The Idaho Real Estate Appraiser Board
meeting was called to order at 8:40 a.m., Monday June 21, 2004, at the Bureau of
Occupational Licenses, Owyhee Plaza, 1109 Main Street, Suite 220, Boise, Idaho.

Pugmire, and passed, to accept the minutes of 04/19/2004.
New Business
Rayola Jacobsen introduced to the Board Mr.
David High with the Attorney General’s Office.
Rayola Jacobsen presented the Board with
the Legislative Report. Legislation is being prepared for the various boards to
present at the next session.
There have been changes in Bureau personnel
to better serve the Boards and these changes were discussed in detail.
Financial Report
Budd Hetrick presented the Board with the
Financial Report. There have been changes to the Financial Report and these
changes were reviewed with the Board in detail. The reports are also located on
the web. Moved by Paul Morgan, seconded by Doyle Pugmire, and passed, to accept
financial report.
Investigative Report
Budd Hetrick presented the Board with the
Investigative Report. To date for 2004 the Bureau has received thirty-three
complaints, with twenty-five under investigation, and two presented for
determination from the Board. For the year 2003 there are twelve complaints
under investigation, and for the year 2002 there are three complaints under
investigation. For 2001 there is one complaint under investigation.
REA-P3C-2-2003-20: Moved by Paul Morgan and
seconded by Doyle Pugmire and carried to accept the Bureau recommendation.
REA-P3C-2-2003-26: Moved by Paul Morgan and
seconded by Doyle Pugmire and carried to accept the Bureau recommendation.
Attorney General Disciplinary Report
David High of the Attorney General’s
Office presented the Board with two DAG Disciplinary Reports.
REA-S3-04-03-1: The Board authorized the
Deputy Attorney General to negotiate a consent order to include probation with
possible suspension of license if any further violations occur, payment of costs
and fine, and USPAP continuing education course in addition to renewal CE
requirement.
REA-P3-01-03-4:
The Board authorized the Deputy Attorney General to negotiate a consent

Disciplinary Actions
Roger Hales presented the Board with two
(2) proposed stipulations.
REA-2003-2: Moved by Paul Morgan and
seconded by Doyle Pugmire and carried to accept the consent order recommended by
the Board and to authorize signature by the Board Chair. Approved by unanimous
vote.
REA-2003-3: Moved by Paul Morgan and
seconded by Doyle Pugmire and carried to accept the stipulation order
recommended by the Board and to authorize signature by the Board Chair. Approved
by unanimous vote.
Mr. Hales recommended a conference call in
30 days to review one disciplinary action case that continues in preparation.
Transcripts and exhibits will be sent to the Board members via email or disk for
the Board’s review prior to the conference call.
Juan (Mike) Vuittonet addressed the Board
regarding web postings of disciplinary actions taken in 1998. The stipulation
order at that time indicated no admission of guilt, no fine or penalty and no
probation. Lenders are now reviewing all appraisals or not accepting appraisals
from the involved licensees. Mr. Vuittonet asked that the disciplinary action be
removed from the website because there was no admission of guilt.
Mr. Hales discussed disciplinary actions and reviewed the process. It was
noted that all formal disciplinary actions taken by the Board are public record,
and that the Board has requested they be posted on the website. The Board
instructed Mr. Hales prepare information on possible time frames for the posting
of disciplinary actions on the web, for presentation at a conference call to be
scheduled.
Eric Stroschein presented the Board with a
question regarding his hours obtained prior in 2003 for registered trainee
status. Mr. Stroschein is to submit the logged hours in question with supervisor
signature for Board review. The Board will review this log at their next meeting
and the decision will be sent to Mr. Stroschein in a letter.
Rayola Jacobsen addressed the Board
regarding the North Idaho Board position. Any applications and resumes should be
submitted to the Governor’s office along with a letter of interest.
Motion by Paul Morgan and seconded by Ruby
Stroschein and carried to elect Doyle Pugmire Chairman for the year 2005.
Approved by unanimous vote.
Doyle Pugmire presented the Board with a
report from the AARO conference he attended in April 2004. The new licensing
requirements from the Appraisal Foundation that go into effect January 1, 2008,
and the rule changes that may have to occur in Idaho were discussed. This item
of business is to be placed on the August 17, 2004 Board agenda.
The Board has asked Roger Hale to
investigate authority to run background checks and to present the Board with his
findings at the Board meeting scheduled for August 17, 2004.
Break for lunch at 12:15 p.m.
Roger Hales presented the Board with a
letter from Steve Weeks asking for clarification or further definition of
non-complex appraisals. Mr. Hales will refer Mr.Weeks to the Chairman of the
Appraisal Foundation, Mr. Ed Morris, in writing.
Old Business
The Board agreed to accept the online USPAP
7 Hour update course for the continuing education requirement.
