Robert Payne called the
meeting to order at 9:05 a.m.
MINUTES
Cheryl Jurgens moved to
approve the February 26, 2004 conference call minutes including corrections to
Rhonda Murray’s name. Vicki
Powers seconded and the motion carried.
Cheryl Jurgens moved to
approve the January 16, 2004 conference call minutes.
Vicki Powers seconded and the motion carried.
The December 1, 2003 minutes
were reviewed and the Board amended the minutes by striking out the sentence
that states the Clinical Society is no longer active.
Rhonda Murray moved to approve the December 1, 2003 board meeting
minutes with amendment. Vicki
Powers seconded and the motion carried.
LEGISLATION
Ms. Jacobson gave a report
on the 2004 Legislation. The new
law added the public board member and the rules also passed.
There was only one bill that did not pass and it was a Bureau Bill
regarding subpoena power.
EXECUTIVE SESSION
Cheryl Jurgens moved to
enter executive session to discuss litigation not subject to public
disclosure. Rhonda Murray
seconded and the motion carried.
Rhonda Murray moved to enter
regular session. Vicki Powers
seconded and the motion carried.
Rhonda Murray moved to
accept the consent agreement for SWO-2004-5. Vicki Powers seconded and the motion carried.
Cheryl Jurgens moved to
accept the stipulation for SWO-2003-4 conditioned upon subsection 2e providing
that respondent shall successfully complete all of the required continuing
education and ethics courses during the period of their revocation and provide
proof to the Board upon making application for reinstatement of their license.
Rhonda Murray seconded and the motion carried.
Cheryl Jurgens moved to
enter a final order for SWO-2004-4 incorporating the findings of fact and
conclusions of law in recommended order of the Hearing Officer and discipline
this licensee to the revocation of the license and repayment of cost for the
investigation and prosecution. Vicki
Powers seconded and the motion carried.
The Board reviewed cases
SWO-S1C-04-02-87 and SWO-2004-7. Rhonda
Murray moved that Board direct the prosecutor to negotiate a stipulation in
case SWO- S1C-04-02-87 pertaining the following terms:
1. Respondent be placed on
probation for two years. 2.
That the licensee obtains a full drug and alcohol evaluation and that
the licensee further complies with all treatment that may be prescribed by the
evaluator. 3. That the licensee submits proof and documentation of
compliance of treatment requirements. 4.
That the licensee pays investigative cost.
Vicki Powers seconded and the motion carried.
Vicki Powers moved that the
Board direct the prosecutor to negotiate a consent agreement whereby the
license be revoked in case SWO-2004-6 and that respondent repay the costs of
investigation and prosecution. Rhonda
Murray seconded and the motion carried.
The Board reviewed the
Petition For Consideration for SWO-2004-2.
Cheryl Jurgens moved that the Board waive the $1,000 fine in the final
order. Rhonda Murray seconded and
the motion carried.
Linda Burch addressed the
frustrations of a social worker regarding the time required to resolve a
complaint.
NASW sent a letter to the
Governor’s office regarding Robert Payne’s Board Term ending June 30, 2004
and asked the Governor to reappoint him for another term.
NASW will be sponsoring
examination prep courses for the intermediate and clinical level ASWB exams.
Linda Burch requested the Board give continuing education credit for
social workers that do Grant Writing Workshops and those that take their exam
prep course.
RULES
The Board will be working on
drafting rules and will be sending out copies to the working rules committee for
review prior to holding a conference call.
Cheryl Jurgens moved to adopt
a temporary rule for Rule 201.04 for an extension changing the last day to apply
for the clinical exemption status from July 1, 2005 to July 1, 2006.
Rhonda Murray seconded and the motion carried.
Ray Millar addressed the Board
regarding concerns from the negotiating rules committee. The Board addressed
changing the clinical exemption status application date to July 1, 2006.
He also addressed the need to recognize the limited role of licensed
bachelor level social workers in the treatment of mental disorders and
addictions and non-psychotherapy services within their scope.
The Board indicated this is already provided in the rules for the
bachelor level in their scope of practice.
FINANCIAL REPORT
Rayola Jacobsen presented the
Board’s financial report indicating a cash balance of $45,811.22.
Ms. Jacobsen shared with the Board that the Bureau has gained a new board
called the Drinking Water and Waste Water Board, one more Board to help share
the cost.
Rhonda Murray moved to break
for lunch at 12:05 p.m. Vicki
Powers seconded and the motion carried.
The Board reconvened at 1:05
p.m.
POST CARDS
Cheryl Jurgens moved that the
Board send out post cards to all licensed social workers alerting to the new
changes in the rules and directing them to the web site to review the changes
and include information on how to make nominations for the public board member.
Vicki Powers seconded and the motion carried.
Melissa Berier addressed the
Board regarding questions on the new clinical exemption status and how she would
proceed with it.
EXECUTIVE SESSION
Rhonda Murray moved to enter
executive session to discuss files not subject to public disclosure. Vicki
Powers seconded and the motion carried.
Rhonda Murray moved to enter
regular session. Vicki Powers
seconded and the motion carried.
Rhonda Murray moved to approve
social work applicant SWOA-25584 for examination for the masters level ASWB exam
preconditioned that the probation period imposed upon the bachelor level license
apply to the LMSW license. Cheryl Jurgens seconded and the motion carried.
The Board discussed defining
clinical supervision for obtaining the LCSW license.
Robert Payne will review the rules for the social work board in Oregon.
The Board meeting adjourned at
3:20 p.m.
