The Idaho Real Estate Appraiser Board
meeting was called to order at 8:55 a.m., Tuesday, June 24, 2003 at the Bureau
of Occupational Licenses, Owyhee Plaza, 1109 Main Street, Suite 220, Boise,
Idaho.

Minutes
Moved by Doyle Pugmire, seconded by Ruby
Stroschein and carried that the minutes of the April 21,2003 board meeting be
approved.
Rayola Jacobsen
Ms. Jacobsen discussed the financial report
with the Board. There current cash
balance is $93,568.13.
Ms. Jacobsen discussed with the Board the
meeting she had with the Hearing Officers that are hearing the different cases
on disciplinary matters.
Proposed Law and Rule Changes
Moved by Stanley Moe, seconded by Doyle
Pugmire and carried that the proposed law and rule changes be adopted.
Complaint Report
Fiscal Year 2003. Twenty-nine (29)
complaints have been received and are currently under investigation.
Fiscal Year 2002, twenty-one (21)
complaints have been received. Of those eighteen (18) remain open and under
investigation or legal review.
Twenty-one (21) complaints have been
received thus far for the year 2001. Of those, four (4) are under investigation
the remaining ones are under legal review.
Thirty (30) complaints received were
received for the year 2000. Of those five (5) remain under investigation. Eleven
(11) are under legal review.
Forty-seven (47) complaints were received
in 1999. Twenty-two (22) are under legal review pending an administrative
hearing.
Thirty-seven (37) complaints were reviewed
in 1998. Eight (8) are under legal review pending an administrative hearing.
Thirty-two (32) complaints were received in
1997. Three (3) are being scheduled for an administrative hearing.

Stroschein and carried the Board go into executive session to discuss possible
litigation. The time being 11:05

Moe and carried that the Board come out of executive session at 11:18 a.m.
REA-2003-10:
Moved by Doyle Pugmire, seconded by Ruby Stroschein and carried that the
Board accept the Stipulation And Consent order for Clinton T. Marchbanks,
CRA-63.
Moved by Doyle Pugmire, seconded by Stanley
Moe and carried that the Board go into executive session to discuss possible
litigation. The time being 11:20
a.m.

Pugmire and carried that the Board come out of executive session at 11:45 a.m.
REA-2003-3:
Moved by Stanley Moe, seconded by Ruby Stroschein to accept the
Stipulation And Final Order of Domenic J. Barone, CRA-136 with one exception
that a change of the probation period of six months be retroactive to May 22,
2003 rather than May 22, 2002. Moved
by Stan Moe, seconded by Doyle Pugmire and carried that the Board amend the
Stipulation to include a $1,000 fine and reimbursement of legal and
investigative costs not to exceed $3,000.
Moved by Ruby Stroschein, seconded by Doyle
Pugmire and carried that the Board go into executive session to discuss possible
litigation. The time being 1:15

Stroschein and carried that the Board come out of executive session at 1:45 p.m.
REA-2003-8:
Moved by Ruby Stroschein, seconded by Doyle Pugmire and carried that the
Board adopt the Hearing Officer’s Findings of Fact, Conclusion Of Law, And
Recommended Order in regards to discipline except that the Board would require
that George Haney, LRA-86 be ordered to pay all costs incurred by the
Board/Bureau in the investigation and prosecution of the matter.

Moe and carried that the Board go into executive session to discuss possible
litigation. The time being 1:55

Pugmire and carried that the Board come out of executive session at 2:20 p.m.
REA-2003-1:
Moved by Stan Moe, seconded by Doyle Pugmire and carried that the Board
reject the Stipulation And Consent Order, however, the Board will approve the
Stipulation and Consent Order as written conditioned upon all terms remain the
same except respondent will agree to pay no more than $7,000 as recovery of the
costs incurred by the Board/Bureau in the investigation and prosecution of the
matter and that all terms be complied with prior to reinstatement.
REA-2003-2:
Moved by Doyle Pugmire, seconded by Stan Moe and carried that the Board
reject the Stipulation And Consent Order and amend it to require 12 months
probation, the payment of $1,500 in fines, and the payment of legal and
investigative costs not to exceed $5,000.
