IBOL COMPLAINT MEMORANDUM

                    SUBJECT:      Investigative Report

 

 

Fiscal Year 2008: To date, eighty-eight (88) complaints have been received, including seventy-seven (77) CE audit files.  Of those, eleven (11) have been closed by Board action; four (4) have been closed following disciplinary action; forty-eight (48) are pending legal review by the Office of the Attorney General; and twenty-f ive (25) remain under investigation.

 

Fiscal Year 2007: one-hundred seventy-three (173) complaints were received, including one hundred-twenty-two (122) CE audit files. Of those, sixty-three (63) have been closed by Board action; fifty (50) have been closed subsequent to disciplinary action; twenty-five (25) are pending legal review by the Office of the Attorney General; and thirty-five (35) remain under investigation.

 

Fiscal Year 2006:  Twenty Nine (29) complaints were received.  Of those, eleven (11) have been closed by Board action; five (5) have been closed following Board disciplinary action; eleven (11) are pending legal review by the Office of the Attorney General; one (1) remains under investigation; and one (1) awaits Board determination.

 

Fiscal Year 2005:  Thirty Five (35) complaints were received.  Of those, eighteen (18) have been closed by Board action; eleven (11) have been closed following Board disciplinary action; and six (5) are pending legal review by the Office of the Attorney General.

 

Fiscal Year 2004: Thirty Nine (39) complaints were received.  Of those, seventeen (17) have been closed by Board action; eighteen (18) have been closed following Board disciplinary action; and four (4) are pending legal review by the Office of the Attorney General.

 

Fiscal Year 2003:  Thirty Two (32) complaints were received.  Of those, twenty-two (22) have been closed by Board action; eight (8) have been closed following Board disciplinary action; and two (2) are pending legal review by the Office of the Attorney General.

 

Fiscal Year 2002:  Thirty Two (32) complaints were received.  Of those, twenty-three (23) have been closed by Board action; eight (8) have been closed following Board disciplinary action; and one (1) awaits Board determination.

 

 

For Board Determination:

 

REA-P3-1-2002-23                C alleged that the R over-inflated the value of the subject property. Owner of the property defaulted on the loan causing a loss to the complainant. INV revealed that R could not provide any information or work files as the appraisal was over 5 years old. DAG review concluded that no formal action would be taken as no records were available. IBOL recommends the Board authorize closure.

 

REA-P3-3-2006-17                C alleged R failed to conduct an adequate inspection; used erroneous information, improper comps and failed to appraise entire subject; resulting in and incorrect valuation. INV revealed that R did not sign the appraisal in question and may not be accountable, though both R and supervisor admitted that R did the majority of the work. Supervisor disclosed in the appraisal that R assisted but there is no signature by R. DAG review concluded that R did not violate law or rule, as assistants are allowed and the supervisor is ultimately responsible. IBOL recommends the Board authorize closure.
