COMPLAINT INVESTIGATION REPORT

FY-2005: No complaints have been received to date.

FY-2004: Twenty (20) complaints were received. One was closed due to lack of jurisdiction, twelve (12) remain under investigation, and five (5) await Board determination (see below).

Fiscal Year 2003. Six (6) complaints were received. Two (2) have been closed, and four (4) await Board determination (see below). 

Fiscal year 2002. Three (3) complaints were received. One (1) remains under investigation.

ARC-L1-3-03-2                      R alleged to be practicing without benefit of licensure. R alleged to have designed a commercial building that is scheduled for construction. INV revealed that R is unlicensed, had prepared plans for the project, and was being supervised by an Idaho licensed architect. Supervision was through both face-to-face contact, and via email & fax, as R worked from home. The licensee/supervisor confirmed to being the architect of record for the project, of having stamped the plans which were submitted to the local P&Z office, and did have the required direction and control. INV also revealed there was no written contract between the licensee & R, and that the project owner paid each person (licensee & R) separate for their services. According to the licensee work done with R was under a verbal agreement. INV revealed no evidence of a violation of law or rule.
IBOL recommends Board authorize closure. 

ARC-P2A-2-03-4                 R is alleged to have stamped plans prepared by an unlicensed person, and failed to provide appropriate oversight during project construction. C alleged that the building was not built according to blueprints. INV revealed that R was hired by a construction company to provide ARC services for 2 office buildings; that plans were prepared, buildings were built, & occupancy permits were issued. R denies using unlicensed person to prepare plans.  INV did not reveal evidence to support the allegations or show a violation of law or rule.
IBOL recommends the Board authorize closure. 

ARC-L6-3-03-5                      R alleged to have prepared plans without supervision, and that plans were stamped by an Idaho licensed architect. R was in the process of application and had certified no practice in Idaho prior to application. C alleges that R's application is false and has proof that R did prepare plans. When INV requested supporting documents, C admitted being mistaken about the identity of the R.  INV revealed that another individual with a similar first name was involved. No evidence was discovered showing that R had practiced in Idaho prior to licensure.
IBOL recommends Board authorize closure. 

ARC-L4-3-03-6                      R is alleged to have stamped plans prepared by an unlicensed person not under R's supervision. INV revealed that R did prepare the plans for a commercial project. No evidence was discovered that an unlicensed individual prepared the plans. When contacted by an investigator C admitted to being mistaken about the identity of the unlicensed person.
IBOL recommends Board authorize closure.

ARC-P4-4-04-2                      C alleged that R allowed an untrained & unsupervised person to prepare plans, that R then stamped as self-prepared work. During the course of INV C withdrew the complaint due to the conditions of a settlement agreement in a civil matter. The settlement is sealed and the parties are prohibited from disclosure.
IBOL recommends the Board authorize closure. 

ARC-L2-2-04-6                      C alleged that R advertised in the yellow pages as an architect. INV revealed that the owners of the company purchased a listing under the "Architects" heading, with the phrase "see our ad under home designing & planning." R advised that only homes of 2 stories or less are designed without the aid of licensed architects and engineers; they do not advertise themselves as architects; and they are well aware of the laws. R apologized for any misunderstanding or confusion. INV confirmed there are no yellow page listings or ads for R in the current directory.
IBOL recommends the Board authorize closure.

ARC-L2-2-04-7                                  C alleged that R advertised in the yellow pages as an architect. INV revealed that R did not authorize a listing under the heading architects. R has only purchased ads for Building designers and only prepares structures 2 stories or less and residential only.  The evidence confirmed that the directory was responsible for the listing.  INV did not reveal evidence of a violation.
IBOL recommends Board authorize closure w/o action. 

ARC-L2-2-04-8                                  C alleged that R advertised in the yellow pages as an architect. INV revealed that R did not authorize a listing under the heading architects. R maintains only purchasing ads as a building designer and only designs residential structures 2 stories or less.  The evidence confirmed that the directory was responsible for the listing.  INV did not reveal evidence of a violation.
IBOL recommends Board authorize closure. 

ARC-L3-1-04-18                    C alleged that R had responsibility over a watershed project and that Rs negligence resulted in ecological damage. IBOL records confirmed that R's license was canceled prior to the incident. INV confirmed that a LAR prepared and stamped all plans for project. Though no permit was ever issued, the owner proceeded to remove materials from a riverbed, in violation of federal requirements. INV reveals that R was a middleman in the project and was not practicing as either an ARC or LAR. No evidence was revealed to support the allegations or a violation.
IBOL recommends Board authorize closure.
