The meeting was called to order at 8:00 a.m. by Chair, R. Doyle Pugmire. 

Stanley Moe arrived at the meeting at 9:15 a.m.

The board reviewed the minutes from the February 14, 2005 board meeting.

Motion was made by Mr. Morgan to approve the minutes from the 02-14-2005 board meeting as written.  Seconded by Mr. Le Moyne, carried. 

Ms. Jacobsen gave the legislative report.  Proposed rules that were passed by the legislature went into effect April 06, 2005.  The Bureau will be receiving four additional licensing boards. 

  1. Contractor Registration
  2. Petroleum Dealers
  3. Speech and Hearing Sciences
  4. Naturopathic Physicians

The addition of these new boards will lower this boards direct costs however, the Bureau will be hiring additional staff to help with the work responsibilities.  An Investigator has been hired for the North Idaho area. 

Mr. Hetrick gave the financial report.  The board has $59,579.77 in appropriation with a cash balance of $91,554.09.  The Appraisal Foundation will be at the Bureau in May of 2005.

Mr. Hetrick gave the investigative report.  There have been 31 complaints so far for fiscal year 2005.  30 of those complaints are under investigation and one is referred for formal action.  There were 38 complaints for fiscal year 2004.  Four of those are closed, four have been referred for formal action and 30 are under investigation or pro-review.  There were 32 complaints for fiscal year 2003.  19 of those are closed, 8 are under investigation and five have been referred for formal action.  There were 31 complaints for fiscal year 2002. Twenty of those have been closed.  Three of these are under investigation and 8 have been referred for formal action.

The Board reviewed complaints regarding  formal action:

REA-P3-2-2003-3:

Motion was made by Mr. Le Moyne to close this case.  Seconded by Mr. Morgan, carried.

Deputy Attorney General, Ken Stringfield, presented the following consent agreements for board approval.

REA-2004-2:

Motion was made by Mr. Morgan to accept the consent agreement as written.  Seconded by Ms. Stroschein, carried.

REA-2005-4:

Motion was made by Mr. Le Moyne to direct respondent to complete 40 hours of classroom study that specifically address’s marketability, feasibility and highest and best use.  Seconded by Mr. Morgan, carried.

Applicant, Michael Aguilera, addressed the board.  Mr. Aguilera was directed by a stipulation to come before the board should he wish to reapply for licensure in the State of Idaho. 

Motion was made by Mr. Le Moyne to allow Michael Aguilera to apply for licensure in the State of Idaho.  Mr. Aguilera must submit a recommendation from his parole officer along with his application and required documentation for board review.  Seconded by Mr. Morgan, carried.

The board noted to Mr. Aguilera that he will also be required to submit a copy of the stipulation along with a cover letter, and that the board may also request copies of his parole officer’s quarterly reports.

Applicant, Aaron Dittman, addressed the board.  Mr. Dittman received some logged hours prior to him holding a registered trainee permit.  Mr. Dittman noted that he was not aware of the new Registered Trainee rules that were put into place July 01, 2003.  The board noted that the hours obtained from May 2003 through June 30, 2003 could be used as logged hours.  Anything from July 01, 2003 until the time that Mr. Dittman held a Registered Trainee permit, would not be allowed per board rule #430. 

Michelle Cappo addressed the board.  Ms. Cappo has received logged hours in the State of Nevada as a Registered Trainee.  Ms. Cappo would like to transfer these hours to the State of Idaho.  Idaho Real Estate Appraiser rule #430.02 states that the appraiser trainee shall be under the direct supervision of an appraiser who holds a current Idaho license in good standing.  Ms. Cappo’s supervisor does not hold a current Idaho license.  The board noted that because of the above board rule, Ms. Cappo’s hours would not be transferable to the State of Idaho.

Licensee, Tray Knipe addressed the board.  Mr. Knipe addressed Real Estate Appraiser rule #430.02 (c) A supervising appraiser shall be limited to supervising no more than three (3) appraiser trainees.  Mr. Knipe works in a firm with other Real Estate Appraisers.  These Real Estate Appraisers use all Registered Trainee’s that work for the firm.  With all the Real Estate Appraisers signing off for these Registered Trainee’s, the three-appraiser trainee limit only allows the firm to hire a total of three-registered trainee’s at any one time.  Administrative Attorney, Roger Hales, noted that as the law and rule stands now, Mr. Knipe’s firm will be required to submit new affidavits every time their supervision of a registered trainee changes. 

Motion was made by Mr. Morgan that this rule was put into place to comply with federal guidelines, and the board will contact AQB for clarification of this rule.  The board will provide Mr. Knapp with AQB’s response.  Seconded by Ms. Stroschein, carried.

An outline of the above issue will be submitted to the board by Mr. Knipe, for the board to submit to AQB.

The board reviewed a request from an applicant asking that education hours be reviewed for approval.  The board noted that the courses submitted were board approved for continuing education only.  These hours cannot be used for pre-licensure credits.

The board discussed University of North Dakota students applying for licensure in the State of Idaho.  It was noted that per board rule, University and College courses that are relevant to the profession are automatically accepted for pre-licensure credits.

Motion was made by Mr. Le Moyne to go into executive session to review applications exempt from disclosure as provided in chapter 3, title 9, Idaho Code.  Seconded by Ms. Stroschein, carried.

Motion was made by Mr. Le Moyne to come out of executive session.  Carried by Ms. Stroschein, carried. 

Mr. Morgan gave a report regarding the AQB training conference in St. Luis.  Federal guidelines will go into effect in January 01, 2008.  States need to start implementing these new changes.  They are asking each state to submit the date they are going to implement these changes, what law and rule changes will be made, and if the state is going to go with a firm date, or a floating date.   The board would like a letter sent out to all licensee’s regarding the new federal changes.

Motion was made by Mr. Morgan to direct the board legal council to assist the Deputy Bureau Chief to review and prepare those laws and rule changes necessary to comply with federal changes to standards and AQB effective 2008.  Seconded by Ms. Stroschein, carried.

The board noted that the form for experience credits would need to be changed for this implementation.

Motion was made by Mr. Le Moyne to send Budd Hetrick and Roger Hales to the AQB criteria implementation seminar.  Seconded by Mr. Morgan, carried.

The board reviewed the complaint for case# REA-2004-4.

Motion was made by Mr. Morgan to send a letter stating an independent board member has reviewed the complaint file, and violations were found.  The outcome of the first review done stands.  Seconded by Mr. Le Moyne, one opposed, motion carried.

The board reviewed a request by case #REA-2004-5 to be allowed to pay the required fine for disciplinary actions in installments.  Mr. Paul Morgan recused himself from this discussion.

The board noted that the stipulation that was signed stated that fine and costs must be paid within 60 days and a USPAP course must be taken within 90 days.  The respondent has also not submitted verification of completion of a USPAP course. 

Motion was made by Mr. Le Moyne to refer this case to the Attorney General’s office for review.  Seconded by Ms. Stroschein, carried.

The board reviewed a request from an applicant to allow on-line education classes for pre-licensure credits.  The board noted that they do not wish to allow on-line education for pre-licensure at this time.

The board broke for lunch at 12:05 p.m.

Motion was made by Mr. Morgan to approve all but one of the continuing education audits submitted for review.  Seconded by Mr. Le Moyne, carried.
