Minutes of August 20, 2004

  

The Idaho Real Estate Appraiser Board meeting was called to order at 10:07 a.m., Friday, August 20, 2004 at the Bureau of Occupational Licenses, Owyhee Plaza, 1109 Main Street, Suite 220, Boise, Idaho.

                            Roger Hales, Administrative Attorney

Ruby Stroschein, Board Member, absent, excused. 

Moved by Paul Morgan, seconded by Henri LeMoyne and carried that the Board go into executive session to discuss possible litigation exempt from public record.  The time being 10:12 a.m. 

Moved by Henri LeMoyne, seconded by Paul Morgan and carried that the Board come out of executive session.  The time being 10:47 a.m. 

FORMAL DISCIPLINARY ACTION 

REA-2004-3:  Moved by Stanley Moe, seconded by Henri LeMoyne and carried to adopt the Hearing Officers Findings of Fact, Conclusions of Law and that License CRA-163 issued to Respondent David L. Votaw be revoked for a period of no less than one (1) year.  Respondent is ordered to pay to the Board the administrative fine and investigative and attorney fees in the amount of Three Thousand Seven Hundred Fifty dollars ($3,750.00) as previously ordered regarding case number REA-2004-1.  Respondent is also ordered to pay to the Board the investigative and attorney fees in the amount of Six Thousand Fifty Nine Dollars ($6,059.00) for case number REA-2004-3.  After the one (1) year revocation period Respondent may request a reinstatement of his license by submitting new completed application for licensure to the Board.  All fines and fees ordered in Cases No. REA-2004-1 and REA-2004-3 must be paid in full prior to the Board considering an application for relicensure. 

PROPOSED RULE CHANGES 

As per the Appraisal Subcommittee’s recommendation, proposed rule changes regarding the National USPAP course and continuing education carry forward credit were presented and discussed. Moved by Henri LeMoyne, seconded by Paul Morgan and carried to accept the proposed rule changes.
