MINUTES OF March 22, 2001

Meeting was called to order at 9:00 a.m. by Board Chair.

Minutes were reviewed from January 30, 2001 board meeting. Approval was tabled to allow Dr. Sterling time to review them.

Mr. Limbaugh reviewed the financial report with the board. Discussion was held on the costs associated with peer review. Moved by Dr. Sterling that the Board receive a report from Dr. Moldenhauer on a quarterly basis outlining the cases reviewed, pending reviews, revenues and expenditures. Seconded by Dr. West, carried.

Mr. Limbaugh updated the Board on the legislation that was being proposed during this session. He stated that the law dealing with interns was passed by both the Senate and the House, and that the Board should begin working on temporary rules to address the revision in the law. Mr. Limbaugh stated that the proposed law changes dealing with exemption from acupuncture licensure, and the Board’s interpretation of its mandate to provide for the health, safety, and welfare of Idaho citizens by insuring full and equal public access to chiropractic services, were denied by Division of Financial Management.

Moved by Dr. West that Board go into executive session. Seconded by Ms. Averill, carried.

Moved by Dr. West that Board come out of executive session. Seconded by Ms. Averill, carried.

Moved by Dr. Sterling that the Board follow Ms. Wallace’s recommendations on complaint numbers CHI-P3C-04-00-014 and CHI-P1-04-0011. Seconded by Ms. Averill, carried.

Moved by Dr. Harper that Board go into executive session. Seconded by Dr. Sterling, carried.

Moved by Dr. West that Board come out of executive session. Seconded by Ms. Averill, carried.

Dr. Donald Norris, Cigna HealthCare, Medicare Administration, addressed the Board on the issue of Chiropractic care and Medicare.

Moved by Ms. Averill that she contact the LACC to obtain and Quality Assurance Manual for distribution to the Board. Seconded by Dr. Sterling, carried.

Discussion was held on continuing education requirements and the rule changes that may need to be made.

Moved by Dr. Harper that Board go into executive session with Dr. Glenn Moldenhauer.

Seconded by Ms. Averill, carried.

Moved by Ms. Averill that the Board come out of executive session. Seconded by Dr. West, carried.

Moved by Dr. Sterling that letters of complaint be referred to John Kersey for investigation.

Seconded by Ms. Averill, carried.

ELECTION OF OFFICERS

Moved by Dr. Sterling that Dr. West be Chair, Dr. Harper be Vice-Chair, and Ms. Averill be Secretary. Seconded by Dr. Harper, carried.

Break for lunch.

Dr. West called the meeting to order.

Moved by Dr. Harper that any proposed law change to exempt licensed chiropractic physicians from acupuncture licensure should be presented by the association and not the Board, and that a letter to that effect be sent to the association. Seconded by Ms. Averill, carried. Moved by Dr. Harper that a proposed law change dealing with public access to chiropractic care be drafted and presented for the next legislative session. Seconded by Dr. Sterling, carried.

Moved by Dr. Sterling that the Board adopt a temporary rule that would allow the Board discretion to approve continuing education that is not sponsored by a CCE approved college.

Seconded by Dr. Harper, carried. Moved by Dr. Sterling that, based on said temporary rule, the three programs, "Coding and Medicare Solution and Validity", "Magnetic Resonance Imaging" and "Validating Chiropractic" sponsored by the Montana Chiropractic Association, be approved by the Board for continuing education credits. Seconded by Ms. Averill, carried. Moved by Dr.

Harper that the continuing education program sponsored by Idaho Association of Chiropractic Physicians be approved for continuing education credits. Seconded by Dr. Sterling, carried.
