Meeting was called to order at 12:35 p.m. MDT by Shannon Gaertner-Ewing, D.C..

 

 

DISCIPLINARY MATTER

 

The Board along with Legal Counsel, Mr. Hales, reviewed Dr. Grothmanís request for reinstatement of his Idaho Chiropractic License, Case No. CHI-2007-12.

 

Let the record reflect Dr. Gaertner-Ewingís recusal.However, for purposes of conducting the meeting Dr. Gaertner-Ewing will conduct the meeting without any voting or discussion privileges.

 

EXECUTIVE SESSION

 

It was moved by Dr. Nelson that the Board enter executive session to discuss with legal counsel the reinstatement of a license of an individual under Idaho Code 67-2345(1)(f) and further on the basis that the documents being considered are exempt from public disclosure per Idaho Code 67-2345 (1)(d).  Seconded by Dr. Haug, motion carried. Individual votes for this motion were: Dr. Anderson, aye; Dr. Nelson, aye; Dr. Haug, aye; and Ms. Schroeder, aye.

 

It was moved by Dr. Anderson that the Board come out of executive session.Seconded by Ms. Schroeder, motion carried. Individual votes for this motion were: Dr. Anderson, aye; Dr. Nelson, aye; Dr. Haug, aye; and Ms. Schroeder, aye.

 

After a full discussion and consideration of Dr. Grothmanís request, the following motion was made:

 

Motion was made by Dr. Anderson to reinstate Dr. Grothmanís license and place Dr. Grothman on a one year probationary period.During the course of the one year probationary period Dr. Grothman must adhere to the laws and rules governing the practice of chiropractic in the State of Idaho and at any time, the Board may also, upon request, audit and inspect any files of Dr. Grothman.Seconded by Dr. Nelson, motion carried.

Moved by Dr. Anderson to enter executive session for the review of an application exempt from public disclosure per Idaho Code 67-2345(1)(d). Seconded by Dr. Nelson, motion carried. Individual votes for this motion were: Dr. Anderson, aye; Dr. Nelson, aye; Dr. Haug, aye; and Ms. Schroeder, aye.

 

Moved by Dr. Haug that the Board enter regular session. Seconded by Dr. Nelson, motion carried.Individual votes for this motion were: Dr. Anderson, aye; Dr. Nelson, aye; Dr. Haug, aye; and Ms. Schroeder, aye.

 

APPLICATION

 

Moved by Dr. Haug that the Board approve the application and issue a license to Dr. Helen Silkman. Seconded by Dr. Nelson, motion carried.

 

CORRESPONDENCE

 

The Board reviewed a letter from chiropractor 901057318 requesting an extension for completing the continuing education requirements for the renewal of their license because of a medical hardship. Moved by Dr. Haug that the Board directs the Bureau to draft a letter for Mr. Hales to review, to be sent to the chiropractor stating the laws and rules do not allow for waiver or extensions of the continuing education requirements. The chiropractor will be required to pay the reinstatement fee and complete the eighteen hours of continuing education in order to reinstate their license. Seconded by Dr. Anderson, motion carried.

 

The Board discussed and reviewed the laws and rules with legal counsel regarding an out of state chiropractor using a juvenile to adjust in continuing education training. There is no provision in the laws or rules that allow practicing chiropractic without a license.
