For Board Determination:

I-ARC-2004-3                      C alleged R possibly altered C's original plans to assist another contractor. INV revealed that R was hired as a consultant for a developer and denied revising the plans in question. INV also revealed that R & witnesses denied that R served in an ARC capacity & no evidence was revealed to support that contention. INV revealed that C's plans were submitted, and changes to those plans were subsequently made without C's authorization.  INV also revealed that C dissolved the relationship with the developer during the project and another ARC was hired to review and revise plans for the project, and those changes were stamped by that licensee.  INV also revealed that the original plans with the revisions cannot be located by the City.  Everyone that could be located that dealt with this project was contacted, but no evidence was produced to indicate who was actually the person responsible for revising the drawings.  INV did not reveal evidence to support the allegations specific to R. File was referred for DAG review.  DAG review concluded no evidence to support the allegation that R was the person who made the revision.  Based on that review, the IBOL recommends  the Board authorize closure.

I-ARC-2007-3                      C alleges that R signed and sealed ARC drawings that were not prepared under his responsible control and is alleged to be aiding and abetting an unlicensed person to practice ARC in the state of Idaho.  INV revealed that the R and the draftsman worked very closely with each other on this project.  Both the R and the Draftsman were completely knowledgeable of each others work.  INV did not reveal evidence to support the allegations.  IBOL recommends the board authorize closure.

I-ARC-2008-1                      Respondent self disclosed on a renewal form of having had received discipline from the ARC State Board in Florida for failure to provide proof of completion of the core curriculum courses or passing the equivalency test of the Building Code Training Program.  Send to DAG for review based on self disclosure. DAG review determined that failure to take a core class in another state jurisdiction is not equal or similar to the CE requirements of Idaho law.  DAG issued a letter thanking R for the honesty provided on the renewal form.  IBOL recommends that the Board authorize closure.

I-ARC-2008-3                      C alleges that R is advertising as an builder/architect in the local paper and on R's website.  IBOL sent R a letter requesting a response.  Response received and R stated that the ad in the paper was a mistake by the paper. Further research of the R website revealed that it has been changed and makes no architect or architectural reference.  IBOL recommends the board authorize closure.

I-ARC-2008-4                      C alleged that R's license is expired and R is still advertising as an Architect.  IBOL sent a certified letter requesting response. R responded noting that license had expired due to not obtaining the required CE. R also noted that an ad was published in error listing Idaho as one of R's licensed states. R maintains that no practice has occurred in Idaho since the license expired, and that as soon as the CE documentation can be obtained, R will reinstate the license.  IBOL recommends the Board authorize closure.

I-ARC-2008-7                      C alleged that R is possibly practicing out side the scope of the their business practice by advertising one of R services is Light Commercial / Tenant Improvement.  Certified response letter sent requesting  response.  R responded stating that its advertising is accurate and they and do provide those services.  If at some point in the process, there is a need for a licensed design professional to calculate or stamp all or any portion of the project then they contract that service out as a agent for their clients.  IBOL recommends the Board authorize closure.
