Meeting was called to order at 10:00 AM MDT by Art Elliott.

 

DISCUSSION

 

In a past meeting Mr. Hughes had inquired with Ms. Cory what percentage the contractor cases were to the whole percentage of investigative files.  Ms. Cory gave this information to the Board.

 

DISCIPLINARY


The Board, together with legal counsel, Mr. Stoll, reviewed, discussed, and determined terms for discipline in the following cases:  CON-2007-76, CON-2008-28, CON-2008-16, CON-2008-44, and CON-2008-47.

After full discussion of each case, the following motions were made:

Case No. CON-2007-76:  Moved by Mr. Nemec that the Board adopt the Hearing Officer’s Findings of Fact and Conclusions of Law.  Registration RCE-15691 issued to JT Enterprises was revoked.  Respondent will be required to pay the maximum fine and the costs and attorney fees.  Seconded by Mr. Hughes, motion carried. 

Case No. CON-2008-28:  Moved by Mr. Nemec that the Board adopt the Hearing Officer’s Findings of Fact and Conclusions of Law and registration RCT-5605 issued to Terry Patraw be revoked.  Respondent will be required to pay a maximum fine and the costs and attorney fees.  Seconded by Mr. Hughes, motion carried. 

Case No. CON-2008-16:  Moved by Mr. Nemec that the Board adopt the Hearing Officer’s Findings of Fact and Conclusions of Law and registration RCT-17961 issued to Michael A. Stella be revoked.  Respondent will be required to pay a maximum fine and the costs and attorney fees.  Seconded by Mr. Hughes, motion carried. 

Case No. CON-2008-44:  Moved by Mr. Nemec that the Board adopt the Hearing Officer’s Findings of Fact and Conclusions of Law and registration RCE-1468 issued to Drywall Systems be revoked.  Respondent will be required to pay a maximum fine and the costs and attorney fees.  Seconded by Mr. Pinther, motion carried. 

Case No. CON-2008-47:  Moved by Mr. Nemec that the Board adopt the Hearing Officer’s Findings of Fact and Conclusions of Law and registration RCE-10890 issued to All Around Construction be revoked.  Respondent will be required to pay a maximum fine and the costs and attorney fees.  Seconded by Mr. Pinther, motion carried. 

At the end of these decisions, discussion was started by the Board in regard to the reinstatement fee for un-renewed or expired registration numbers.  Mr. Elliott asked that Ms. Anderson place this on the to do list for future discussion.

EXECUTIVE SESSION

Motion was made by Mr. Pinther to enter into executive session to discuss applications and matters not subject to public disclosure, per Idaho Code 67-2345 (1) (d).  Motion was seconded by Mr. Nemec, motion carried.  Individual votes for this motion were: Mr. Nemec, aye; Mr. Pinther, aye; Mr. Hughes, aye; and Mr. Elliott, aye.

 

Motion was made by Mr. Pinther to go out of executive session.  Motion was seconded by Mr. Nemec, motion carried.  Individual votes for this motion were: Mr. Pinther, aye; Mr. Nemec, aye; Mr. Hughes, aye; and Mr. Elliott, aye.

Motion was made by Mr. Hughes to table the following applications from approval for further information.  Motion was seconded by Mr. Pinther, motion carried.

Mr. Stoll revisited application #901103689 with the Board which had been approved at the 10/15/08 board meeting, and it was determined that the registration be issued with a request letter to be sent asking for owner full names so that this information may be put in the file. 

 

Mr. Stoll revisited application #901103293 with the Board which had been approved at the 10/13/08 board meeting, and it was determined that this registration would be issued with no stipulations to the approval.

 

DISCUSSION

 

Motion was made to approve a board member’s car expense while at the NASCLA conference in Alabama by Mr. Hughes.  Motion seconded by Mr. Nemec, motion carried.

 

Motion was made by Mr. Nemec to accept Ms. Anderson’s suggestions to the Construction Type list that is included with applications.  The change would include a reference to the Division of Building Safety’s licenses.  Motion seconded by Mr. Pinther, motion carried.

 

The Board members inquired with Mr. Hetrick why the public can not see a registration number that has been canceled or put out of business at the request of the registrant.  All registrations that are not current but are reinstateable do currently show on the website as non-current.
