The purpose of this conference call is to review and discuss Department of Health and Welfare rules governing Skilled Nursing/Intermediate Care Facilities. 

The Board noted that rules 152.03.a.i and 152.03.b., IDAPA 16.03.02, appear to conflict with 54-3214 and 54-3217 Idaho Code.  The Board determined that the services referenced in those rules fall within the practice of social work as defined in 54-3202.(2), Idaho Code. 

The Board unanimously recommended the following changes to rules: 

152.03.a

i.          Is a social worker licensed by the state of Idaho as a social worker or who received regular consultation from such a qualified social worker.

 153.03

b.                  If the facility does not provide the services directly but arranges with an outside resource to provide the services, then the outside services must be provided by a licensed social worker and there shall be a facility staff member designated in writing as a liaison person who:
