Regular Meeting Minutes of September 28, 2005

Chairman Dr. Mayo called the meeting to order at 9:00 a.m.

MINUTES

The minutes from the June 29, 2005 conference call meeting was reviewed.  Moved by Dr. Moldenhauer to approve the June 29, 2005 minutes with spelling error corrected.  Seconded by Dr. Gaertner-Ewing, motion carried.

The minutes from the August 11, 2005 conference call meeting was reviewed.  Moved by Dr. Gaertner-Ewing to approve the August 11, 2005 minutes with spelling error corrected.  Seconded by Mr. Shiosaki, motion carried.

The minutes from the August 18, 2005 conference call meeting was reviewed.  Moved by Dr. Gaertner-Ewing to approve the August 18, 2005 minutes.  Seconded by Dr. Moldenhauer, motion carried.

Ms. Jacobsen gave an update on the 4 new boards and their progress.  The naturopathic board members have not been appointed by the Governor at this time.  The office space has been remodeled and new staff has been hired.  All rules have been submitted and ready to be presented for the 2006 Legislation.

FINANCIAL REPORT

Mr. Hetrick presented the financial report indicating a cash balance of $95,045.42 and with $47,149.15 left in appropriations.  This board is in good shape financially.


INVESTIGATIVE REPORT

Mr. Hetrick presented the investigative report which indicates that two new complaints have been received for fiscal year 2006 and are under investigation.  Seventeen complaints have been received for fiscal year 2005 and thirteen are under investigation: one was referred for administrative action; and three await Board determination.  Twenty-two complaints were received for fiscal year 2004.  Of those, ten have been closed; five were referred for administrative action; six remain under investigation or pro-review; and one awaits Board determination.

The Board reviewed case CHI-P5-2-2005-14.  Moved by Dr. Moldenhauer to accept the Bureauís recommendation to authorize closure for complaint case CHI-P5-2-2005-14.  Seconded by Dr. Gaertner-Ewing, motion carried.

The Board reviewed case CHI-P3C-1-2005-13.  Moved by Dr. Gaertner-Ewing to accept the Bureauís recommendation to authorize closure for complaint case CHI-P3C-1-2005-13.  Seconded by Dr. Dutson, motion carried.

The Board reviewed case CHI-P4A-2-2005-7.  Moved by Mr. Shiosaki to accept the Bureauís recommendation to authorize closure for complaint case CHI-P4A-2-2005-7.  Seconded by Dr. Gaertner-Ewing, motion carried.

The Board reviewed case CHI-P4B-2-2004-15.  Moved by Dr. Moldenhauer to send a letter to respondent requesting copies of any records and x-rays with the notation that non-compliance is grounds for disciplinary action.  Seconded by Mr. Shiosaki, motion carried.

CRITERIA QUALITY FOR CONTINUING EDUCATION

The Board reviewed information from the Federation of Chiropractic Licensing Boards regarding the Providers of Approved Continuing Education (PACE) Program.  Moved by Dr. Gaertner-Ewing to accept any continuing education course approved by the PACE Program to qualify for the required continuing education.  Seconded by Dr. Dutson, motion carried.

CORRESPONDENCE

The Board reviewed a letter requesting information on the use of Pulse Light as part of the scope of practice for Chiropractors.  After discussion it was determined that this practice is a surgical procedure.  Moved by Dr. Moldenhauer to send a letter that the use of Pulse Light is not within the scope of practice for Chiropractors.  Seconded by Mr. Shiosaki, motion carried.

The Board received a letter from a licensee requesting an extension of continuing education requirements because of health reasons.  The continuing education rules do not allow for the waiver of continuing education.  The Board suggests that the chiropractor request an inactive license and obtain the continuing education prior to re-activating the license. 

The Board received an application for approval of a continuing education seminar course.  Moved by Dr. Gaertner-Ewing to postpone the review and discussion of this course later in the meeting.  Seconded by Mr. Shiosaki, motion carried.

