Meeting minutes of October 4th, 2004
Meeting called to order at 8:30 a.m. by Secretary Joni Huff. Those present: Chair Christy Stutzke, Vice Chair Eric Negaard, Linda Swope, Geneal Thompson, and Joni Huff. Bureau Staff present: Rayola Jacobson, John Kersey, and Kim Aksamit. Legal Counsel: Carl Ericson, Deputy Attorney General Kenneth Stringfield.
Motion made by Mr. Negaard to approve minutes from June 7th, 2004; seconded by Ms. Huff; motion carried.
Motion made by Ms. Huff to approve minutes from June 28, 2004; seconded by Ms. Thompson, motion carried.
Motion made by Ms. Swope to approve minutes from July14, 2004; seconded by Mr. Negaard, motion carried.
Motion made by Ms. Thompson to approve minutes from August 23, 2004; seconded by Ms. Huff, motion carried.
Ms. Jacobsen reported on the requested law and rule changes that have been submitted to the legislation.
Leslie Thorson and Curtis Park, from the Barber Board, were introduced.
Ms. Jacobsen gave the financial report.
COS-P4-2-04-22: Moved by Ms. Thompson to accept the recommendation and close the case; seconded by Mr. Negaard and carried .
COS-P4A-2-04-32: Moved by Mr. Negaard that no further action be taken; seconded by Ms. Thompson and carried .
COS-L6A-1-04-40: Moved by Mr. Negaard to accept the recommendation from the Bureau and authorize closure; seconded by Ms. Huff and carried .
COS-B1C-2-04-65: Moved by Ms. Huff to take the Bureau's recommendation to send an advisory letter and close; seconded by Ms. Swope and carried .
COS-L5A-1-04-70: Moved by Ms. Thompson to accept the recommendation to close without action; seconded by Mr. Negaard and carried .
COS-2005-3: Moved by Ms. Thompson that the Board give authorization to the Attorney Generals office to pursue disciplinary action in the revocation of said license.; seconded by Mr. Neggard and carried.
COS-2005-6: Moved by Mr. Negaard to take the recommendation of the Attorney Generals office with the caveat that they recover expenses; seconded by Ms. Huff and carried .
Ms. Stutzke shared her gratitude and support towards everyone while she was on the Board.
COS-2004-14, 16,and 17: Motion made by Mr. Negaard to vacate the last three final orders and, upon submitting satisfactory proof to the Board that respondents did indeed serve 15 days of the 30 days of the suspension, that credit for the time served will be allowed, and the matter remanded back to the hearing officer; seconded by Ms. Swope and carried .
Motion made by Mr. Negaard that if this legislation is passed and the bond is raised to 25,000.00 for a school, the Board would not enforce the higher bond until the renewal of their school license in the year after July 1st 2005, seconded by Ms. Thompson; motion carried.
Mr. Negaard recused himself from the discussion regarding Burton Academy.
Motion made by Ms. Huff to have the Bureau write an advisory letter of reprimand for failure to register a student to be issued to Burton Academy, seconded by Ms. Thompson; motion carried.
Discussion was held with Leslie Thorson and Curtis Park regarding the merging of the Cosmetology and Barber Boards; no action taken.
Break for lunch
Moved by Mr. Negaard that Board go into executive session to discuss pending litigation exempt from public disclosure, seconded by Ms. Huff, and carried .
Moved by Mr. Negaard to come out of executive session, seconded by Ms. Thompson, and carried .
Ms. Thompson is Regional Director on the National Board.
Motion made by Ms. Huff to accept the 2004-2005 contract with the Bureau; seconded by Ms. Swope, and carried.
Motion made by Mr. Negaard that the Bureau will no longer be issuing a paper student instructor permit; seconded by Ms. Huff, and carried .
Discussion was held on qualification for examiners, and the matter was tabled until the February meeting.
Re-certification training for examiners and Board members will be held on Jun 4th and 5th, 2005. School overview will be on June 6th, 2005.
NIC conference for 2005 will be held in Washington on August 27th-29th, 2005.
Motion made by Mr. Negaard to accept the amended 2004-2005 contract; seconded by Ms. Thompson; motion carried.

Motion made by Ms. Huff to have the Bureau write an advisory letter of reprimand for failure to register a student to be issued to Headmasters CDA, seconded by Ms. Thompson; motion carried.
Board reviewed the curriculum for Master Educators of Beauty. A letter will be sent advising of necessary changes required before approval can be considered.
Motion made by Mr. Negaard to respond to the letter from an ISU student stating that the Board received her letter and that it appears she is in violation of NIC testing agreements.
The Board reviewed applications received by the Bureau.
