The meeting was called to order at 9:32 a.m. Mountain Time by Mr. Paul Morgan, Chair.
Formal Disciplinary Action
The Board met via conference call to discuss Final Orders for Case Nos. REA-2005-8 and REA-2007-95.
Mr. Hales presented and advised the Board of their options for discipline. After a full review and discussion of the records the Board made the following motions:
Case No. REA-2005-8: Moved by Ms. Lentz that license number CRA-361 issued to Patrick M. Wall be suspended for a period of six (6) months with the exception that the suspension period may be reduced to a three (3) month suspension period if Mr. Wall attends a Board approved thirty (30) hour Sales Comparison Approach course and a fifteen (15) hour USPAP course. The courses shall be in a classroom face to face with and instructor. No online courses will be approved or considered. At the conclusion of the suspension period Mr. Wall’s license shall be placed on probation for a period of two years. Mr. Wall must also, pay a fine in the amount of $1000 and the costs and attorney fees as determined by the Bureau. Seconded by Mr. Moe, motion carried. The motion was later amended by Ms. Lentz to adopt the Hearing Officer’s Findings of Fact, Conclusions of Law and to authorize the Chair to sign the Order on behalf of the Board upon its completeness. Seconded by Mr. Moe, motion carried.
Case No. REA-2007-95: Moved by Mr. Moe that Mr. John Rich, license number CGA-413 pay an administrative fine in the amount of $500 and the costs and attorney fees in the amount of $250 and to adopt the Hearing Officer’s Findings of Fact, Conclusions of Law and to authorize the Chair to sign the Order on behalf of the Board upon its drafted completeness. Seconded by Ms. Lentz, motion carried.
