IBOL COMPLAINT MEMORANDUM

SUBJECT:                  Investigation Report

 

Fiscal Year 2004: To date, thirty-three (33) complaints have been received to date. Twenty-five (25) remain under investigation; two (2) await pro-review; and six (6) have been closed. 

Fiscal Year 2003. Thirty-one (31) complaints have been received. Twelve (12) are currently under investigation; one (1) awaits pro-review; & two (2) await Board determination. 

Fiscal Year 2002.  Thirty (30) complaints have been received. Of those five (5) remain open with three (3) under investigation, and two awaiting pro-review. 

2001: Twenty-four (24) complaints were received. Of those, one (1) is undergoing pro-review.   

 

REA-P3C-2-2003-20            C alleged R under-valued the subject property. C alleged respondent prepared 2 separate reports on the same property with a $10,000.00 difference in value, and owner had to sell the home at the lower value. Investigation revealed R failed to include information related to the multiple levels of the subject home and previous sales information in the 1st report. Pro-review reported 2 USPAP violations: STD 1-1: that the failure to include the multi-level issue in the 1st report should have been addressed in detail in the second report to assist in explaining the differences. 
STD 2-1: R admitted failure to show the previous sales in one of the reports. 
Review of complaint logs indicate this is R's first offense.
IBOL recommends Board authorize closure with an advisory letter including a redacted copy of pro-reviewer's findings.

REA-P3C-2-2003-26            C alleged R was biased and unethical. R agreed to perform an appraisal for C for a PUD for a fee of $2,500-$3,000.00 + $500 for an MAI fee. C alleged that R had used information from a prospective buyer to influence the appraisal values. Investigation revealed R refunded $1,500.00 after C called R to cease any further work. R denied any relationship with a prospective buyer or any other unethical behavior. The investigation did not reveal any evidence to support the allegations, or of a violation of law & rules or USPAP. IBOL recommends Board authorize closure without action.
