Meeting Minutes of June 07, 2004

Meeting
called to order at 8:30 a.m. by Secretary Joni Huff.
Those present: Chair Christy Stutzke, Vice Chair Eric Negaard, Linda
Swope, Geneal Thompson, and Joni Huff. Bureau
Staff present: Rayola Jacobson,
Budd Hetrick, and Kim Aksamit. Legal Counsel: Carl Ericson
New Board Member Linda Swope was
introduced.
Motion by Mr. Negaard to accept minutes
from February 02, 2004, seconded by Ms.
Huff; motion carried.
Motion by Ms. Thompson to accept minutes
from March 22, 2004, seconded by Ms.
Swope; motion carried.
Motion by Ms. Huff to accept minutes from
May 26, 2004, seconded by Mr. Negaard; motion carried.
Ms. Jacobsen Reported on the law change of
54-805 Idaho Code that will go into effect July 1st, 2004 and the
rules that have passed and now in effect. The
bill presented by Representative Meyer, which places the appointment of
examiners with the board passed and will be effective July 1st, 2004.
Mr. Hetrick gave the financial report.
Mr. Hetrick gave the investigative report.
The Board reviewed Bureau recommendations regarding pending cases.
COS-L1-1 2004-1:
Moved by Mr. Negaard to accept the recommendation of the Bureau and
authorize closure and an advisory letter that the license must be renewed as
required; seconded by Ms. Swope; motion carried.
COS-L3A-1-2004-24:
Moved by Ms. Huff to accept the Bureau’s recommendation that an
advisory letter outlining scope of practice and reflecting that all advertising
pertaining to eyelash and brow tinting be stopped until appropriately licensed
person can be employed; seconded by Mr. Negaard; motion carried.
COS-L6A-2-2004-43:
Moved by Mr. Negaard to accept the Bureau’s recommendation authorizing
an advisory letter regarding compliance with probation and closure; seconded by
Ms. Huff; motion carried.
COS-L5A-1-2004-58:
Moved by Ms. Thompson to accept the Bureau’s recommendation to
authorize closure; seconded by Ms. Swope; motion carried.
COS-L4-2-2004-69:
Moved by Ms. Huff to accept the Bureau’s recommendation to authorize
closure without action; seconded by Ms. Thompson; motion carried.
The Board reviewed disciplinary matters
from the Deputy Attorney General.
COS-2004-21:
Moved by Mr. Negaard to accept the disciplinary action; seconded by Ms.
Huff; motion carried.
COS-2004-12:
Moved by Mr. Negaard to revoke or refuse to issue license for 5 years as
of June 07, 2004; seconded by Ms. Thompson; motion carried.
Board Chair signed final orders on case numbers COS-2004-14, COS-2004-16 and COS-2004-17.
Moved by Mr. Negaard for the Board to allow
a one time 30 day application prior to law change 54-805 (2) (a) affected July 1st
2004 for student instructors taking July 2004 boards; seconded by Ms. Thompson;
motion carried.
Rayola Jacobsen thanked the School Owners
for supporting the Bureau on Rule 200 04.
Board Chair asked for a moment of silence in honor of President Reagan.
Discussion from the Board regarding
Attorney General Lawrence Wasden request was in support.
Upon receiving additional information the Board will proceed to inform
licensees upon renewal.
Discussion was held on law and rule changes regarding:
· Raising school bond
· Qualifications on appointing Examiners
· Requirements for Demonstration Permits
· Discontinuing the Apprenticeship program
· Changing Instructor to student ratio
No Board action was taken.
Moved by Mr. Negaard that all Board members
attend the 49th annual NIC conference in Richmond Virginia including
all travel expenses and rental car; seconded by Ms. Swope; motion carried.
Break for lunch
Moved by Mr. Negaard to go into executive
session to consider records that are exempt from disclosure as provided in
chapter 3, title 9, Idaho Code; seconded by Ms. Swope; motion carried.
Moved by Ms. Thompson to come out of
executive session; seconded by Ms. Huff; motion carried.
Motion made by Mr. Negaard to accept the
curriculum for the Scott Lewis School with the stipulation that the massage area
can not be part of the licensed school and can not overlap or be used for
cosmetology training, and that the statement of requirements verbiage on page 4
of the hand book be removed; seconded by Ms. Thompson; motion carried.
Moved by Mr. Negaard to accept the
curriculum for Burton Academy as written with the stipulation that they remove
the verbiage that the State Law requires a minimum of 8 hours practice on a
manikin hand with a dremal tool; seconded by Ms. Huff; motion carried.
Motion made by Ms.
Thompson to send Linda Swope to New Mexico for NIC Examiner Training upon
approval from New Mexico and to include travel days; seconded by Ms Huff; motion
carried.
Applications were reviewed and approved.
Lists of licensees are available upon request.
