The meeting was called to order at 12:20 p.m. MST. Roll call established attendance.
APPROVAL OF MINUTES
The October 29, 2008 minutes were approved as corrected.
NEW BUSINESS
PROPOSED CHANGES TO STATUTE AND RULES
The proposed rules have been submitted and published in the administrative bulletin.
Mr. Milstead reviewed his report to the germane committees with the Board. He expressed concerned that the proposed rules simply mirror the statute rather than clarify or explain the requirements for examination and education and do not address the concerns raised in the 2008 Legislature.
Discussion was held regarding the adoption of an examination.
Dr. Grogan moved that the Board consider both the American Naturopathic Certification Board (ANCB) and the National Naturopathic Board of Examiners (NNBOE) examinations for a mode of testing for possible presentation to the Legislature. Dr. Grogan and Dr. Lee voted in favor; Dr. Langenderfer and Dr. Stevens, against. Chairman Barraclough broke the tie, voting in favor of the motion.
Dr. Stevens stated he feels there are flaws in the statute and the Board could implement language that creates a pathway for a grandfather clause. He moved that if asked for a possible solution within the legislative session, the Board would offer up a grandfather clause. Seconded by Dr. Langenderfer, motion carried.
Dr. Langenderfer stated she supports having a grandfather clause for a specified time and to then relying on a nationally accredited school and the N-PLEX.
Dr. Lee stated the Board has the authority to make a decision and to protect the public a person must be licensed. He stated he has a pool of questions he’s gathered to test the competency portion of the examination.
Chairman Barraclough reported on his meeting with the Governor’s staff. They discussed the proposed rules and the Governor’s concerns with respect to education and examination. He added that the Governor’s first priority is for public safety.
The proposed rules have been submitted and the Board Chair will be notified when the rules will be heard in the legislature.
The meeting adjourned at 1:50 p.m.
