Minutes of October 17, 2005

The meeting was called to order at 9:05 a.m. by Chair, Henri Le Moyne.   

The board requested to talk to Roger Hales about the AQB required date.

The board reviewed the minutes from the August12, 2005 board meeting. 

Motion was made by Mr. Morgan to accept the board meeting minutes from the August 12, 2005 board meeting as written.  Seconded by Mr. Bachmeier, carried. 

Ms. Jacobsen, gave the financial report.  As of September 30, 2005, the board had $126,149.93 in appropriation with a cash balance of $127,724.19.   

Mr. Hetrick, gave the investigative report.  For 2006 there have been 3 complaints received.  All of which are under investigation.  For fiscal year 2005 there were 35 complaints.  33 of these are currently under investigation, and one has been referred for formal action.  There were 38 complaints for fiscal year 2004.  Seven of these complaints have been closed, 3 have been referred for formal action, 27 are under investigation or pro-review and 1 awaits board determination.  There were 32 complaints for fiscal year 2003.  20 of these have been closed, 5 are under investigation or pro-review and 7 have been referred for formal action.  There were 32 complaints for fiscal year 2002.  21 of these have been closed, 2 are under investigation or pro-review, 8 have been referred for formal action, and 1 awaits Board determination. 

Mr. Moe arrived at 9:15 a.m.

Mr. Hetrick, Deputy Bureau Chief, presented an investigative report for case #REA- S2-2005-15. 

Motion was made by Ms. Stroschein to refer to the Real Estate Commission and follow up by Mr. Le Moyne for case # REA S2-2005-15.  Seconded by Mr. Bachmeier, carried. 

Mr. Hetrick presented an investigative report for case #REA- L3-2-2004-25. 

Motion was made by Mr. Moe to accept IBOL recommendation to close the investigation. Seconded by Ms. Stroschein, carried.

Mr. Hetrick presented an investigative report for case #REA- L3A-1-2003-31. 

Motion was made to accept the IBOL’s recommendation by Mr. Moe. Seconded by Mr. Bachmeier, carried.

Mr. Hetrick presented an investigative report for case #REA- P3-1-2002-53. 

Stephanie Guyon, Deputy Attorney General, informed the Board that she will be temporarily taking over all of the Boards.

Stephanie Guyon, presented a stipulation and consent order for case # REA-2005-6.

Board discussed the complaint about the mobile home appraisal. The stipulation recommended a fine, additional continuing education classes, probation for 6 months and required reinstatement of licensure. Respondent is not admitting fault. Continuing Education shall be included in maintaining his license. 

Mr. Morgan made a motion to accept the stipulation, with a letter listing classes that would be approved by the Board.  Ms. Stroschein seconded, carried.

Mr. Hales, Administrative Attorney, arrived at 9:25 a.m.

Mr. Hales addressed the board regarding the statues of water rights. Mr. Hales is continuing to research the law as to who has jurisdiction of the water rights.

The board asked Mr. Hales if it is misleading for a Certified Residential Appraiser to advertise as a Certified Appraiser. Mr. Hales will follow up on Idaho Code 54-4103 and  54-4104. Mr. Hales suggested to the Board that it may require a Law change being taken to the Legislature. The Board will address this issue at a future Board meeting.

Susan Robbins with ASFMRA addressed the board regarding the Winter Seminar for ASFMRA.  

Ms.Stroschein made a motion to accept the 12 hour continuing education. Seconded by Mr. Bachmeier, carried.

Ms. Stroschein informed the board that this may be her last meeting as a board member. She is stepping down. Mr. Morgan also informed the board that he is stepping down as a board member.

Mr. Moe addressed the board regarding the Fraud Seminar that he attended. Mr. Moe recommended that the board approve 7 hours of continuing education for this seminar. The Board suggested that Mr. Moe give a continuing education application to the provider of the seminar. The Board also recommended that the IBOL send post cards to all Licensed Real Estate Appraisers inviting them to the Fraud Seminar. Mr. Le Moyne will contact the Real Estate Commission to invite Realtors to the seminar.

The Board discussed case # REA- BKE-8-5-2005. Applicant is seeking reciprocity with Washington. Verification sent from Washington states that licensure was through passing the ASI in California. Board recommended that the applicant ask Washington to write a letter to the Idaho Real Estate Appraiser Board stating that Washington was an original state of licensure.

The board adjourned for a break at 10:45 a.m. 

Meeting was called back to order at 10:55 a.m. by chair, Mr. Le Moyne. 

Mr. Hales discussed the Law with the Board in regards to information for a licensee with a felony conviction. Mr. Hales suggested that the matter go to the Attorney General. Motion was made by Mr. Morgan for the Bureau to investigate and give the information to the Attorney General for their review and further action. Mr. Moe seconded, carried.

The board went into executive session to consider records exempt from public discloser as stated in 67-2345 (1) (d)

Ms. Stroschein made a motion to come out of executive session. Mr. Bachmeier seconded, carried.

The board reviewed applications for examination and licensure. The following applicants were approved for examination:

The following applicants were approved for licensure:

The board adjourned for lunch at 12:20 p.m.

The board reviewed continuing education audits.  All audits submitted were approved. 

Mr. Le Moyne addressed the board concerning the AQB date of January 1, 2008. At the last board meeting the board discussed proposing taking to legislation a Law change to meet the AQB requirements by January 1, 2007 in Idaho. The board phoned Mr. Hales to discuss why a change should take place in Idaho in 2007. Mr. Hales said that the reason the board had addressed it at their last board meeting was to make sure that Idaho was in compliance with Federal requirements.

The board set the next meeting date for December 12, 2005.
