Minutes of October 18, 2004
The Idaho Real Estate Appraiser Board meeting was called to order at 8:40 a.m., Monday, October 18, 2004 at the Bureau of Occupational Licenses, Owyhee Plaza, 1109 Main Street, Suite 220, Boise, Idaho.

Motion by Mr. Morgan to approve the minutes of August 17, 2004. Seconded by Mr. Moe, carried.

Rayola Jacobsen presented the Board with the Legislative Report. The approved rule changes have been published and submitted to the Legislative Subcommittees, and to date there have been no objections.
Budd Hetrick presented the board with the Financial Report which was reviewed in detail. Motion by Mr. Moe to accept the financial report presented. Seconded by Mr. LeMoyne, carried.
Budd Hetrick presented the Board with the Investigative Report. Fiscal Year 2005, to date two (2) complaints have been received. One (1) is under investigation; and one (1) has been referred for formal action. Fiscal Year 2004: Thirty-eight (38) complaints were received. Four (4) have been closed; three (3) were referred for formal action; and thirty-one (31) remain under investigation or pro-review. Fiscal Year 2003: thirty-two (32) complaints were received. Sixteen (16) have been closed; eight (8) are currently under investigation; one (1) awaits pro-review; four (4) were referred for formal action; and three (3) await Board determination (see below). Fiscal Year 2002: thirty (30) complaints were received. Seventeen (17) have been closed; two (2) remain under investigation; two (2) await pro-review; eight (8) were referred for formal action; and one awaits Board determination (see below). Fiscal Year 2001: twenty-five (25) complaints were received. Of those, twenty-three (23) were referred for formal action.
REA-P-3-2-02-57 Motion by Mr. Morgan to accept the recommendation that the Board authorize closure with an instructional letter and a redacted copy of the pro review to Respondent. Seconded by Mr. Moe, carried.
REA-P3C-3-03-21 Motion by Mr. LeMoyne to accept the recommendations for closure. Seconded by Mr. Morgan, carried.
REA -P3-02-03-23 Motion by Mr. Moe to accept the recommendations for closure. Seconded by Mr. Morgan, carried.
REA-P3C-1-03-30 Motion by Mr. Morgan to accept the recommendations for closure. Seconded by Mr. LeMoyne, carried.
Ken Stringfield addressed the Board regarding a stipulation consent re-reviewed by the Board. Motion by Mr. LeMoyne to accept the Attorney General’s recommendation of $6000.00 fine, 15 hour National USPAP course and probation for one year. Seconded by Ms. Stroschein, carried.
REA-2004-4, presented by Mr. Stringfield. Motion by Ms. Stroschein to accept Bureau recommendations. Seconded by Mr. Morgan, carried.
REA-2003-1, presented by Mr. Stringfield to the Board for recommendations. The recommendations are as followed:
1. Three to Five (3 to 5) year suspension of license
2. Two (2) year probation
3. The Board has the right to audit all office records
4. Submittal of Board approved appraisal log every quarter for the two (2) year term of probation
5. Board has a right to select one appraisal per quarter for review by a pro-review at the licensees expense
6. Violations result in suspension of license
7. All fees and costs to be paid within one (1) year, first in thirty (30 days of signed consent.
Motion by Ms. Stroschein to allow ten (10) hours continuing education credit to Doyle Pugmire and Rick Bachmeier for attending the course Digital Appraisal. Seconded by Mr. LeMoyne, carried. Mr. Pugmire was recused from this motion.
Motion by Mr. LeMoyne to accept nomination of Mr. Moe to Vice-Chairman of the Idaho Real Estate Appraiser Board. Seconded by Mr. Morgan, carried.
Budd Hetrick and Roger Hales presented the Board with the contract between the Bureau and the Board and it was reviewed in detail. Motion by Mr. LeMoyne to accept Bureau contract as written. Seconded by Mr. Moe, carried.
The Board reviewed a request by Lynnsay Jacobs Hagerty from Montana regarding a course she took from the University of Idaho. The Montana Real Estate Board directed her to contact Idaho and ask if her course was approved by the Idaho Board. Idaho reviews college courses on an individual basis. Motion by Mr. Morgan to approve AgEcon 361-Farm and Natural Resource Appraisal and Business 364-Real Property Appraisal, these courses have been accepted in the past for 45 hours of appraisal pre-licensure education credit. Seconded by Mr. LeMoyne, carried. Ms. Stroschein was recused from this discussion and motion. Secretary to send a letter to the Montana Board.
Discussion was presented regarding classes offered by instructors that have not submitted their courses for Board approval, but advertise that the courses are approved in Idaho. Applicants and licensees are encouraged to check the Bureau website for approved courses.
Mr. Hetrick reviewed the application process with the Board in detail. The Board is encouraged to review the entire application at the time, to evaluate all areas for correction in one review. The registered trainee application was reviewed.
Mr. Hetrick presented a letter for discussion to the Board regarding demonstration reports submitted in applications for clarification. Demonstration reports must be the work of the applicant applying for credit for the report. Motion by Mr. Morgan for applicant to submit two (2) more sample demonstration reports of applicants own work for an upgrade license. Seconded by Mr. Moe, carried.
Mr. Moe presented the Board with a report on the AARO Conference held on October 9-12, 2004 in Washington DC. The new AQB Course Approval Program requirements that will be implemented on January 8, 2008, were discussed in detail regarding course providers and changes to course approvals along with hours according to topic. Decisions need to made by the Board soon on how to implement these changes and what role the Board wishes pursue, to with the AQB recommendations or develop their own matrix. The Board also needs to decide on a firm date or a segmented date to make all AQB requirements effective for education, examinations, and experience. The Board may need to affirm accreditation rating of schools, does the Board have the resources to provide this service, and should the provider be required to pay for this service. Auditing applications in regards to topical educational instead of hourly is another decision the Board needs to make. The AARO conference discussed the trainee applicant and the supervisor role. One state requires the trainee and the supervisor to attend a two (2) hour training session prior to the training period. This would ensure that the supervisor and trainee are familiar with the process. Roger Hales requested that the new AQB requirements be placed on the next agenda for discussion, giving the Board time to review for potential law and rule changes for 2008.

Motion by Ms. Stroschein to accept the changes to the Idaho Trainee Application. Seconded by Mr. Morgan, carried.
Letter received by the Appraisal Subcommittee reviewed. Bureau to email their response to the Board members for review.
