The meeting was called to order at 9:00 a.m. by Chair, Henri Le Moyne.

The board reviewed the minutes from the April 17, 2006 board meeting.

Motion was made by Mr. Morgan to accept the minutes as written. Seconded by Mr. Bachmeier, carried.

Ms. Jacobsen, Bureau Chief, gave the Legislative report. Lt.Governor Risch has been sworn in as Governor with Mark Ricks to be sworn in as Lt. Governor this afternoon. Ms. Jacobsen discussed the status of the new boards being added to the Bureau and the affect this will have on the current Boards.  Discussion was held on the number of investigations that are still open. 

 Mr. Moe and Mr. Morse arrived at 9:10am.

Ms. Jacobsen gave the financial report. Detailed report is on the web. The board has as of 6/19/2006, $7,495.29 in appropriation with a cash balance of $121,647.60.

Ms. Brown, board secretary, gave update on the quote for ordering USPAP books for all Licensees and Registered Trainees.  Motion was made by Mr. Morse to authorize the Appraisal Foundation to mail out USPAP books to all currently Licensed Appraisers and Registered Trainees, and approve payment of these expenses. Seconded by Mr. Bachmeier, motion carried.

Motion was made by Mr. Morgan to accept the financial report. Seconded by Mr. Morse, carried.

Emily Mac Master, Deputy Attorney General, presented a stipulation and consent order for case # REA-2006-4.  Motion was made by Mr. Morgan to approve and sign the stipulation. Seconded by Mr. Morse, carried.

Ms. Jacobsen gave the investigative report. Fiscal Year 2006:  Twenty Two (22) complaints have been received to date.  Of those one (1) has been closed, and one (1) was referred to the Office of the Attorney General for formal action. Fiscal Year 2005:  Thirty Five (35) complaints were received.  Of those thirty (30) remain under investigation, four (4) were closed, and one (1) was referred to the Office of the Attorney General for formal action. Fiscal Year 2004: Thirty Nine (39) complaints were received.  Of those, Twenty two (22) remain under investigation, eight (8) were closed, and nine (9) have been referred to the Office of the Attorney General for formal action. Fiscal Year 2003:  Thirty Two (32) complaints were received.  Of those, Two (2) remain under investigation, twenty two (22) were closed, and eight (8) have been referred to the Office of the Attorney General for formal action. Fiscal Year 2002:  Thirty Two (32) complaints were received.  Of those, three (3) remain under investigation, twenty one (21) were closed, and eight (8) have been referred to the Office of the Attorney General for formal action.

Board discussed the need for pro-reviewers. Ms. Jacobson explained the process to the board. She stated that anyone interested in becoming a pro-reviewer should contact the Bureau of Occupational Licenses.

Board discussed individuals who give an estimate of value and are not licensed appraisers in the State of Idaho. Mr. Hales, Administrative Attorney, explained that anyone appraising value that is unlicensed is committing a crime and their name should be given to the prosecutor’s office. A cease and desist letter may also be sent to the individual.

Ms. Jacobsen left the meeting at 9:45 a.m. to attend the swearing in of the Lt. Governor.

Board discussed letter regarding a Temporary Permit. Motion was made by Mr. Morgan to approve issuing the Temporary Permit. Seconded by Mr. Moe, carried.

Mr. Vuittonet, applicant, addressed the board regarding qualifications for supervision.

Motion was made by Mr. Morgan to go into executive session to discuss eligibility for supervision of Registered Trainees. Seconded by Mr. Morse, carried.

Motion was made by Mr. Morgan to come out of executive session. Seconded by Mr. Morse, carried.

Motion made by Mr. Morse to allow Mr. Vuittonet to supervise Registered Trainees, based on inconsistency of rules. Seconded by Mr. Morgan, carried.

Motion made by Mr. Morse to amend rule 275.b.ii. Delete wording “from acting as a supervisor”. To be submitted to the legislature for approval. Seconded by Mr. Morgan, carried.

Board discussed email from licensee requesting clarification on applications that are reviewed by the board prior to the new AQB requirements going into effect 1/1/2007. Board stated that if a complete application is reviewed before 1/1/2007 and is not approved due to an error in the demonstration reports, it will fall under the current rules. If an application is reviewed after 1/1/2007 and it is determined that the application is incomplete, it will fall under the new rules. Mr. Hales will respond to licensee’s email.

Board discussed requesting a temporary rule moving 1/1/2007 AQB requirements date to 1/1/2008. Board would also like to add a rule that allows board members and licensees to receive continuing education credit for attending board meetings. Board reviewed differences between segmented and firm dates for education.

Motion made by Mr. Bachmeier to adopt 1/1/2008 date, with the segmented approach not to extend past 1/1/2009 if applicant has not met current requirements. Seconded by Mr. Morse, carried 5 to 1. Mr. Morgan opposed the motion.

Board reviewed upcoming seminar entitled, “Advanced Commercial Leases.” Mr. Morse to attend the seminar and submit a certificate of completion for the board to review and approve.

Board discussed letter from licensee who requested to take all CE courses online due to disability. Mr. Hales to respond to licensee and request documentation of disability from doctor.

The Board elected a new Chair.  Mr. Moe nominated Mr. Morgan for Chair. Seconded by Mr. Morse, carried.  

Board discussed continuing education requirements for partial years. Mr. Hales explained that licenses in Idaho are renewed on the licensee’s birth date. During the first year of licensure continuing education is not required. Continuing education is required after the second year of licensure.

Board discussed continuing education waivers and deferrals. A waiver or deferral could be granted due to military duty or disability up to 180 days. Board asked Mr. Hales to examine law and advise board on whether it needs to take any action.

Motion was made by Mr. Bachmeier to go into executive session to review applications. Seconded by Mr. Morse, carried.

The Board reconvened from lunch at 1:30p.m.

Ms. McGinty, Investigations coordinator, presented a settlement proposal for case # REA-2003-8.  Following discussion the Board is requesting additional time to research matters brought up in the settlement letter.
