, motion carried.

 

I-CON-2009-177 C alleges R was contracted to build the Cís house and that R failed to correctly install some large windows and now the windows do not latch or seal properly. C stated that there are many other problems that R failed to correct. INV revealed the house price was reduced to offset the cosmetic issues, that R fixed numerous issues within the one-year warranty, and that C was satisfied at the end of the one-year period. IBOL recommends the Board authorize closure.Motion to close was made by Ms. Prather.This motion was seconded by Mr. Elliott.

 

I-CON-2009-179 C alleges R is practicing CON without being registered and has employees without workersí compensation. INV revealed no evidence to support the allegations or a violation. IBOL recommends the Board authorize closure.Motion to close was made by Ms. Prather.This motion was seconded by Mr. Pinther.

 

I-CON-2009-187 C alleges R was hired to remodel Cís property. C stated that R will not provide C with a final disclosure. INV revealed R was not familiar with the disclosure laws, and C informed the investigator that everything has been worked out and C is satisfied. IBOL recommends the Board authorize closure.Motion to close was made by Ms. Prather.This motion was seconded by Mr. Elliott.

 

I-CON-2009-193 C alleges that R failed to provide proof of liability insurance after receiving cancellation notice from insurance company. IBOL subsequently received notification from R to cancel Rís registration. IBOL recommends the Board authorize closure.Motion to close was made by Mr. Pinther.This motion was seconded by Mr. Elliott.

 

I-CON-2009-204 C alleges R is practicing as a CON without being registered. C also stated R has been accessed fines for improper advertising in another state. INV revealed no evidence to show the R had worked as a CON in Idaho. IBOL recommends the Board authorize closure.Motion to close was made by Mr. Pinther.This motion was seconded by Mr. Elliott.

 

NEW BUSINESS

 

Ms. Cory, Ms. Hall, and the Board members discussed annual goals for the Board and Bureau.The Board made a suggestion to correct the tab on the Disciplinary Action link on the website to read ďsearch accomplishedĒ.

 

It was also discussed to create a link for a contracting business to set themselves up to receive e-mails for any of their contractors/sub-contractors.

 

The Board inquired with the Bureau how fines/fees once issued are recovered.Ms. Cory informed the Board that Ms. Peel has a contract with a collection agency.Ms. Peel let Board know she has already been receiving payments from the collection agency.

 

It was also determined that the Board would remain involved with NASCLA.

 

Mr. Pinther gave his NASCLA updates from the annual meeting.Ms. Anderson also gave her feedback, stating that the meeting was very informative, and being involved with NASCLA will benefit the Board now as well as in the future.

 

Mr. Pinther submitted to the Board for their review information on the The National Construction Investigators Association.He requested that the chief investigator and all the investigators be allowed to join.It was determined that for right now the chief investigator would be the only person to join to determine if this organization would assist the investigators with their job.A motion was made by Mr. Elliott to authorize the chief investigator to join, and for the Board to pay the $30 annual fee.Seconded by Ms. Prather, motion carried.

 

The Investigative unit will be meeting at the Bureau on October 28th and the 29th.The Board requested that the two local board members, Ms. Prather and or Mr. Nemec, attend this meeting so that the Board and the Investigators can touch base with one another.

 

EXECUTIVE SESSION

 

A motion was made by Mr. Elliott that the Board go into executive session under Idaho Code ß 67-2345(1) (d) to consider records that are exempt from disclosure under the Idaho Public Records Law.  The purpose of the Executive Session was to consider registration application materials.  Motion was seconded by Mr. Pinther, motion carried.The vote was: Mr. Elliott, aye; Ms. Prather, aye; Mr. Pinther, aye; and Mr. Hughes, aye.
