MEMORANDUM

                SUBJECT:         Complaint Investigation Report   

 

    FY2006: To date forty (40) complaints have been received.  Of those, thirty-three (33) remain under investigation; three (3) have been referred for disciplinary review; and four (4) await Board determination.

Complaint issues are as follows:

Unregistered practice - 12
Competency - 3
Failure to complete construction - 7
Contract issue - 4
Failure to deliver - 10
Fraud - 4

For Board determination:

CON-P4A-2-2006-3            C alleged that R will not complete warranty work on home . INV revealed that all activity took place prior to the registration act. C's were advised of other alternatives that could be pursued. R advised that the issue was a manufacturer's problem and that company is no longer in business. INV also revealed that R has now developed a warranty and insurance program for the new work being done. INV did not reveal evidence to support the allegations or a violation. IBOL recommends the Board authorize closure.

CON-P4A-2-2006-8            C alleged that R was hired to enclose a patio and was paid in full. C & R agreed that R would return to property to fix any leaks. C has made several attempts to contact R but has been unsuccessful. INV revealed that activity took place prior to registration act & is beyond the Board's jurisdiction. IBOL recommends the Board authorize closure with notification of other alternatives for possible resolution.

CON-P1-2-2006-10            C alleged that R is being issued permits without the benefit of being registered, and performing jobs without permits. INV revealed that R was working on projects that were below the cost threshold requiring registration. R advised that several larger projects were on hold until registration could be obtained. Bureau records confirmed that R has obtained registration. INV did not reveal evidence of a violation. IBOL recommends the Board authorize closure.

CON-P1-4-2006-16            C alleged that R is not registered and is hiring unregistered contractors and subcontracting them out to general contractors. A search of IBOL records indicates that R is not registered. INV revealed that R is a building supply company and that R maintains a list of contractors they sell supplies to. R admitted to providing that list to those who request a referral. INV did not reveal evidence to show that R employs contractors or has any other control or direction over contractors. No evidence was revealed to support the allegations or violations. IBOL recommends the Board authorize closure.
