Minutes of November 21, 2006

 

 

The Idaho State Board of Barber Examiners board meeting was called to order at 9:07 a.m., Tuesday, November 21, 2006 at the Bureau of Occupational Licenses, Owyhee Plaza, 1109 Main Street, Suite 220, Boise, Idaho.

 

Roll Call:          Kevin Moriarty, Chair

                           Gussie O’Connor, Board Member – attendance by phone

 

Bureau Staff:     Rayola Jacobsen, Bureau Chief

                               Budd A. Hetrick, Deputy Bureau Chief

                               Roger J. Hales, Administrative Attorney – attendance by phone

       Marcie McGinty, Investigations Coordinator

 

NEW BUSINESS

 

Moved by Gussie O’Connor to accept the November 6, 2006 minutes as written.  Seconded by Kevin Moriarty, motion carried.

 

Ms. Jacobsen presented the Board / Bureau contract after a full review the Board made the following motion:  Moved by Gussie O’Connor to accept the FY 2007 Board / Bureau contract and to allow Mr. Moriarty to sing the contract on behalf of the Board.  Seconded by Kevin Moriarty, motion carried.

 

FORMAL DISCIPLINARY ACTION

 

Roger Hales presented the disciplinary record in the matter of the license of Scott R. Lusk, License No. B-2464, and Cutting Edge, License No. BS-1646.  Prior to the meeting the Board was given a copy of the full record for their review.  After a full discussion and review of the entire record the Board made its determination for a Final Order.

 

Moved by Gussie O’Connor to adopt the Findings of Fact, Conclusions of Law.  That Mr. Lusk will serve a two (2) year probationary period and will be required to pay the costs and fees acquired in the matter.  The fees shall be paid within ninety (90) days of the Final Order.  Further discipline will be imposed if the terms of the Final Order are not met.  Seconded by Kevin Moriarty, motion carried.

 

Moved by Kevin Moriarty that the meeting be adjourned.  Seconded by Gussie O’Connor, motion carried.