The Board reviewed and discussed FCLB Power Poll surveys.  The Board directed the Bureau to answer the survey on behalf of the Board.


EXECUTIVE SESSION         

Moved by Dr. Dutson to enter executive session to discuss an applicant file not subject to public disclosure.  Seconded by Ms. Gaertner-Ewing, motion carried.

Moved by Mr. Shiosaki to enter regular session.  Seconded by Dr. Dutson, motion carried.

Moved by Dr. Gaertner-Ewing to deny applicant DCA-1146 for licensure at this time based on the application and statements made.  The Board however, recognizes efforts toward this process and suggests at some time in the future it would be appropriate to apply again.   Seconded by Dr. Dutson, motion carried.

Moved by Dr. Dutson to enter executive session to discuss an applicant file not subject to public disclosure.  Seconded by Mr. Shiosaki, motion carried.

Moved by Dr. Gaertner-Ewing to enter regular session.  Seconded by Dr. Dutson, motion carried.

Moved by Dr. Moldenhauer to grant a license to applicant DCA-1137 with a probation period of (1) one year from completion of the disciplinary requirements established by the Nevada Board of Chiropractic Physicians.  That applicant shall comply with all requirements established by the Nevada Board of Chiropractic Physicians based upon the discipline in that state.  That compliance shall include utilization of the Nevada compliance officer to review your work in Idaho as a chiropractic physician.  That during the term of probation applicants chiropractic records are subject to review by the Idaho Board of Chiropractic Physicians.  Seconded by Mr. Shiosaki, motion carried.

Ms. Jacobsen presented the Board a letter from NBCE regarding hurricane victims.  Special arrangements can be made for chiropractors affected by the hurricanes that need to take any part of the NBCE exam.

The Board reviewed a letter from a chiropractor licensed in another state and wanted to do primary reads of MRI scans.  Moved by Mr. Shiosaki to refer the letter to Roger Hales to draft a letter addressing the Boardís concerns.  Seconded by Dr. Gaertner-Ewing, motion carried.

The Board was informed by the Bureau that Idaho Code 54-706 did not address a vice-chair or secretary for the Board.  Moved by Dr. Gaertner-Ewing that to accommodate the business of the Board and for the purpose of the wall certificates that a vice-chair and secretary be elected.  Seconded by Dr. Moldenhauer, motion carried.

Moved by Mr. Shiosaki that the Board elect Dr. Gaertner-Ewing as secretary.  Seconded by Dr. Moldenhauer, motion carried.

The Board reviewed continuing education audits.  Moved by Dr. Moldenhauer that the Board accept the reinstatement and continuing education for CHI-725-1508 and send a letter advising that in the future better planning will avoid these problems.  Seconded by Dr. Gaertner-Ewing, motion carried.

The Board reviewed continuing education for CHI-73-3239.  Moved by Dr. Gaertner-Ewing that the licensee has 30 days to provide documentation that the course taken is approved by an approved chiropractor college or obtain an additional 12 hours of continuing education.  Seconded by Dr. Dutson, motion carried.

Dr. Moldenhauer will be attending the District FCLB meeting September 29th through October 2, 2005 at Omaha, Nebraska.  Dr. Gaertner-Ewing moved that the Board authorize payment of expenses for Dr. Moldenhauerís attending the District meeting.  Seconded by Mr. Shiosaki, motion carried.

The Board scheduled a conference call meeting for November 30, 2005 at 12:30 p.m.

Moved by Dr. Gaertner-Ewing to approve Dr. Dutson and Dr. Moldenhauer to attend the National Board Part IV exam administration for November 11-13, 2005.  Seconded by Mr. Shiosaki, motion carried.  Expenses are paid by NBCE.

Moved by Dr. Gaertner-Ewing that Dr. Moldenhauer review the continuing education application for approval of seminary and bring back his recommendation to the next meeting.  Seconded by Dr. Dutson, motion carried.

Moved by Dr. Gaertner-Ewing that the meeting adjourn at 12:50 p.m.  Seconded by Mr. Shiosaki, motion carried.
