Meeting minutes of October 25th, 2004

The Idaho State Cosmetology Board meeting was called to order at 1:30 p.m., Monday, October 25, 2004 at the Bureau of Occupational Licenses, Owyhee Plaza, 1109 Main Street, Suite 220, Boise, Idaho.

Christine Stutzke, Chair and Eric Negaard, Board Member, absent, excused.

FORMAL DISCIPLINARY ACTION

COS-2004-26:  Moved by Joan Huff, seconded by Linda Swope and carried to adopt the Hearing officers Findings Of Fact, Conclusions Of Law And Recommended Order.  That Hoang Nguyen, Owner of Fancy Nails, License No. CS-221970 be suspended for a period of One hundred twenty (120) days with ninety (90) days stayed, suspension shall go into effect five (5) days of signed order.  At the conclusion of suspension the establishment license shall be placed on probation for a period of two years (2). Respondent shall pay a fine in the amount of Five Hundred Dollars and No/100 ($500) and pay the investigative costs and attorney fees in the amount of Five Hundred Ninety One Dollars and 67/00 ($591.67) within thirty (30) days of order.

COS-2005-1:  Moved by Joan Huff, seconded by Linda Swope and carried to adopt the Hearing officers Findings Of Fact, Conclusions Of Law And Recommended Order.  That Khai Quang Le, License No. NT-221505 be suspended for a period of One hundred eighty (180) days with One Hundred Fifty (150) days stayed, suspension shall go into effect five (5) days of signed order.  At the conclusion of suspension the license shall be placed on probation for a period of two years (2). Respondent shall pay a fine in the amount of One Thousand Dollars and No/100 ($1000) and pay the investigative costs and attorney fees in the amount of Three Hundred Four Dollars and 10/00 ($304.10) within thirty (30) days of order.

COS-2005-6:  Moved by Joan Huff, seconded by Linda Swope and carried to accept the Stipulation and Consent Order in the matter of The Hair Depot, License No. CS-6200 and Christy Bahem, Owner, License No. RC-16152.  With condition that the second paragraph of section C paragraph 3 be deleted. And to allow Geneal Thompson to sign on behalf of Board Chair, Christine Stutzke who is absent and excused from this meeting.
