LEGEND OR PRESCRIPTIVE DRUGS
Dr. Gaertner-Ewing and Mr. Hales discussed the history of the Board’s meetings with the Board of Medicine and Board of Pharmacy associated with legend or prescriptive drugs as referenced in Idaho Code 54-704.
Dr. Nelson moved that since the Chiropractor Physicians Act’s adoption in approximately 1980, it has been the Board’s intent that a chiropractic physician should be able to administer clinical nutritional substances in any form. However Federal Law changed in approximately 1994 to reclassify certain nutritional substances as legend or prescriptive drugs which may conflict with the Board’s intent. It is the Board’s desire to take reasonable steps to resolve such potential conflict. Seconded by Dr. Anderson, motion carried.
The Board discussed appointing a sub-committee to work with the Idaho Chiropractic Physicians Association on changing the law. It was moved by Dr. Nelson that the Board appoint a sub-committee of Dr. Haug and himself to work with the Idaho Chiropractic Physicians Association and Medical and Pharmacy Boards to clarify the language in the statue regarding the use of nutritional methods in all forms and bring recommendations to the Board. Seconded by Dr. Haug, motion carried.
The Board reviewed an e-mail question from Jennifer Kroon from Blue Cross of Idaho regarding whether a chiropractor can order, fabricate and dispense spinal orthotics for patients. It was moved by Dr. Nelson that Dr. Gaertner-Ewing respond to this letter. Seconded by Ms. Schroeder, motion carried.
The Board reviewed an e-mail question from Renae Swaim regarding if a chiropractor can order syringes and needles. It was moved by Dr. Haug to send a letter stating these are not prescriptive items. Seconded by Ms. Schroeder, motion carried.
The Board reviewed an e-mail question from Dr. Travis Cunningham regarding if it is within the scope of practice for chiropractors to provide SpineCor scoliosis braces. The Board will request additional information.
CONTINUING EDUCATION COURSE
The Board reviewed a continuing education course on nutrition for Frances De Melo. It was moved by Dr. Haug to approve the course titled, “Advanced Nutrition Principles, Nutritional Interventions and Nutraceutrical Applications in Clinical Practice” for twelve hours. Seconded by Dr. Nelson, motion carried.
It was moved by Dr. Nelson to adjourn the meeting at 2:00 PM MDT. Seconded by Dr. Haug, motion carried.
