                SUBJECT:         Complaint Investigation Report 


FY2006: To date, five (5) complaints have been received. Of those, one (1) has been closed; three (3) remain under investigation; and one (1) awaits Board determination.

FY 2005: Seventeen (17) complaints were received. Of those, four (4) have been closed; and one (1) awaits Board determination.

FY 2004: Twenty-two (22) complaints were received. Of those,  eleven (11) have been closed;  five (5) were referred for administrative action;  and six (6) remain under investigation or pro-review.   

There is one (1) pending administrative action.

For Board Determination:

CHI-L2-2-06-2                C alleges that R's advertisement is misleading. INV confirmed that a reader Board at R's address contains an advertisement for "Breast Screening without X-rays." R denied responsibility for the sign, noting that the sign belongs to a naturopath who rents an office in the same building. The ad clearly lists that person's phone number under the ad. While the proximity of R's sign and the offending sign may lead to confusion, INV did not reveal evidence to support the allegations or a violation. IBOL recommends the Board authorize closure.
