Conference Call Meeting Minutes of February 8, 2006

Chairman Dr. Mayo called the meeting to order at 12:38 p.m.
The Board reviewed the November 30, 2005 and January 25, 2006 minutes. Moved by Dr. Moldenhauer to approve the November 30, 2005 and January 25, 2006 minutes. Seconded by Dr. Gaertner-Ewing, motion carried.
Ms. Jacobsen reported that the chiropractic rules were submitted to Legislation and that they were accepted by both houses. There is pending legislation regarding Licensed Physical Therapists moving from the Board of Medicine to the Bureau of Occupational Licenses.
Ms. Jacobsen presented the financial report indicating a cash balance of $99,694.37 with $32,432.00 remaining in the budget. The Board is in good shape financially. Moved by Mr. Shiosaki to accept the financial report. Seconded by Dr. Moldenhauer, motion carried.
Mr. Hetrick presented the investigative report indicating that five (5) complaints have been received for fiscal year 2006. One (1) has been closed and three (3) remain under investigation and one (1) awaits Board determination. Seventeen (17) complaints were received for fiscal year 2005. Four (4) have been closed and one (1) awaits Board determination. Twenty-two (22) complaints were received for fiscal year 2004. Eleven (11) have been closed and five (5) were referred for administrative action and six (6) remain under investigation or pro-review.
The Board reviewed complaint case CHI-L2-2-06-2. Moved by Dr. Gaertner-Ewing to accept the Bureauís recommendation and close case CHI-L2-2-06-2. Seconded by Mr. Shiosaki, motion carried.
Mr. Hetrick presented the Board information on case CHI-B6C-4-05-3. This case involved meeting the continuing education requirement for the renewing of their license. Moved by Mr. Shiosaki to authorize Dr. Gaertner-Ewing to review the continuing education course with the authority to approve or reject. Seconded by Dr. Dutson, motion carried.
Mr. Hales presented a letter to the Board, from a chiropractor that was previously disciplined by the Board regarding an advertisement issue. The chiropractor is requesting reinstatement of their license. The chiropractor has met all the requirements stipulated in the consent order. Moved by Dr. Moldenhauer that the chiropractorís license be reinstated. Seconded by Dr. Gaertner-Ewing, motion carried.
Mr. Hales reported that the correspondence the Board directed him to write from the previous board meeting was answered as directed.
The Board discussed Peer Review and that Rule 600.04.a, states that the Peer Review Committee must utilize the Reference Guide, 5th Edition, Robert E. Olson, D.C. in conducting a review. The 6th Edition is now available and therefore, is more accessible. The Board has purchased 12 copies of the 5th Edition and these will be distributed to the 2006 Peer Review Committee. The members of the 2006 Peer Review Committee will be asked to return the manuals back to the Bureau once they are no longer on the Peer Review Committee. The Board requested that Dr. Gaertner-Ewing review a copy of the 6th Edition and compare it to the 5th Edition and bring a recommendation to the next board meeting. Moved by Dr. Gaertner-Ewing that the Board purchase a copy of the 6th Edition of the Reference Guide. Seconded by Mr. Shiosaki, motion carried.
The Board discussed a news release from the Inspector General, which reported that there are problems with chiropractors not being in compliant with Medicare requirements for adequate documentation of record keeping. The Board discussed possibly requiring continuing education or may approach the Association in providing training in this area. The issue of adequate documentation has been discussed at previous board meetings and the Bureau will search for this information and provide it for the next board meeting.
The Board reviewed the NBCE correspondence requesting that two board members participate as examiners in the administration of the Part IV Exam and attend the June Part IV Test Committee Meeting. Moved by Dr. Gaertner-Ewing that the Board allow Dr. Moldenhauer and Dr. Dutson to participate as examiners in the administration of the Part IV Exam and Dr. Dutson to attend the Part IV Test Committee Meeting. Seconded by Jun Shiosaki, motion carried.
The Board reviewed correspondence from a chiropractor requesting information on using multiple fee schedules. The chiropractor laws and rules do not address the fee schedule. Mr. Hales will research this issue and bring a report back to the next meeting. Moved by Dr. Moldenhauer that the Board direct Mr. Hales to respond to the chiropractorís question on the fee schedule. Seconded by Dr. Gaertner-Ewing, motion carried.
The Board reviewed correspondence from an individual regarding the use of injectables in the practice of chiropractic. The Board indicated that chiropractors are allowed to draw blood for testing purposes. This issue regarding injectables has been discussed at previous board meetings. Mr. Hales will do research regarding the use of medical devices and research previous board meeting minutes that address the use of injectables and bring his report to the next board meeting.
CONTINUING EDUCATION COURSES
The Board reviewed a request from Dr. Dutson, to have a continuing education course approved that will be taught at the IACP convention in April 2006. Dr. Dutson recused himself from discussion on this issue. Moved by Dr. Gaertner-Ewing that the Board approve this course for 6 hours as requested. Seconded by Mr. Shiosaki, motion carried.
The Board reviewed a request from Paul Powers, D.C. requesting to have a distance learning course from the University Of Bridgeport College Of Chiropractic approved for continuing education credit. The Board directed the Bureau to respond to this request as denied based upon Rule 350.03., which requires the actual physical attendance of the applicant in a face-to-face setting with the course instructor.
The Board reviewed a request from the IACP 2006 convention requesting approval of continuing education presented by Dr. James Cox. Moved by Dr. Dutson to approve the course for 12 hours. Seconded by Mr. Shiosaki, motion carried. Dr. Gaertner-Ewing recused herself from discussion. The Board asked that the approval letter include a copy of Rule 350.04, which outlines the requirements for making request for approval of continuing education.
The Board discussed applications for the 2006 Peer Review Committee. Moved by Mr. Shiosaki that the Board wait to make a decision on an application until a later time. Seconded by Dr. Moldenhauer, motion carried.
CONTINUING EDUCATION AUDIT
The Board reviewed continuing education courses for audited licensed chiropractors. Moved by Dr. Gaertner-Ewing to accept the continuing education for these 12 chiropractors as being complete. Seconded by Dr. Moldenhauer, motion carried.
The Board discussed the date for the next board meeting. Moved by Dr. Gaertner-Ewing that the Board schedule the next meeting at the Bureau for May 31, 2006 at 9:00 a.m. Seconded by Mr. Shiosaki, motion carried.
It was moved and seconded to adjourn the meeting at 2:25 p.m.
